WHEREAS, a petition for the annexation of certain territory to the
City of CUpertino in the Camty of Santa Clara oonsist:irq of 0.27 acre on
the north side of Hel:n¥Jsa Avenue between Byme Avenue an:l 0rarJ1e Avenue
(APN 357-16-043) has been filed with the City of CUpertino; an:l
WHEREAS, on ""'-"hoot' 19, 1988, the City Council adopted Resolution No.
7697 initiating p1.' ~i1'ÇS for annexation of the area designated ''HermJsa
Avenue 88-09"; an:l
WHEREAS, said territory is mrlnhabited an:l all owners of lan:l included
in the p1.~ consent to this annexation; an:l
WHEREAS, Section 35150.5 of the Califomia Gcvemment 0Jde states that
the Local Aqercy Fomation t'hmni RI:1ion shall not have any authority to
review an annexation to any City in Santa Clara County of \mincxn:po:tdted
territory which is within the UJ:ban service area of the city of the
annexation if initiated by resolution of the legislative body an:l
therefore the City c::cJUl'X:il of the City of CUpertino is I'IOftI the oon:iucting
authority for said annexation; an:l
WHEREAS, Gcvemment COde Section 56837 provides that if a petition for
annexation is signed by all owners of lan:l within the affected territory
the City Council may ~ or r'li ~ the annexation withQIt plblic
hearing; an:l
WHEREAS, evidence was p1.1S5Ut:ed to the City Council;
NCM, ~\JlŒ, BE IT RESOLVED by the City Council of the City of
CUpertino as follows:
1. '!hat it is the oon:iucting authority p.¡rsuant to Section 35150.5 of the
Gcvemment Code for the annexation of property designated ''HermJsa
Avenue 88-09," DK>re particularly described in Exhibit "A";

2. '!hat the following ffndin; s are made by the City Council of the City
of CUpertino:
a. '!hat said territory is uninhabited an:l oanprises awroximately
0.27 acre.
b. '!hat the annexatiCl1 is consistent with the orderly annexation of
territory with the City's uman service area an:l is consistent
with the City policy annexing when providing City services.
c. '!he city Council has CCIIpleted an initial study an:l has foun:l
that the annexation of said territory has no significant jJ¡pact
on the environment, an:l previously ~ the granting of a
Negative Declaration.
d. '!he City Council on JUne 4, 1984, enacted an ordinance prezoning
the subject territory to City of CUpertino Rl-7.5 zone.
e. Armexation to the City of CUpertino will affect no chan;Jes in
special districts.
f. '!hat the territory is within the City uman service area as
adcpted by the Local 1!qercy FcmnatiCl1 C'rImmi "'$ion.
g. '!hat the annexation is made subject to no tams an:l co1'ñitions.
h. '!hat the cnmty SUrveyor has deteJ:mined the boondaries of the
~~ annexatiCl1 to be definite an:l certain, an:l in CCIIplianoe
with the C'rImmi....iat's road annexation policies. '!he City shall

All that certain real property situate in the County of Santa Clara, State
of California, more particularly described as follows:
Being a portion of lot 53 and a portion of Hermosa Ave. as shown on that
certain map entitled, "Map of Subdivision "A" Monta Vista", recorded in
Volume P of Maps, Page 20, Santa Clara County Recorders, more particularly
described as follows:
Beginning at the Southwest corner of that certain parcel of land annexed to
the City of Cupertino entitled, "Hermosa Ave, 71-15"; said corner also being
the northeast corner of Lot 67 of said map;
Thence West 50.08 feet to the Northwest corner of said lot 67¡ said corner
also being on the southerly line of Hermosa Avenue¡
Thence North 238.42 feet;
Thence East 50.08 feet to the northeast corner of said lot 53¡ said corner
