Referenda Certification - CITY OF CUPEIQ1NO City Hall 10300 Torre Avenue Cupertino, CA 95014-3255 Telephone: (408) 777-3223 FAX: (408) 777-3366 kimberlys@cupertino.org OFFICE OF THE CITY CLERK SUMMARY Agenda Item No. 11- Meeting Date: May 16. 2006 SUBJECT AND ISSUE Receive the City Clerk's certification of sufficiency for referenda petitions against Ordinance 1975 (V al1co condominiums) and Ordinance 1977 (Toll Brothers development). SIGNATURE VALIDATION On April 19, 2006, a proponent filed petitions for the referenda of Ordinances 1975 and 1977. The Santa Clara County Registrar of Voters Office validated the signatures using the random sampling guidelines issued by the Secretary of State, and has determined that both petitions have sufficient signatures. In order to qualifY for a referendum, the proponents were required to obtain signatures of 10% of the registered voters in Cupertino, or 2,543 signatures, on each petition. The petition regarding Ordinance 1975 (Vallco) had 5,051 valid signatures, and the petition regarding Ordinance 1977 (Toll Brothers) had 4,644 valid signatures. RECOMMENDATIONS Staff recommends that the City Council accept the City Clerk's certification of sufficiency for Ordinance 1975 (Valleo) and Ordinance 1977 (Toll Brothers). The petition needed 2,543 valid signatures to pass, based on the 10% requirement of the registered voters in the City of Cupertino pursuant to California Elections Code Section 9237. We performed a random sampling of 500 of the total signatures utilizing petition guidelines issued by the Secretary of State. Based upon this sampling, the petition had a projected number of 5,051 valid signatures, which is 98.2% of the number of valid signatures required to pass, Therefore this petition has passed.
