CC Resolution No. 7867 RESOIIJTIOO' NO. 7867 A RESOIIJTION OF '!HE CITY CXXJNCIL OF '!HE CITY OF aJPERI'INO AMENDING RESOIIJTION NOS. 6901, 5214, 7255, am 7540, CITY ATIQRNEY' S caŒ'ENSATION The City Council of the City of CUpertino resolves that Resolution Nos. 6901, 5214, 7255 am 7540 are ~ as follCMS: section 8. Retainer: The City Attorney shall receive a m:mt:hly retainer from the city in the sum of $4,401. 00 which shall be considered full c:a¡¡pensation for the purposes of contributions am withholdings with respect to retirement, social security, income tax withholdings, am the like. The m:mt:hly retainer shall be paid at the em of each month on the payroll account of the City. F\1rthemore, the City shall contribute to PERS retirement am health benefits in the same am::ront it does for regular City enployees. F\1rthemore, arr;¡ rebate of PERS retirement contributions shall be at the same rate as Classified Management enployees of the city of CUpertino. section 9. l\dditional Camœnsation: In addition, the City Attorney shall receive the follCMin;J contractual services compensation. (a) 1\dministrative. 'Ib the extent that the =llective time of the City Attorney am other members of the law firm of the City Attorney, for the perfonnance of administrative services, exceeds thirty (30) hours in arr;¡ one m:mth excluding the time spent at am preparation for regular am special city Council meetin3s am Planning Commission meetings, the City Attorney shall be entitled to receive additional c:a¡¡pensation from the city at the rate of $95.00 per hour. (b) Litiqation. The city Attorney shall receive as a c:a¡¡pensation for the perfonnance of litigation services, am f= the litigation services of the Deputy City Attorney am other attorneys of the law firm of the City Attomey, c:a¡¡pensation at the rate of $95.00 per hour. Section 11. OVerhead: Except as herein otherwise expressly provided, the city Attorney shall pay for his own overllead, am that of the Deputy City Attorney am other members of the law firm of the Attorney incurred at the office located at 852 North First street, 'Ihird Floor, San Jose, -1- RESOIIJTION 00. 7867 California 95112 inc1\Jdin;J but not limited to rent, telephone, secretarial, bookkeeping, reception, postage, stationmy, office supplies, insurance, libra:ry, copying, taxes and licenses. Furthermore, telephone calls in which there is no substantive conversation betweem the city Attorney or a member of his fhm am a City Ccuncil member or City staff shall be considered part of the overtlead costs. Nevertheless, the city shall supply the City Attorney with "City of CUpertino" lettemead stationery am envelopes am shall also pay for all costs incurred in connection with maintaining the special municipal law libra:ry books owned by the City which are on loan to the City Attorney. Effective date of the above c::harqes shall be the same date as for other employees.
