CC Resolution No. 7890 RESOIIJTION No. 7890 A Resolution of the City COUncil of the city of CUpertino Certifyin;¡' the Environmental IIrpact Report for the County Hazardous waste Management Plan Arñ Approvin;¡' Said Plan WHEREAS, the County of Santa Clara, pursuant to the California Health an:i Safety Code, prepared a Draft Hazardous Waste Management Plan in April, 1989 which was subsequentlyamenied in July, 1989 in response to CCII!I!I1e!1ts from various public agencies, indust:ry groups an:i oancerne1 citizens; an:i WHEREAS, state law requires that the majority of the cities with a majority of the incorporated population nust approve said plan; an:i WHEREAS, the Draft Environmental IIrpact Report (SOl #87092903) was prepared by the County as lead Aqe:ooy, circulated to all oancerne1 parties for review an:i canunent, an:i was considered as the Final Environmental IIrpact Report at a public hearin;¡' on July 11, 1989; an:i WHEREAS, the County, at its meetin;¡' of July 11, 1989, certified that the Final Em ~lies with requirements of the California Environmental Quality Act, adopted a IroI'lÍtorin;¡' program to ensure ccarpliance with mitigation measures proposed in the FEm, an:i adopted fiIxlin:Js pursuant to section 21081 of CEQA; an:i WHEREAS, The city of CUpertino, as a Respopnsi})le Aqe:ooy in the process of preparin;¡' an:i adopting the œwMP, has considered the plan document, Em an:i IroI'lÍtorin;¡' program, an:i conducted public meetims on this matter on June 5, 1989 an:i August 14, 1989 an:i has considered all testiJocmy offered at said meetings; NCM, 'IHEREFORE, '!HE CITY CXXJNCIL OF '!HE CITY OF aJPERl'INO RESOLVES AS FOLI.CMS : 1) CEQA CXMPLIANCE: The City of CUpertino hereby fiOOs that the Envi.ronmnetal IIrpact Report is adequate an:i has been prepared in ~1iance with the California Environmental Quality Act based on review of the information contained therein. 2) IDNI'roRING PROGRAM: '!he City of CUpertino hereby attests to the adequacy of the Monitorin;¡' Program to enusre ~1iance with mitigation measures proposed in the FEm, to be carried out in accordance with the site-specific program action described in section 3 (C) of this Resolution. 3) FINDINGS: A) That the Em identified potentially significant adverse :iJrpacts resulting from inplementation of the Plan in the topic areas listed belOW', an:i are a=rpanied by appropriate mitigation measures to reduce identified :iJrpacts to insignificant levels: ram Use Flora ani Fauna Hydrology & Water Quality TranspOrtation Geology ani Soils Cl:iJnate ani Air Quality . C) '!bat these mitigation measures will be =ied out by the City at the time that a specific hazardous waste managenvant project is proposed within the City un:ler this Plan. '!he project-specific IOOlÚtorin;¡' plan will assure an 0lXJ0in;¡' review function for both general ani project related mitigation actions. 4) '!he City of CUpertino does hereby approve the Santa Clara County Hazardous Waste Managenvant Plan of April, 1989 as amen:ied.
