SEITING DATE FOR OONSIDERATION OF ANNEXING AREA DESIGNATED
"IMPERIAL AVENUE 89-09", PROPERI'Y LOCATED ON THE EAST SIDE OF IMPERIAL
AVENUE BE1IWEEN OLIVE AVENUE AND AICAZAR AVENUE;
APPROXIMATELY 0.232 ACRE, ROSA (APN 357-19-055)
WHEREAS, the City Council of the city of CUpertino has received a
request for annexation of territory designated "Inprial Avenue 89-09"
from property owners, Clarke aro. Sandra Rosa; aro.
WHEREAS, the property, 0.232± acre on the east side of Inprial
Avenue between Olive Avenue aro. Alcazar Avenue (APN 357-19-055) is
contiguous to the City of CUpertino aro. is with:in its w:ban service area;
aro.
WHEREAS, annexation would provide for use of City services; aro.
WHEREAS, this territory is uninhabited aro. was prezoned on JUne 4,
1984 to City of OJpertino Rl-7.5 zone; aro.
WHEREAS, the City of OJpertino, as Lead Agency for environmental
review c:anpleted an :initial study aro. granted a Negative Declaration for
annexation; aro.
WHEREAS, the County Sw:veyor of Santa Clara County has foun::l the map
aro. description (Exhibits "A" aro. "B") to be :in accordance with Govemment
COde Section 56826, the boumaries to be def:inite aro. certa:in, aro. the
proposal to be in c:anpliance with IAF'CX)'s road annexation policies I aro.
WHEREAS, the fee set by the COUnty of Santa Clara to ca<ler staff costs
for above certification has been paid; aro.
WHEREAS, as provided :in Govemment COde Section 56826 the City Council
of the city of OJpertino shall be con::luctin;J authority for a
reo¡:ganization including an annexation to the City I aro.
WHEREAS, Govemment COde section 56837 provides that if a petition for
annexation is signed by all owners of lard with:in the affected territory
the City Council may approve or disapprove the annexation without public
hearin;J ;

All that certain real property situate in the County of Santa Clara, State
of California, more particularly described as follows:
Beginning at the northwest corner of Lot 1, shown on that certain map
entitled "Record of Survey of Lands of R. Pedersen ",which was filed for
record on March 21,1961 in Book 130 of Maps Page 48, in the Office of the
Recorder, County of Santa Clara state of California·, more part"icularly
described as follows:
Thence NORTH 75.00 feet, along the easterly right-of-way of Imperial
Avenue, said right-of-way, also being along the easterly boundary line of
that certain annexation to the City of Cupertino by Resolution No.3109
entitled" Imperial 71-7 "¡
Thence S 89 57'30"E 135.00 feet to a point on the westerly boundary line
of that certain annexation to the City of Cupertino by Ordinance No.83
entitled" McClellan 1-A .¡
Thence SOUTH 75.00 feet, along said annexation boundary line to a point
