SEITING DP.TE FOR CX)NSIDERATION OF ANNEXING AREA DESIGNATED
''MCCLELIAN ROAD 89-10", PROPERl'Y LOCATED ON THE NORIH SIDE OF MCCLELIAN
ROAD ÞÆ MIRA VISTA; APPROXIMATELY 0.278 ACRE,
HOXSIE (APN 357-05-002)
WHEREAS, the City Council of the city of CUpertino has received a
request for armexation of territory designated ''McClellan Road 89-10" from
property owner, Rebert Hoxsie; aro.
WHEREAS, the property, 0.278± acre on the north side of McClellan
Road at Mira vista (APN 357-05-002) is contiguous to the City of OJpertino
aro. is within its urt>an service area; aro.
WHEREAS, armexation would provide for use of City services; aro.
WHEREAS, this territory is uninhabited an::l was prezoned on June 16,
1975 to City of OJpertino Rl-IO zone; aro.
WHEREAS, the City of OJpertino, as Iead Agency for environmental
review c:ampleted an :initial study aro. granted a Negative Declaration for
armexation; aro.
WHEREAS, the County SUrveyor of santa Clara County has foun::l the map
aro. description (Exhibits "A" aro. "B") to be :in accordance with Gove:rnment
Code Section 56826, the boundaries to be def:inite aro. certa:in, aro. the
proposal to be :in c:ampliance with IAFro's road armexation policies; an::l
WHEREAS, the fee set by the County of Santa Clara to caver staff costs
for above certification has been paid; an::l
WHEREAS, as provided :in Govemment Code Section 56826 the city Council
of the City of OJpertino shall be conducting authority for a
reorganization including an armexation to the City; aro.
WHEREAS, Gove:rnment Code Section 56837 provides that if a petition for
armexation is signed by all owners of lan::l within the affected territory
the City Council may approve or disapprove the armexation without public
hearin;J ;
