WHEREAS, Chapter 1.09 of the 0Jpertin0 H.micipal Code states that it
is unlawful for anytI18 in the City of 0Jpertin0 to pemit a situaticn that
is, or is likely to Þeor->, injurious to the senses, or an obstruction to
the free use of prc:party so as to interfere with the cx:mfortable enjoyment
of life or prc:party; and
WHEREAS, there is located at the All American Shq:pin;J center,

be a I1L1isance, consistin;J of, amc:n;J at:her thin:;¡s, collectia1 of trash,

exterior storage; and
WHEREAS, as provided by secticn 1.09.080, the City cnmcil shall hold

PJblic nuisance an:l, if said deteJ:minaticn is made, the City Ccuncil shall

CUpertino does, upon adcpticn of this resoluticn, establish the date of
March 19, 1990, 6:45 p.m., as the time an:ll0300 Torre Avemæ, CUpertino,
California as the place where pJblic t:e:stm:my will be taken relative to
the deteJ:mination as to whether or net a PJblic nuisance exists and if so
determined, what type of abatement is r-~~"Y.
