All that real property situate in the County of Santa Clara, State of California, and· being
a portion of that certain Parcel of land conveyed to the County of Santa Clara by Deed
recorded on October 11, 1977, in Book DI97, page 696 of the Official Records of Santa

GRANT OF WATER SYSTEM EASEMENT
Deed of water system easement is made , 1990,
by COUNTY OF SANTA CLARA, a political subdivision of the State of
california, grantor, to CITY OF CUPERTINO, a municipal corporation,
grantee.
Grantor, in consideration of COUNTY'S ability to use CITY'S fire
flow system by installing two (2) fire hydrants for the use by
COUNTY and the potable water by installing points of entry to the
water system, grants to grantee, its successors and assigns,
(a) an easement to use, own, operate, inspect, maintain,
repair and replace an existing 1,600,000 gallon water storage
facili ty, more commonly known as st. Joseph's Reservoir, owned
by CITY and being located on COUNTY land in the County of Santa
Clara, State of California as described in the legal description
attached hereto as Exhibit "A", and;
(b) a right of way and easement to install, inspect, maintain,
repair and replace water pipelines and appurtenances thereto, to
be used for transporting water for a fire flow system and potable
water supply through said pipelines. Such right of way and
easement shall be fifteen (15) feet in width on and through the
land belonging to grantor, located in the County of Santa Clara,
state of California as described in the legal description attached
hereto as Exhibit "B".
Coextensive with this right is the further right in grantee, its
successors and assigns, of ingress and egress over and on that
portion of land belonging to grantor as described in the legal
description attached hereto as Exhibit "C", to effect the purposes
of the easement. This right is conditioned on the reasonable
exercise thereof for the benefit of the dominant tenement, and in
the event of excessive use, use for non-dominant purposes, or use

by means otherwise injurious to the servient tenement, grantor
shall have the right to extinguish the easement.
In witness whereof, grantor has executed this deed on the date

OVER THE LANDS OF THE COUNTY OF SANTA CLARA
RANCHO SAN ANTONIO PARK
An easement (15.00 feet in width) for the purposes of vehicular ingress and egress over
that certain strip of land leading from Crista Rey Drive to the Saint Joseph Reservoir
located within Rancho San Antonio Park, said strip of land being situate in the County of
