A RESOI1Jl'ION OF THE CITY' CXXJNCIL OF THE CITY' OF aJPERI'INO
SEITING DATE FOR CDNSIDERATION OF ANNEXING AREA DESIGNATED
"ORANGE AVENUE 90-02", PROPEm'Y LOCATED ON THE FAST AND WEST
SIDES OF ORANGE AVENUE BEIWEEN GRANADà AVENUE AND AIMADEN AVENUE;

WHEREAS, the City Council of the city of CUpertino has received a
request for annexation of territorY designated "Oran;¡"e Avenue 90-02" from
property owners, Teny M. BrcMn, Bobby G. Bell and Rita R. Bell; and
WHEREAS, the property, 1. 73± acre on the east and west sides of orange
Avenue between Granada Avenue and Almaden Avenue (AmS 357-17-048, 49, 77,
78, 79, 357-15-12) is contiguous to the City of CUpertino and is within
its w:ban service area; and
WHEREAS, annexation would provide for use of City services; and
WHEREAS, this territory is uninhabited and was prezoned on June 4,
1984 to city of CUpertino Rl-7.5 zone; and
WHEREAS, the City of CUpertino, as Lead 1Iqency for environmental
review ~leted an initial study and granted a Negative Declaration for
annexation; and
WHEREAS, the County SUrveyor of Santa Clara County has found the map
and description (Exhibits "A" and "B") to be in accordance with Gove:rmnent
Code section 56826, the !Jourx3aries to be definite and certain, and the
proposal to be in ~liance with IAFCX)'s road annexation policies; and
WHEREAS, the fee set by the County of Santa Clara to cover staff costs
for above certification has been paid; and
WHEREAS, as provided in GovernIœnt Code section 56826 the City Council
of the city of Cupertino shall be conducting authority for a
reorganization including an annexation to the city; and
WHEREAS, Gove:rmnent Code section 56837 provides that if a petition for
annexation is signed by all owners of land within the affected territory
the City Council may approve or disapprove the annexation without public
hearirç i

CUpertino hereby initiates annexation PJ:~jrgs and will consider
annexation of the territory designated "orange Avenue 90-02" at their
regular meetinJ of May 7, 1990.
