A RESOI1Jl'ION OF THE CITY CXXJNCIL OF THE CITY OF aJPERI'INO
SEITING DATE FOR CONSIDERATION OF RIDBGANIZATION OF AREA DESIGNATED
''UPlAND WAY 89-12", PROPERI'Y IDCATED Kr THE END OF UPIAND WAY
SOU'IH OF RAINB:M DRIVE; APPROXIMA'I'EUi 4.201 ACRES,

WHEREAS, the City Council of the city of CUpertino has received a
request for reorganization of territo:ty designated "Upland Way 89-12" from
property owner, LarrY Miller; and
WHEREAS, the property, 4.201± acre at the em. of Upland Way south of
Rainbow Drive (APN 366-03-050) is contiguous to the City of CUpertino and
is within its urban service area; and
WHEREAS, reorganization wculd provide for use of City and CUpertino
Sanit:a:ty District services; and
WHEREAS, this territory is uninhabited and was prezoned on september
21, 1981 to City of CUpertino RHS zone; and
WHEREAS, the City of CUpertino, as Lead lIqerK;y for environmental
review c::arpleted an initial study and granted a Negative Declaration for
annexation; and
WHEREAS, the Coonty SUrveyor of Santa Clara County has found the map
and description (Exhibits "A" and "B") to be in a=rdance with Government
Code section 56826, the ~ies to be definite and certain, and the
proposal to be in ~liance with IAFOO's road annexation policies; and
WHEREAS, the fee set by the County of Santa Clara to OJIler staff costs
for above certification has been paid; and
WHEREAS, as provided in Goverment Code section 56826 the City Council
of the city of cupertino shall be conducting authority for a
reorganization including an annexation to the city; and
WHEREAS, Government Code section 56837 provides that if a petition for
armexation is signed by all owners of land within the affected territo:ty
the City Council may approve or disapprove the reorganization without
public hearin;J;

CUpertino hereby initiates annexation proceedings am will consider
annexation of the territo:ty designated "Upland Way 89-12" at their regular
meeting of March 5, 1990.
