GRANT OF EASEMENT
WATER LINE PURPOSES
THE ROMAN CATHOLIC BISHOP OF SAN JOSE. A CALIFORNIA SOLE CORPORATION
hereinafter called GRANTOR, hereby grants to the CITY OF CUPERTINO,
a municipal corporation, hereinafter called GRANTEE , the right to
excavate for, install, replace (of the initial or any ·other size),
maintain and use for water line purposes as Grantee shall from time
to time elect within the hereinafter described property of those
certain premises which are situate in the City of Cupertino, County
of Santa Clara, State of California, and described as follows:

Grantor hereby further grants to Grantee the right and privilege
to enter upon his lands contiguous to and along the line of said here-
inabove described strip for the purpose of locating, constructing, re-
pairing, maintaining, or replacing said water line or appurtenances
thereto, and for the purpose of doing any necessary or lawful act in
connection with the construction or maintenance of said water line
there is also granted the right of the use of sufficient land contig-
uous to said strip on either or both sides therof for the purpose of
excavation of and deposit of earth and necessary building material during
the time of constructing said water line, and any repair thereof.
The foregoing is subject to the following express conditions:

The Grantee agrees to restore the ground surface and any improve-
ments thereon to its original grade or condition insofar as it is prac-
ticable and reasonable to do so.

BEING a portion of that certain 473 acre tract of land conveyed to the
Roman Catholic Archbishop of San Francisco by deed recorded May 13,
1920 in Book 517 of Deeds at Page 40, Santa Clara County Records, and
being more particularly described as follows:
BEGINNING at the most Southeasterly corner of that certain parcel of
land described as "State of California 7096 O.R. 185" as shown on that
certain Record of Survey of the Lands of the Roman Catholic Archbishop
of San Francisco, filed for record October 16, 1969 in Book 260 of
Maps at Pages 28, 19, 30, 31, 32, Santa Clara County Records; thence
along the Northeasterly line of said Lands of the Roman Catholic
Archbishop of San Francisco as shown on said map, South 52·11'09" East
420.00 feet; thence leaving said line South 39'49'51" East 91.24 feet;
thence South 17·18'12" East B8.11 feet; thence South 13·31'44" East
561.42 feet; thence North 76·51'59" East 14.00 feet to a point lying
on the Westerly line of the Lands of the Southern Pacific Railroad as
shown on said map; thence along said Westerly line, South 12'29'39" ,
< East 15.00 feet; thence leaving said line South 76·51'59" West 28.83
feet; thence North 13'31'44" West 579.61 feet; thence North 17'18'12"
