Local Energy Code Amendments
Background
●Aug. 2022: City Council adopts CAP 2.0
●Nov. 2022: City Council adopts Ordinance No. 22-2245
(all -electric reach code – Chapter 16.32)
●Jan. 2024: California Restaurant Association v. City of
Berkeley (2024) 89 F.4th 1094
●May 2024: City Manager suspends enforcement of all-
electric reach code
Local Energy Code Amendments
●Goal: Adopt local Energy Code amendments to
encourage energy efficiency and building
electrification – no limits on type of “energy”
consumed
●Legal Standard: Local energy efficiency standards
must be “cost effective” and use less energy than the
standard requirements contained in the state Code
(24 Cal. Code Regs., Title 6, § 10-106)
Summary of Proposed Amendments
●Energy Performance Enhancements: Energy efficiency
requirements for single-family residences, multifamily
residential, and commercial occupancies
●Electric Ready Requirements:
●Electric outlets near natural gas appliances
●Ventilation for future heat pump appliances
●Reserved and labelled breakers in the electrical
panel for future electric appliances
●Proposed code amendments do not regulate cooking
equipment, dryers, etc.
Recommended Action
●Conduct a first reading of and introduce Ordinance
No. 24-2265 repealing Chapter 16.32 and adopting
local Energy Code amendments
