Alan Enterprise, LLC, a California limited liability company, grants to the CITY OF
CUPERTINO, a California municipal corporation, for public utility purposes, together with the
right, but not the obligation, to construct, repair, operate, and maintain any and all public
utilities and improvements in, on, under, along and across the real property, which shall be or
become necessary for preservation of the public safety, welfare or convenience, the real
property described in Exhibit A and shown in Exhibit B, which is situated in the City of
Cupertino, County of Santa Clara, State of Califomia.

Being a portion of Common 1 Lot "A" as said lot is shown on that certain Final map entitled. "Tract
Map No. 10587, Alan Row" recorded in Book 949 of Maps, at Pages 50 through 52, Santa Clara County
Records, and more particularly described as follows:
PUBLIC SERVICE EASEMENT No. 1
BEGINNING at a point in the easterly line of Camino Vista Drive, a public street 60 feet in width, and
also being a southwesterly corner of Common Lot "A" per said Final Map;
Thence leaving said corner and along the easterly line of Camino Vista Drive North 00°1 F35" West,
5.53 feet to a point on the southerly line of the "Private Drive", a private street varying in width, as
