Map Amendments related to implementing the 6th Cycle Housing Element (Application

Recommended Action
That the City Council take the following actions for consistency with the 6th Cycle
Housing Element, and minor edits for clarity and compliance with State law, as follows:
1. Conduct the first reading of Ordinance No. _______ “An Ordinance of the City Council
of the City Of Cupertino Amending Various Chapters in Title 14, Title 17 And Title 19,
Including But Not limited to the Addition of Three New Chapters in Title 19, to
Implement Policies in the General Plan and for Clarity” (Attachment A) as further
described in the staff report; and 2. Adopt Resolution No. ______ approving amendments
to the Heart of the City Specific Plan and the Below Market Rate Housing Mitigation
Manual to allow implementation of the Housing Element and meet the requirements of
State Law (Attachment B): and 3. Conduct the first reading of Ordinance No. ____ “An
Ordinance of the City Council of the City of Cupertino Rezoning Certain Sites in the City
for Conformance with General Plan and Housing Element” (Attachment C) to reflect
changes to Priority Housing Sites and other minor changes for internal consistency.

Staff received the following questions regarding Item #7 via email on July 1:
Q1: Why is the letter from Cupertino for All included as an attachment for this agenda
item? Are they a party of interest for this agenda item? In what way?
I believe the city has received many other emails on the matter. (Chao)

Staff response: The letter from Cupertino for All, dated June 18, 2024, was included as
Attachment D of the staff report because it was received in time to be included in the packet for
Item #7. Additional emails have subsequently been received from members of the public and will be
provided to the Council.
Q2: Has the city staff had any meeting informal or formally with Cupertino for All?
When were the meetings and who attended them. Any meeting minutes. Please disclose
them. If the city staff has met with any other advocacy group, please disclose them too.

Staff response: City staff has not had any meetings with Cupertino for All or other advocacy
groups.
Q3: What parcels would be eligible under the new corner lots policy? I continue to get
this question. Will the Cupertino Property Information site
(https://gis.cupertino.org/propertyinfo/) be updated with such information? (Chao)
Staff response: Parcels eligible for Housing Element Strategy HE-1.3.6 are zoned R-1 (single-
family) and are either corner lots or lots that abut properties that are on a major collector or
arterial street that are zoned and used for commercial development, including mixed-use
developments. This includes over 1,600 R-1 zoned properties citywide. This information will be
made available to the public via the City’s webpage.
Q4: Where can a resident find out more with comparison with corner lots and non-corner
lots? (Chao)
Staff response: The City’s Zoning Ordinance (Chapters 19.28 and 19.32) includes development
standards for the R-1 and R-2 Zoning Districts. Residential property owners can view the
standards and compare them.
