RESOLUTION NO. 24-050
A RESOLUTION OF THE CUPERTINO CITY COUNCIL AUTHORIZING
THE CITY MANAGER OR HER DESIGNEE TO (1) NEGOTIATE AND
EXECUTE REQUIRED MEMORANDUMS OF AGREEMENT AS A
COALITION PARTNER AGENCY FOR THE PURPOSE OF SECURING
GRANT FUNDS FROM THE UNITED STATES ENVIRONMENTAL
PROTECTION AGENCY’S CLIMATE POLLUTION REDUCTION GRANTS
PROGRAM BY JULY 1, 2024; AND (2) NEGOTIATE AND EXECUTE ANY
DOCUMENTS NECESSARY TO ACCEPT AND EFFECTUATE THE GRANTS
WHEREAS, the Climate Pollution Reduction Grant Program provides $5
billion in grants to states, local governments, tribes, and territories to develop and
implement ambitious plans for reducing greenhouse gas emissions and other
harmful air pollution; and
WHEREAS, pursuant to Section 60114 of the Inflation Reduction Act, this
two-phase program provides $250 million for noncompetitive planning grants and
approximately $4.6 billion for competitive implementation grants; and
WHEREAS, awards are expected to range from $2 million to $500 million
across five funding tiers; and
WHEREAS, the County of Santa Clara submitted a Priority Climate Action
Plan to the Environmental Protection Agency (EPA) on behalf of communities in
Santa Clara and San Benito Counties, enabling eligible member agencies,
including Cupertino, to apply for competitive implementation grants; and
WHEREAS, priority for the competitive implementation grant funds seeks
to achieve substantial community benefits such as the reduction of air pollutants
in communities that have high levels of fine-particle pollution, are in proximity to
Superfund sites, and have linguistic isolation; and
WHEREAS, Cupertino has census tracts that are considered to have high
levels of fine-particle pollution, proximity to Superfund sites, and have linguistic
isolation as defined by the EPA; and
WHEREAS, the City intends to serve as a coalition partner agency,
demonstrating a collaborative and regional approach to maximizing greenhouse
gas reductions and community benefits; and

WHEREAS, Cupertino submitted letters of intent to enter in
Memorandums of Agreement with participating agencies as part of two coalition
grant applications; and
WHEREAS, if awarded grant funds, the City of Sunnyvale will be the lead
agency and fiscal agent of the Community-Scale Reusable Foodware System
Design and Implementation Project and Cupertino will partner with the City of
Sunnyvale, the City of Mountain View, the City of San José, and the San Benito
County to support implementation of the project, receiving no funds directly; and
WHEREAS, if awarded grant funds, Cupertino will partner with Mountain
View, Morgan Hill, San José, and Sunnyvale, led by Silicon Valley Clean Energy,
to electrify and fortify critical facilities that serve a community’s most urgent needs
during emergencies as part of the Public Facility Resiliency Implementation
Project; and
WHEREAS, Cupertino is proposing to upgrade and electrify Quinlan
Community Center water heating, space heating, and space cooling equipment to
reduce greenhouse gases and increase resiliency during extreme heat and
dangerous air quality events because of climate change at an estimated labor and
equipment cost of approximately $1.9 million over five years; and
WHEREAS, in order to receive grant funds, applicants are required to
negotiate and enter into Memorandum of Agreements with participating agencies
by July 1, 2024; and
WHEREAS, staff recommends that the City Council authorize the City
Manager or their designee negotiate and execute the required Memorandums of
Agreement with participating agencies by July 1, 2024 to ensure the City is eligible
to receive grant funds;
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby
authorize the City Manager or their designee to negotiate and execute on behalf of
the City the required Memorandums of Agreement with participating agencies by
July 1, 2024 for the purpose of securing grant funds from the EPA’s Climate
Pollution Reduction Grants program;
