WHEREAS, that portion of a City street known as Scenic Circle at Palm
Avenue am mre particularly described in description am map attached
hereto am made part hereof as Exhibits "A" and "B", respectively, is
unnecessazy for present or pxœpective public street puzposes; am
WHEREAS, said portion will be retained as a public service easement;

WHEREAS, the City Council elects to þL~ p.¡rsuant to the provisions
of Section 8320 et seq. of the streets am Highways Code of the state of
California;
WHEREAS, it is d.......,.,r to be in the public interests that the City
Council elects to proceed to order said vacation;
NOO, nmREroRE, BE IT RESOLVED that the City Council hereby declares
it intention to vacate the aforesaid portion of City street.
BE IT FURlHER RESOLVE:
1. '!bat the 6th day of May, 1991, at 6:45 p.m., in the Council
Chamber, City Hall, 10300 Torre Avenue, CUpertino, California is the time
and place fixed for hearing on the above proposed vacation;
2. '!hat the aforesaid date is not less that 15 days fran passage of
this resolution p.¡rsuant to law;
3. '!hat the City Clerk shall cause a certified copy of this
resolution to be published in the manner prescribed by law, and shall
cause certified CXJpies to be posted alon:J the line of said property
proposed to be vacated at least 10 days before the date of hearing am no
more than 300 feet apart with a minimum of three (3) being posted.

COUNTY OF SANTA CLARA. STATE OF CALIFORNIA. described as follows:
Beginning at a point on the Easterly line of Lot 34 as shown on
the map of "Monta Vista Park". recorded in Book "P" of Maps at
Page 19, Santa Clara County Records, said point being the South-
erly terminus of that certain course shown as North O' 07' East
(said bearing being taken as North O' 07' 42" West for purposes
of this description), 100.12 feet on said map; thence following
said Easterly line of Lot 34. along the arc of a tangent curve to
the right with a radius of 15.00 feet, through a central angle of
90' 00' 00". an arc distance of 23.56 feet to the Northeast
corner of that certain parcel. formerly Palm Avenue. described
in Lot Line Adjustment Resolution No. 8202. recorded August 14.
