OF THE STREE.TS AND HIGHWAYS roDE OF THE STATE OF CALIFORNIA
WHEREAS, hearing on Resolution of Intention No. 8361 was held on May
6, 1991, at a regular meeting of the City Council at 10300 Torre Avenue,
CUpertino, California; and
WHEREAS, it appears that notice thereof was duly given as required by
law; and
WHEREAS, from the evidence presented, both oral and documentary, it
appears to be to the best interest of the City to vacate the hereinafter
described portion of a City street; and that said portion of said City
street is unnec::essaxy for present or prospective public street purposes;
and
WHEREAS, existing streets are adequate to handle present and future
projected traffic; and
WHEREAS, vacation is in conformance with the City's General Plan;
New, ~ut<E, BE rr RESOLVED:
1. That all or arr;¡ protests against the vacation of said portion of
City street be and hereby are overruled and denied;
2. That said portion of Miramonte Read described and shown in
Exhibits "A" am "B" attached hereto and made part hereof, be and
hereby is vacated.
BE IT FURlHER RESOLVED:
That the City Clerk be and hereby is instructed and directed to cause
a certified copy of this resolution, attested to and sealed with the
official seal of the city, to be recorded with the County Recorder of the
County of santa Clara, California, forthwith.

All that real property situated in the County of Santa Clara, ~tate of
California, more particularly described as follows:
Beginning at a point at the 'intersection of the northeasterly line of
Miramonte Road, 40 feet in width,with a line parallel to and measured
ten (10) feet perpendicular distant southeasterly from the north-
westerly line of Lot 44, as said Miramonte Road and Lot 44, are shown
upon the "Map of 9th Addition ~ionta Vista", a !1ap of which is recorded
in Book "P" of t1aps, page 16, Santa Clara County Records; thence along
the said northeasterly line of t,1iramonte Road S 39° 12' 11" E, 38.39
feet to the beginning of a tangent curve; thence on a curve to right,
having a radius of 30 feet, through a central angle of 78° 24' 22",
for an arc length of 41.05 feet to a point on the center line of said
Miramonte Road; thence along the said center line of fliramonte Road,
N 39° 12' 11" E, 66.67 feet to the intersection thereof with the south-
westerly prolongation of the said parallel line, parallel to and
measured ten (10) feet perpendicular distant southeasterly from the
northwesterly line of Lot 44; thence along the said southwesterly
prolongation, N 50° 47' 49" E, 20.00 feet to the point of beginning.
