WHEREAS, the a¡:p1icant has met the burden of proof required to su¡;port
his said a¡:plication¡ and
WHEREAS, the Planning Camtission, after duly noticed public hearings,
has forwarded its reccmœndations to the City Council.
1!U'l, THEREFORE, BE IT RESOLVED that after careful oonsideration of
maps, facts, exhibits and other evidence sul:mitted in this matter, the
a¡:plication for the Variance (2-V-9l) be and the same is hereby awroved
with the following a:mditions and findings:
FINDIN:;S:
l. '!hat there are exceptional circumstances a¡:plying to the land,
use and building referred to in the a¡:plication which do not
a¡:ply generally to land, buildings or uses in the same district.
2. That granting of the a¡:plication is necessary for the
preservation and enjoyment of substantial property rights of the
petitioner .
3. '!hat granting of the Variance will not affect adversely the
health and safety of the cxmnunity, or produce eoonanic injmy to
the subject neighborhood.
BE IT FUImIER RESOLVED that the City Clerk be and is hereby directed
to notify the parties affected by this decision.
