CC Resolution No. 8466 RESOI1JTICN 00. 8466 A RESOI1JTICN OF THE CITY axJNCIL OF THE CITY OF aJPERI'IN:> AMENDDC THE ENVIRCNoIENTAL ASSESSMENT PROCEOORE AS ORIGINALLY ~.1r;u ON MARCH 27, 1973 AND AMENDED ON MARCH 4, 1974, ~Y 17, 1977, MAY 1, 1978, JULY 7, 1980, AND MARCH 13, 1984 WHEREAS, the California Environmental Quality Act requires local g:wernments to adopt procedures to detennine the potential inpact of their decisions on the enviromnent; and WHEREAS, the California EnviroIuœntal Quality Act Guidelines enable local g:wernments to adopt said guidelines by reference; and WHEREAS, said guidelines adopted by reference may <x>ntain ack:litional procedures tailored to meet the specific needs of a local jurisdiction. 1Ol, 'IHEREFORE, the City Council of the City of CUpertino does hereby rescind previously adopted local guidelines and adopt the state CI!X)A Guidelines and the following local provisions which establish the duties of the Enviromnental Review Camtittee and set forth a fee for Environmental Assessment. l. Calp)sition of Environmental Review Camtittee '!he EnvÍLúr:llIental Review Camtittee (ERe) is CXIlp>Sed of one City Council perBOIl, one Planning Camtissioner, the City Manager, the Director of Public 'l'brks and the Director of O:mmmity Develoµœnt, or their designated alternates. 2. Duties of the Environmental Review Camtittee a. All discretionary projects which are not catecprically exeupt or otheJ:WÌse exa¡pted fran further envÍLuulueontal assessment, shall be forwarded to the Environmental Review Camtittee. b. '!he Camtittee shall evaluate the Initial study of a proposed project to detennine whether the project mayor may not have a significant effect on the environment. c. If a detennination is made that the project will not have a significant inpact on the environment, the Camtittee will reccmœnd that the final reviewing authority (decisiOIJll'Blœr) grant a Negative Declaration. " RESOllJTION 00. 8466 d. If a detennination is made that the project may have a significant inpact on the enviromœnt, the Ccmnittee shall require the preparation of an Enviromœntal Inpact Report. '!he major areas of concern, the selection of the prepared, and the preparation of the SIR shall be coordinated by the ERe not including the City Council and the Planning Ccmnission neòJers. The project sponsor may aweal a decision to prepare an SIR to the City Council. The City Council may reject or sustain the aweal. If the City Council detennines that an SIR is not necessæ:y, the project shall be retumed to the ERe for further consideration.
