WHEREAS, the applicant has met the burden of proof required to sUR?Ort
his said application; and
WHEREAS, the planning Cannission, after duly noticed public hearings,
has foI:Warded its recxmnendations to the City Council.
N:M, 'mEREFORE, BE IT RESOLVED that after careful consideration of
maps, facts, exhibits am other evidence subttitted in this lliitter, the
application for the Variance (3-V-9l) be and the same is hereby approved
with the following cxmditions and findings:
FINDIN:;S:
1. '!hat there are exceptional circumstances applying to the lard,
use and building referred to in the application which cb not
apply generally to lard, buildings or uses in the same district.
2. '!hat granting of the application is necessary for the
preservation and enjoy¡ænt of substantial property rights of the
petitioner .
3. '!hat granting of the Variance will not affect adversely the
health and safety of the CXIIII1UI1Íty, or produce eronani.c injury to
the subject neighborhood.
BE IT FOImIER RESOLVED that the City Clerk be and is hereby directed
to notify the parties affected by this decision.
