WHEREAS, hearing on Resolution of Intention No. 8490 was held on
October 7, 1991, at a regular Iœeting of the City Council at 10300 '!brre
Avenue, CUpertino, California; and
WHEREAS, it appears that notice thereof was duly given as required by
law; and
WHEREAS, fran the evidence presented, both oral and documentaJ:y, it
awears to be to the best interest of the City to vacate the hereinafter
described portion of a City street; am that said portion of said City
street is unnecessary for present or prospective public street pw:poses,
but is necessary to be retained as Public utility Easanent, Public Service
Easement, and SanitaJ:y Sewer Easement.
WHEREAS, existing streets are adequate to handle present and future
projected traffic; and
WHEREAS, vacation is in cxmfonnance with the City's General Plan;
N:M, 'lHEREFORE, BE IT RESOLVED:
l. '!hat all or arr;¡ protests against the vacation of said portion of
City street be and hereby are overruled and denied;
2. '!hat said portion of Peninsula Avenue described and shown in
Exhibits "A" and "B" attached hereto and made part hereof, be am hereby
is vacated, but is retained as Public utility Easanent, Public Service
Easement, am SanitaJ:y Sewer Easanent.

DESCRIPTION FOR THE ABANDONMENT OF A PORTION OF
PENINSULA AVENUE WITHIN
THE CITY OF CUPERTINO. CALIFORNIA
All that certain real property situated within the City of
Cupertino, County of Santa Clara. Sëate of California. being a
portion of Peninsula Avenue as shown upon the map entitled "MAP
OF MONTA VISTA FIRST ADDITION", filed in Book P of Maps at Page
23, Santa Clara County Records, and also as shown upon the map
of Tract No. 6919 Amended filed in Book 499 of Maps at Pages 8,
9 and 10, Santa Clara Councy Records. described as follows:
Beginning at the im:ersection of the monument line of
Peninsula Avenue, as relocated, WiTh the monument line of Stevens
Creek Boulevard, as said monument lines are shown upon Record of
Survey filed in Book 310 of Maps at ?age l5, Santa Clara County
Records; thence from said point of beginning along said Stevens
Creek monument line P.ast 219.00 feet; thence leaving said line
at right angles North 45.00 feet to che true point of beginning
of the herein described parcel.
Thence from said true point of jeginning and parallel with
said Stevens Creek monument line WeSé 70.04 feet to the intersec-
tion thereof with the Southwesterly ~ine of Peninsula Avenue, 40
feet in width; thence along a non-tangent curve to the right
having a radius of 627 feet (a radial line of said curve through
said point bearing N17'13'04"E), through a central angle of
11' 01' 42" an arc length of 120.69 feet (a radial line through
said end of said curve bearing N28 "l4' 46 "E) ; thence along a
non-tangent curve to the left having a radius of 3l2.60 feet (a
radial line of said curve through said point bearing S66'44'42"W),
through a central angle of 6"48'59" an arc length of 37.19 feet
(a radial line through said end said end of said curve bearing
S59' 55' 23 "101) ; thence leaving said curve non-tangentially and
along the Southwesterly prolongation of the Northwesterly line
of Lot 13, Block 3, of the hereinabove mentioned "MAP OF MONTA
VISTA FIRST ADDITION". N30'42' 30"E 19.40 feet to a point on the
Northeasterly line of peninsula Avenue, 40 feet in width; thence
Southeasterly along said line of Peninsula Avenue along a non-
tangent curve to the left having a radius of 587 feet (a radial
line of said curve through said point bearing N3l'08'06"E)through
a central angle of 18' 55 ' 02" an arc length of 193.81 feet to a
point of cusp (a radial line through said end of said curve
bearing N12'13'04"E); thence leaving said curve non-tangentially
and along a Southwesterly line of the hereinabove mentioned map
of Tract No. 6919 Amended S27"44'E 18.64 feet to the most South-
erly corner thereof; thence South 8.70 feet to the true point
of beginning.
