District an easement to Regnart Creek in cxmjunction with the wilson Park

PARCEL A
That certain real property situate in Lot 19 of Tract 8332 as shown on that certain Tract Map filed for
record in Book 629 of Maps at pages 35 & 36, Santa Clara County Records and lying within the City
of Cupertino, County of Santa Clara, State of California, described as follows;
Beginning at the most southeasterly corner of said Lot 19; thence westerly along the southerly line of said
Lot 19 N 80049'44"W 50.68 feet; thence northerly along a westerly line of said Lot 19 N OOI2'42"W
15.20 feet; thence S 80049'44"E 50.68 feet along a line parallel with and distant northerly 15.00 feet
measured at right angles from said southerly line to the easterly line of said Lot 19; thence southerly
along easterly line S 0°12'42" 15.20 feet to THE POINT OF BEGINNING.
Containing 760 square feet, or 0.017 acre of land, more or less.
Said easement area shall be kept clear of any type of building, fences, structure, payement or trees, unless
prior written approyal is obtained from District.
The easement shall include the right to construct, reconstruct, inspect, maintain and repair a channel,
protection works and appurtenant structures, together with the right to trim or remoye such trees or brush
within the easement area as may constitute a hazard to persons or property or may interfere with the use
of the said area for the purposes granted. It also shall include the right to enter upon said land with
yehicles, tools, implements, and other materials, take therefrom and use, earth, rock, sand and grayel
for the constructiorl, maintenance and repair of said channel, protection works and appurtenant structures
by said District, its officers, agents, and employees, and by persons under contract with it and their
employees whenever and whereyer necessary for flood control or storm drainage purposes.
Together with an easement for ingress and egress purposes oyer the area identified as Parcel B, below.
Said easement shall be kept clear of anything that would interfere with ingress and egress to and from
Regnart Creek. District shall assume no maintenance responsibility for said ingress and egress easement
and shall not be held liable for damages that result from lawful District operations.
PARCEL B
A 20.00 foot wide easement situate in Lot 19 of Tract 8332 as shown on that certain Tract Map filed for
record in Book 629 of Maps at pages 35 & 36, Santa Clara County Records and lying within the City
of Cupertino, County of Santa Clara, State of California, described as follows:
Commencing at the most southwesterly corner of said Lot 19; thence easterly along the southerly line of
said Lot 19 S 80049'44"E 9.00 feet to the TRUE POINT OF BEGINNING; thence N 9°10'16"E 47.90
feet to a point on the southerly line (Cul-De-Sac Bulb) of Parks ide Lane; thence northeasterly along said
southerly line along a non-tangent curve to the left, concaye northerly with a radius of 42.00 feet from
which the radial line bears N 6°36'51"W through a central angle of32°39'05" for an arc length of23.93
feet; thence S 9°1O'16"W 60.45 feet to the southerly line of said Lot 19. Thence westerly along said
southerly line N 80049'44"W 20.00 feet to THE TRUE POINT OF BEGINNING.
Containing 1 ,057 square feet, or 0.024 acre of land, more or less.
