CC Resolution No. 8617 REOOIJmW ID. 8617 A RESOllJTIW OF THE CITY <IXJNCIL OF THE CITY OF aJPERl'IID DESIGNATllC THE SANm CIARA <XUNTY CIN;ESTIW MANI\GEMENT AGENCY AS RECIPIENT OF AND 0IlERALL PROGRAM MAm\GER FOR AB 434 (SHER-1991) VEHIC[E REX;IS'lRATIW FEE REVENUES WHEREAS, the State of California enacted the California Clean Air Act of 1988 requiring air districts to adopt and cities and CDunties to iltplarent certain transportation exmtrol neasures in order to ilIprove air quality; and WHEREAS, the State of California enacted Congestion Management Legislation in 1989 and 1990 requiring cities and CDUIlties to iltplarent Congestion Management Programs (CMP) to reduce traffic cxmgestion and iltprove air quality; and WHEREAS, the CDunty and the cities of Santa Clara County have in response to the aforaœntioned state legislation created the Santa Clara County Congestion Management Agency; and WHEREAS, the Santa Clara County Congestion Management Agency operates the Camn1ter Nebiork Transportation Danand Management Program for the benefit of its III!!IÙ:Jer agencies; and WHEREAS, the State of California enacted AB 434 (Sher) in 1991 to provide vehicle registration fee revenues to fund certain transportation exmtrol neasures through the subvention of forty per cent of the CDUIlty'S proportionate share of the revenue to a designated countywide overall ~~CIlU manager; and WHEREAS, in order to qualify for the subvention of forty per cent of the CDUIlty'S proportionate share of the revenue, the County Board of SUpervisors and a majority of the cities with a majority of the population must designate, by resolution, a CDuntywide overall program manager to iltplarent local programs and projects. NCM, 'ffiEREFORE, be it resolved, the City Council of the City of CUpertino designates the Santa Clara County Congestion Management Agency as the CDunty wide overall program manager for projects and programs and the recipient of the County's forty per cent proportionate share of the fee-paid vehicle registration fee revenues according to the following tenns and CDnditions. '!he Santa Clara County Congestion Management Agency shall: -1- RESOliJ'l'IW ID. 8617 1. Develop, inplaœnt and administer transportation <x>ntrol projects and programs as set forth in state statutes. 2. '!he projects and programs so developed, inplemented and administered shall be in<x>rporated into the annual budgets and work PJ.uy<.<1u" of the Congestion Management Aqency and the Catmuter Network Transportation Demand Management Program. 3. '!he Congestion Management Aqency will encuntJer the funds within two years of receiving the funds. 4. '!he Congestion Management Aqency will, at least once every two years, undertake an audit of each project or program funded accx>rdi.ng to the <x>nditions set forth in state statutes.
