ES'mBLISHThG '!HE BARBARA RCŒ:RS 'IRUST FUND

WHEREAS, BaJ:bara Rogers has served as a City CouncilIœnber fran 1978
to 1991, a period of thirteen years, and has served as the City's Mayor in
1980-81, 1985-86 and 1989-90; and
WHEREAS, she has been inst.nnœntal in providing leadership to the
cxmnunity and has rendered a great service to the people of CUpertino; and
WHEREAS, private individuals have donated sums of ncney to BaJ:Dara
Rogers for the establishment of the BaJ:bara Rogers Trost Fund, and have
requested that the City of CUpertino administer said private sums for the
benefit of the trust and for the purpose of distributing funds to ~rthy
programs which best reflect Barbara Rogers' activities in cxmnunity
affairs.
N:M, 'nIEREFURE, IT IS HEREBY RESOLVED:
1. 'Ihe City hereby accepts the sum of $3,836.16 representing the
donation received fran various private individuals, under the teJ:ms and
conditions of this resolution.
2. Said funds, together with any other private donations, will be
deposited by the City Director of Finance into a special BaJ:Dara Rogers
Trost Fund acoount which will be maintained separate and apart fran any
other acoount of the City. No public funds shall be deposited in said
account. 'Ihe Director of Finance shall be responsilile for investing and
reinvesting said funds utilizing the same standards of investment which
apply to public funds held by the City.
3. Any net incx:me not distributed under the teJ:ms of this resolution
shall be accumulated and added to the principal of the fund.
4. A cx:mnittee consisting of the City Manager of the City of
CUpertino, the Director of Finance for the City of CUpertino, and BaJ:Dara
Rogers, or her designee, shall fran tiJœ to tiJœ detenni.ne, in their sole
discretion, the awropriate programs which ~uld receive distributions of
principal or interest fran the fund; provided, however, that any program
receiving funds fran the BaJ:Dara Rogers Trust Fund must, in the opinion of
the cx:mnittee,
a) Directly benefit the CUpertino cxmnunity.

b) Be representative of BaJ:bara Rogers' activities in cxmnunity
affairs, including but not limited to arts and culture, education, the
needy, histo:ry, recreation, \\'aIIeI1' s issues and public safety.
5. Twenty-one (21) years after the death of Barbara Rogers, all funds
remaining in the BaJ:bara Rogers Trost Fund shall be transferred to the
general fund of the City of CUpertino free of any restrictions cxmtained
in this resolution.
6. Any actions taken by a najority of the cx:mnittee are binding on
the fund.
7. Any designation for an alternate representative for BaJ:bara
Rogers must be made in writing. Upon her death, her designee will
cxmtinue to serve on the trust fund cx:mnittee. In the event no
designation is made of a representative for BaJ:bara Rogers after her
death, the other IœIIiJers of the cx:mnittee shall select such a
representative .
