CC Resolution No. 8790 RESOliJTICN NO. 8790 A RESOliJTlOO' OF THE CITY axJNCIL OF THE CITY OF aJPERI'INO RESCINDIN} RESOliJTICN NO. 8357 AND ESTABLISHING RIJIES GOIIERNING RECRIJI'IMENT, APPOINIMENT AND REAPPOINIMENT '10 CITY ADVIS<RY OODIES WHEREAS, the City Council of the City of Cupertino wishes to establist unifoD1l teIIns and mnditions of office to advisory Ccmnittees anc' Ccmnissions; and WHEREAS, there are within the City of CUpertino many citizens witt talent, expertise and experience who wish to serve the cx:mnunity; and WHEREAS, the City Council believes it is iIIportant to provide these citizens the opportunity to contribute to their cx:mnunity; NCM, THEREFORE, BE IT RESOLVED that the City Council of the City of CUpertino establishes the follCMing rules çpverning recruitment, awointment and rea¡:çointment to City of CUpertino advisory bcxlies. A. RECRIJI'IMENT 1. '!\\U IIDnths before regular teIIns expire, or imœdiately follCMinç receipt of a resignation, the Public Infonnation Officer publishef notice of vacancies in the CUœrtino Scene and newspapers and puts the infonnation on cable TV. 2. '!\\U deadlines are included in the notices. The awlication period iE extended for five days if an inctmtJent has not awlied by the first published deadline. During the extended period on! y noninctmtJents mal' awly. 3. Applications will be kept active for a maxiroum of one year after Council review. 4. 'lhose persons with awlications on file are advised of the vacancy by the City Clerk and may activate that awlication. The awlication is not reactivated autanatically. Upon receipt of the notice, the awlicant IIILISt call the City Clerk's Office and state s/he wishes tc be considered. 5. An awlicant may file for a maximum of bio cx:.mnissions at anyone awlication period. -1- '. RESOllJTICN 00. 8790 6. A III8IIDer of an advisory body, having cœpleted biio consecutive t.enns, must wait one year before being eligible to a¡::ply for the sane ccmnission or ccmnittee. 7. Notice of vacancies will be distributed by the City Clerk to the Chamber of Camlerce, service organizations, and other organizations as a¡::propriate with respect to the openings. 8. Notices of the vacancies will be posted in the City Clerk's office. 9. ~lication fonns will be available in the City Clerk's office and will be mailed with info:rmation about the openings upon request. 10. When the final deadline has passed, the City Clerk's Office will mail a¡::plicants the date, tiIœ and location of the interviews along with sanple questions to consider. 11. The City Clerk's Office will ropy the a¡::plicant's materials for CounciJmembers. The material will also be available for public review in the City Clerk's Office and the CUpertino Library. B. INTERVIEWS AND APPOIN'lMENTS 1. After review of the a¡::plications and other material, any additional question a Counci1naò:Jer wants to have asked will be forwarded to the Mayor prior to the meeting. Follow-up questions may be asked by other CounciJmembers during the interviews. 2. All a¡::plicants shall be present in the roan when the meeting is called to order. The Mayor will then explain the process and ask that they leave the roan until it is tiIœ for their interview. '!his is optional as the meeting is public. After the a¡::plicant is interviewed, sjhe may choose to remain in the roan. 3. 'lhe order in which interviews are scheduled to take place will be determined by a drawing of naIæ8. This will be done in advance by the City Clerk. 4. Interviews are info:rma1 and usually last 5-10 minutes. CouncilIœltiJers are looking for: (a) familiarity with the subject; (b) decision-making ability; (c) ccmnit:Iænt to the position a¡::plied for -2- RESOLUTICN 00. 8790 5. A¡:poinbœnt will be made following a vote in public. Ballots will be distributed, the Counci1.members will vote and sign the ballots. votes will be announced by the City Clerk. 'Ihe nUJ1i:)er of ballots will be determined by the mmiJer of awlicants and vacancies. (Guidelines for determining the mmber of ballots is attached Exhibit "A".) 6. Following awoinbœnts, all awlicants will be sent a letter am awlications will be kept for one year. 7. Presentation of Certificate of A¡:poinbœnt will be scheduled for the next Council meeting. C. GENERAL PROITISICNS 1. If a vacancy occurs for an unexpired tenn and interviews for awoinbœnt to that advisory body have been oonducted within the previous ninety clays, the unexpired tenn may be filled fran those awlications following the required posting of the vacancy. 2. Restrictions listed in this resolution do not awly to t.aIporary appoinbœnts for unexpired tenns. 3. A JœIIiJer shall be considered ralDVed fran an advisory body under the following conditions. (a) A naId:Jer misses IIDre than three consecutive meetings. (b) A JœIIiJer misses 25% of the body's meetings in a calendar year. 4. No awlication shall be accepted after the deadline.
