RESOLUTION NO. 8876
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
AMENDING RESOLUTION NO. 8653 wmCH ESTABLISHED THE
BARBARA ROGERS TRUST FUND AND PROVIDED FOR THE
ADMINISTRATION THEREOF
WHEREAS, on May 18, 1992, the City Council of the City of Cupertino adopted
Resolution No 8653 establishing the Barbara Rogers Trust Fund and providing for the
administration thereof; and
WHEREAS, it has been requested by Barbara Rogers that the resolution be
amended to allow any decision by a majority of the committee administering the fund to be
vetoed by her or her designee;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Cupertino hereby amends Resolution No. 8653 to read as per Exhibit" A" attached.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Cupertino this 17th day of May ,1993, by the following vote:

WHEREAS, BartJara Rogers has served as a City eouncilmelrtJer fran 1978
to 1991, a period of thirteen years, and has served as the City's Mayor in
1980-81, 1985-86 and 1989-90; and
WHEREAS, she has been instruIœntal in providing leadership to the
cxmm.mity and has rendered a great service to the people of CUpertino; and
WHEREAS, private individuals have donated S1.DTIS of IIDIley to BartJara
Rogers for the establisluœnt of the BartJara Rogers Trust Fund, and have
requested that the City of Cupertino administer said private S1.DTIS for the
benefit of the tJ:ust and for the pw:pose of distributing funds to worthy
j,1L~CI1'" which best reflect BartJara Rogers' activities in cxmm.mity
affairs.
K:M, 'lHEREFœE, IT IS HEREBY RESOLVED:
1. '!he City hereby accepts the sum of $3,8336.16 representing thee
donation received fran various private individuals, under the teJ:1rIs and
conditions of this resolution.
2. Said funds, together with any other private donations, will be
deposited by the City Director of Finance into a special BartJara Rogers
Trust Fund acaount which will be maintained separate and apart fran any
other account of the City. No public funds shall be deposited in said
account. '!he Director of Finance shall be responsible for investing and
reinvesting said funds utilizing the same standards of i.nvestnent which
apply to public funds held by the City.
3. Any net ina:me not distributed under the teJ:1rIs of this resolution
shall be accunn1lated and added to the principal of the fund.
4. A cx:mnittee cxmsisting of the City Manager of the City of
Cupertino, the Director of Finance for the City of Cupertino, and BartJara
Rogers, or her designee, shall fran time to time deteDnine, in their sole
dìscretion, the éa!¥LUj,1Liate programs which would receive distributions of
principal or interest fran the fund; provided" however, that any program
receiving funds fran the BartJara Rogers Trust Fund Im1St, in the opinion of
the cx:mnittee,

a) Directly benefit the Cupertino cx:mmmity.
b) Be representative of Barbara Rogers' activities in cx:mmmity
affairs, including but not limited to arts and culture, education, the
needy, history, recreation, w::JOen's issues and public safety.
5. 'lWenty-one (21) years after the death of Barbara Rogers, all
funds remaining in the Barbara Rogers Trust Fund shall be transferred to
the general fund of the City of Cupertino free of any restrictions
exmtained in this resolution.
6. Any decision by a majority of the amnittee may be vetoed by
Barbara Rogers or her designee.
7. Any designation for an alternate representative for Barbara
Rogers must be made in writing. upon her death, her designee will
continue to serve on the trust fund amnittee. In the event no
designation is made of a representative for Barbara Rogers after her
death, the other JTeItJers of the amnittee shall select such a
representative.
