between the City of CUpertino, hereinafter referred to as "City",
ani representatives of the CUpertino Ðtployees 1Issociation,
hereinafter referred to as "1Issociation" , sets forth the
a.,¡...eeme¡tt resulting fran several tii""""""'ions held between these
two parties concerning the wages, hours, terms, ani c:cniitions of
enployment for the arployees of the Miscellanea1S Ðlployees Unit
of the City, for which the 1Issociation is the recognized sole ani
exclusive representative. '!his i!':leement represents the full ani
integrated agreement reached between the parties.
SECl'ICN 1: NO DTSCRIMINATICN
City ani 1Issociation agree they shall not discriminate in arr¡
way on aOOClIDt of race, creed, religion, sex, age, national
origin, political affiliation, sexual preference, or for
1Issociation activity.
SECl'ICN 2: SAIARY sæEWlE

appropriate Schedule of Pay Grades effective June 14, 1993.

SECI'ION 3: OO'I'-OF....çu,ss WAGE PAY
'I'eirq:x:)rary assignment, approved in advance by the Department
Head, to a classification in a higher pay grade shall be
compensated at the step 1 rate of the higher classification, or
at a rate five percent greater than that of the regular position,
whichever is greater, for the rn.unber of hours so assigned.
SECI'ION 4: HOORS OF WJRK: 0VERl'IME
Hours of Work Defined
Hours INOrJœd shall include all time not under the control of
the enployee whether such hours are INOrJœd in the City's INOrk
place, or in sane other place where the euployee is can:yin;J oot
the duties of the City.
'!he nomallNOrk 'Neek shall be 40 hours in seven days.

It will be a management responsibility to schedule the hours
of INOrk for each euployee covered by this agJ:e..u.ent. Except in
unforeseen circumstanoes, chan;Jes in enployee's hours of INOrk

Rest Periods
Each euployee shall be granted a rest period of fifteen
minutes durin;J each INOrk period of nore than three hours
duration. No wage deduction shall be made nor time off charged
against enployees ~ authorized rest periods, nor shall any
rights or overtime be accrued for rest periods not taken.

Overtime
Overtime shall be defined as any 1tIOrk in excess of regular
1tIOrk hours defined above. Holidays am paid time off shall count
toward the acx::uIm1lation of the 1tIOrk week.
Overtime 1tIOrk for the City by an enployee shall be authorized
in advance by the Department Head or their designee. In the event
of unforeseen circumstances, overtime shall be ~ after the
work is CXIIpleted.
Pavment of Overtime
All ~ed overtime 1tIOrk performed by enployees shall be
paid at the rate of one am one-half (1 1/2) t.iJnes the nonnal
rate of pay. Work performed on regularly så1eduled days off,
City Holidays or durin; an enployee's så1eduled vacatioo shall be
considered to be overtime am paid aCXlOl'Ciin;ly.

At the enployees discretion, ........t"'IJSatory time off may be
granted for overtime worJœd at the rate of time am one-half for
each hour 1tIOrXed in lieu of oœpensatioo in cash. Ðrployees who
have previoosly eaznecJ. oœpensatory time, shall be allowed to
sc:hedule .......'l-""'lSatory time off at dates of the enployee's
selection provided: 1) that prior supervisory awroval has been
obtained, am 2) it is taken prior to the first pay period in
~r am 3) the request is made in writirg.
Carpensatory time may be aocruecJ., up to 60 boors. Any
catpW;atory time remaining on the books after this time will be
paid off in cash at the rate of time am one-half.

Any overtilne worked after the first pay period in December

paid off in cash at the rate of tilne am one-half.
SECI'ION 5: P.E.R.S. mNI'RIIUl'ION
The City agrees to pay the employee's =ntribution rate to
the Public Employees Retirement system not to exceed 7.0% of
a¡:plicable salary.
'!he 2% at 55 trust fun:i established in 1990 will be used by
the city exclusively to assist in the payment for the \D'1fI.mied
liability created by the 2% at 55 PERS =tract amendment.
SECI'ION 6: INSURANCE COVE:RAGE
Health - Medical Insurance - City agrees to pay a maxinum of
$343.50 for medical coverage for employee am deperxents through
the Meyers-<>eddes state Ellployees Medical am Hospital Care Act.
Instances in which the premium for medical am hospital
insurance plan selected by an employee is less than the City's
maxinum premium contribution, the City agrees to contribute a
sum, equal to the difference effective at that tilne, to a
deferred c:œq:¡ensation plan in the employee's name. '!he City
retains the right of selectioo am ac1ministratioo aver the plan
or plans utilize::l to defer '-'Ut~lSation.
If dur~ the teDn of this ag1:e.=ull:!llt, modifications are made
to the Federal Tax COde which would result in any of the medical
insurance provided be subject to taxation, the =ntract will be
re-opened for the p.rrp: s es of adjusti.n;J the salary am medical
benefits so 10ß3" as it does not result in an increase or decrease
in the total c:œq:¡ensatioo.

Dental Insurance - city agrees to pay $56.05 per TIDnth for
enployees an::l their depen:lents.
Life Insurance -
City shall provide life:Îl1surance an::l

the aJD:JUJ1t of two an::l one half times annual salazy to a maximum
benefit of $250,000.
IDn:r Term Di"",hilitv Insurance - city agrees to pay that
premium now in effect for eaàl enployee. Like other
non-iniustrial disabilities, enployees nay use sick leave an::l
vacation leave to SUR?lement lost wages.

Nothing containai herein shall preclude the right of the
Deparbnent Head with the approval of the Awointin:] Authority to
reschedule work assignrrents or hours of work to n-eet ~ency
situations an:i other administrative l'IE!œS''Sities caused by the
observance of a holiday or non-work day or period; provided,
however, that all such affected enployees are duly c:cxrpensated
for said rescheduled work assigrnnents.
Floatin:r Holidavs
In addition to the foregoin:] paid holidays, eligible
enployees shall be allowed to schedule 20 hours to be used as
additional holiday leave not to be taken in increments of less
than 4 hours. '!his floatin:] holiday leave shall be taken at
dates of the enployee's selection, provided: 1) that prior
supervisor approval be obtainai, an:i 2) before the erñ of the
secon:i pay period in DeceniJer of each caleroar year.
For new enployees, floatin:] holiday leave will be pro-rated
in the followin:] manner:
1. Enployees hired after January 1 I::AIt before March 31
shall be entitled to 20 hours floatin;J holiday leave in
that caleroar year.
2. Enployees hired after April 1 I::AIt before septeni:Jer 30
will be entitled 10 hours of floatin:] holiday leave
that caleroar year.
3. Enployees hired after October 1 I::AIt before DeceniJer 31
will not be entitled to floatin:] holiday leave in that
caleroar year.

In order for an enployee to receive hisjher regular pay for a
holiday or designated non-<NOrk day, work must be perfonned on the
reguJ.ar scheduled day before am the reguJ.ar scheduled day after
the holiday or designated non-<NOrk day. Ellployees on vacation,
injury leave, awroved short tem leave of absence, with or
without pay, or who su1::mit satisfactory evidence of personal
illness shall be CXIT'ISidered as worki.n:J their regular schedule for
pay p.¡rposes.
SECI'ION 9: TEMroRARY DIS1\BILI'lY æIUTl~

earn vacation credit on the basis of 5/6 work day or the hourly

days or the hourly equivalent, for each =mplete ¡ronth of
continuing service.
D..1ring the 10th year of employment an employee shall earn
vacation credit at the rate of one an:i five-twelfths (1 5/12)
workdays or the hourly equivalent for each rronth of canpeted
continuous service.
D..1ring the fifteenth year of employment an:i thereafter, an
employee shall earn vacation credits at the rate of one an:i
two-thirds (1 2/3) work days or the hourly equivalent for each
rronth of =mpleted continuous service.
D..1ring the twentieth year of employment an:i thereafter, an
employee shall earn vacation credits at the rate of one an:i five
sixths (1 5/6) work days or the hourly equivalent for each ¡ronth
continuous service.
An employee may accrue no ¡rore vacation credit than twice the
annual rate being earned.
Upon teDnination of employment, unused vacation may not be
used to exten::l final employment date beyon:l the annual rate being
earned.

Represented employees may convert, on a once per calerx1ar
year basis, unused vacation time for payment subject to the
followin;¡' corx:titions:
1. 'Ihe employee must have an earned vacation of a rni.ninI.mt of
15 days.
2. Arrf payments made for unused vacation will be subject to
all a¡:propriate taxes an:i deductions as determined by the
F:inan:::e Deparbnent.
3. MirUm.mt exd1a1'ge will be 1 day, maxiJrum exd1a1'ge will be
5 days. All d1aD:Jes are irrevocable.
SECI'ICN 11: SICK rEAVE
All full time arployees, other than those hold:Ïn3' te!tp:lrcuy
status, shall eazn eight (8) haJrs per month sick leave time
withalt limit on accunulation. '1hose pemanent arployees IòCrkin3'
less than full time (at least 20 haJrs per~) shall eazn in
one mcnth the I1lTIIi:Je.r of haJrs of sick leave they 'oIa.Ù.d noJ:1Jlally
IòCrk in one day or the equivalent withalt limit on aocl1ml11ation.
En'ployees absent withalt pay for any reason for roore than forty
(40) haJrs durin;¡' a calerx1ar month shall not eazn sick leave
benefits for that month.

children. En'ployees shall, whenever possible, make ~il1'bnelJts

this is not possible, sick leave may be used for these p.nposes.

shall be taken in periods of no less than one-half hour
increments .
'lhe City shall pay an employee for unused balance of sick
leave upon retirement, or termination for other than just cause,
a=rcling to the follow:in3' schedule:
1. If upon retirement, an employee has aocrued 320 hours of
sick leave, which shall require the fonnal fil:in3' of the
appropriate forms with the Public Employee's Retirement
system, a cash payment will be made equivalent to
seventy-five percent (75%) of the dollar value of the
unused sick leave. SUch payment to be calculated at a
wage rate which is the average of the p~iT¥} five (5)
years for the employee.
2. If upon termination for other than discharge with a just
cause, an employee has 320 hours of aocrued sick leave, a
cash payment will be made equivalent to fifty percent
(50%) of the dollar value of the unused sick leave
balance. '!he dollar value for such payment shall be
calculated at a wage rate which is the average of the
pr........(jiT¥} five (5) years for the employee.
Represented employees will have the option, subject to
approval, of converting sick leave to vacation leave on a
two-to-one basis. '!he maxil!Imt allowable ~e will be 96
hours of sick time for 48 hours of vacation leave per calerrlar
ear. Minimum ~e will be 8 hours sick leave for 4 hours of
vacation. An employee may convert sick leave in excess of 320
hours to vacation leave on a one-to-one basis with a max:i.mum of
48 hours arxi a m:in:inu.nn of 4 hours.

As a corxlition of corwertin;r sick leave to vacation, all
employees will be required to use at least one-half of the
vacation a=ed durin;r the previous twelve m:mths.
SUCh corwersion, either to exc:han;¡e sick leave for vacation
or vice versa shall be subject to the followin;r oon:litions:
1. All requests to exc:han;¡e sick leave for vacation time
shall be su1:mitted in writin;r to the Department Head at
least sixty (60) calen:Jar days in advance of intended
vacation utilization.
2. The grantin;r of such exc:han;¡e and su1:Jsequent use will be
at the discretia1 of the Department Head.
3. If twelve (12) DDnths have elapsed since ~ of the
exchan;Je of sick leave for vacation, and the employee has
not been peDllitted the use of the converted vacation
time, (after su1:mittin;r at least one written request for
utilization) the elIployee will have the right to
re-convert the vacation time to sick leave in reverse
ratio to the original exc:han;¡e. '!his exchan;Je will be
allO!o'ed onlv for previously converted sick time to
vacation and will not be peDllitted for regularly accrued
vacatia1 time.

4. If an employee, after convertin;¡ sick leave to vacation
tÌlne, exhausts all of hisjher remainin;J sick leave due to
injury or illness, he/she may make a written request to
the Deparbnent Head to re-=nvert vacation tÌlne to sick
leave on a reverse ratio basis. Approval will be subject
to an assessment by the Department Head as to the
validity of the illness/injury am whether or not a
written Iñysician's statement attestin;¡ to the
illness/injury is required will be at the sole c:pt:ion of
the Department Head.
5. If the employee's vacation aocrual ey'""""""'" the maxi.rmnn
allowable aocrual, he/she will have the c:pt:ion to
re-=nvert vacation tÌlne back to sick leave on a reverse
ratio basis. SUch re-conversion shall be limited to
previously converted sick leave/vacation am may not
exceed the ëUID.IJ'lt ~~ary to reduce the aa::rued
vacation to the maxim.mt allowable. Regularly aa::rued
vacation tÌlne will not be eligible for this re-aorNersion
to sick leave am any regularly aa::rued vacation tÌlne
aa::rued in I3XOeeS of the maxi.rmnn allowable will be
disallowed am not subject to utilization by the
employee.
NCIl'E: lis used in this dcc:lmIent, "reverse ratio" is interñed to
mean that the ratio of sick leave to vacation will revert
to the original ratio at the tÌlne the initial exchan:1e
was implemented.

SECrION 12: FAMILY lEAVE
'!he city of CUpertino will be in compliance with state arñ
Federal Family Leave laws.
SECrION 13: PERSONAL lEAVE
'!he City shall allow sick leave to be used for =rx:iucting
personal business which cannot be conducted outside regular
INOrlå.n;J hours.
'!he enployee m.JSt request personal leave, if non-emergerx:y,
at least forty-eight (48) hours (bic INOrlå.n;J days) prior to the
time desired. SUch leave can be granted. In cases of emergency,
the forty-eight (48) boor notification pz:oced1u-e may be waived by
the :iJmnediate supeJ:Visor provided the fOIm is campleted arñ the
reason for the request is state:! upon return.
SECI'ICN 14: BERFAVEMml' lEAVE
En'ployees shall be granted paid bereavement leave not to
exceed three (3) 1NOrk days upon the occasion of death of a close
relative. Close relatives are defined as m:rt:he.r, father, sister,
brother, wife, husband, child, grandparent, gran:kh:ildren,
rrother-in-law arñ father-in-law.
SECrICN 15: MII.I'D.RY lEAVE
Military leave shall be granted in aocordaIv::e with the
provision of state law.
All enployees entitled to military leave shall give their
supeJ:Visor an '-M-"'..tunity, within the limits of military
requirements, to determine when such leave shall be taken.

SECI'ION 16: PRÐ3NANCY DISABILITY lEAVE
A pregnant employee is entitled up to four (4) IOOI1ths leave
of absence without pay for temporary disability resulting from
pregnancy, miscarriage, childbirth or reo:Nery therefrom.
Enployees shall take unpaid leave of absence during such leave
except that accrued vacation pay am sick leave may be taken at
the c.ption of the employee.
As with all other temporary disabilities, a PtYsician's
certificate is required to verify the extent am duration of the
temporary disability.
An employee who plans to take a pregnancy leave must give a
reasonable notice (not less than four (4) 'tIeeks) before the date
she expects to take the leave am the estimated duration of the
leave. '!he City will pay health am welfare benefits at the same
rate as prior to the leave until the employee is released by her
physician to return to work or for sixty (60) days, whichever
canes first.
SECl'ION 17: AOOPl'ION lEAVE
Upon request, a leave of absence without pay for up to four
(4) 'tIeeks will be granted to adoptive parents. Accrued vacation
pay am sick leave may be taken at the c.ption of the employee
during this leave time. '!he City will pay health am welfare
benefits at the same rate as prior to the leave.

SECrION 18: C'ATASTROEHIC rEAVE
1. '!he City will fom a ccmnittee to establish a definition of
catastrq:hic or life-threatenin;} illness. 'Ihis ccmnittee will
evaluate each iIxlividual case when it is su1::mitted to qualify
to receive fun::1s. '!he only limitation is that the employee
TII.ISt be the one fac~ the illness. '!he ccmnittee has the
right to ask the awlicant to su1::mit further dccl1ntøTTtation
fran their ¡::hysician to detemine the awlicant does suffer a
catast.ro¡::hi.c or life-threatenin;} illness.
2. All benefitted E!IIployees who have ra.;o"'ßd initial probation
with the city will be eligible to receive assistance. An
E!IIployee does not have to be a contribItor to be eligible.
An enployee or their repl.:5 lltative 11I.1St OCIIplete a
prescribed awlicatic:n fom together with ~ medical
documentation to the Personnel Office when awly~ for
fun::1s .
3. A recipient TII.ISt have used all of their available leave hours
before he/she is eligible.

available at this time) .

5. Vacation leave will be the only leave that may be donated.
An eq¡loyee may not donate vacation leave hours which would
reduce hisjher total a=ed leave balances to less than 120
hours. All leave donations are irrevocable.
6. A vacation transfer drive will be held once a year for

recipient with the regular payroll, which will keep them in
an active errployment TtDde with the City. nus procMnre
prevents overpayments or =rrections since it canes after the
actual leave has been taken. (Conversion allows for
adjusbnents for different rates of pay.) No enployee shall
receive payment for TlDre than 100% of their regular pay.

SECl'ION 19: ABSENCE NaI'IFICATION
An E!II'ployee is expected not to absent hin1selfjherself fran
work for arr:¡ reason other than personal illness without rnakin;J
prior arrangements with hisjher supervisor. Unless prior
arrangements are made, an E!IIployee who, for arr:¡ reason, fails to
report for work 1IIJSt make a sincere effort to i:nunediately notify
hisjher supervisor of hisjher reason for beirg absent. If the
absence, whether for personal illness or at:hmwise, is to
continue beyorñ the first day, the E!IIployee 1IIJSt notify the
supervisor on a daily basis 1.U1less at:hmwise arranged with
hisjher supervisor. In prq¡er cases, exceptions will be made.
Arrj l.U1authorized absence of an E!IIployee fran duty shall be
deemed to be an absence withcut pay and will be groon:1s for
disciplinazy actiœ by the Department Head. In the absence of

TRAINING AND 'lUITI0N REIMIURSEMENl'
It is the intent of the City to recognize the value of
trainin;¡' to its employees; am to adopt a trainin;¡' policy which
will encourage employees to avail themselves of jab related
educational opportunities that will advance their knowledge am
interests in the direction of their career with the City; am by
doin;¡- so to improve the Mlmicipal Service. Ðrployees who wish to
seek reimbursement fran the City for ~ PJ:<..yLCUU costs shall
provide a written request for reimbursement to their DepartJœnt
Head. '!he fODII provide::l shall include the type .of program,
sponsorin;¡- organization or institution, meetin;¡- times am costs
for such program.
Once a trainin;¡' program has been ~roved by the Department
Head any employee covered by this Agreement. ~d be eligible for
reimbursement unless furDs budgeted for this activity have been
exhausted. HoftJever, no employee shall receive any reimbursement
until they have provide::l satisfacto:ry proof of successful
CCII'pletion of the program.
SECI'ION 21: CI'lY SFamRED REæFATION PRXõRAMS
City employees shall have the privilege of enrollment in City
sponsored :recreation programs at city residents' fee structure
am in preference to non-residents w:ishirg to enroll.

SECrION 22: roE POOCESS
In each ani every instance invol vin;¡ the issuance of warning
notices, suspensions or the dismissal or discharge of an
employee, such will not be effectuated without the euployee first
havin;¡ been given, in writin;¡ the basis for such action bein;¡
taken ani the opporttmity to question the reasons therefore of
hisjher supervisor or Department Head. Said opporttmity shall be
as soon as is practical after havin;¡ been served the written
notice ani shall not constitute any limitation othezwise
available through the grievan::e or "IT"""'1 pro..""ed1rres. Þirrf
written warning in an employee's file will be rE!IIICIITed iran the
file after three years.
SECl'ION 23: IAYOFFS
layoffs of euployees may be made by the ~intin;r Authority
for lack of fums, lack of writ or for other similar ani just
cause. '!he order of layoff shall be that which, in the opinion
of the ~intin;¡ Authority, will cause the least clisn1ption of
setVice to the City.
Unless otherwise prevented fran doin;¡ so as a result of
corr:litions or situations beyaxi the City's control, the City will
provide a rnininJJm of thirty (30) days notice to any employee
subject to bei.n;J laid off ~ to the Rule on layoffs.

SECI'ION 24 REINSTATEMENT
'Ihe names of enployees affected by layoff shall be placed on
a recall list for a period of two years in the reverse order of
layoff arxi shall have the first opportunity for reinstate!œnt.
Failure to respon:l within ten days to a written notice of such
opportunity shall cause that name to be re=ved fran the recall
list.

to be illegal by a c:::oort of cc:mpatent jurisdiction or void as
bein;J in contravention of arr¡ law, role or regulation of arr¡
government agen::y havin;J jurisdiction aver the subject set forth,
then the remain:ler of the ag:t:eetoont shall continue in full force
arxi effect W'lless the parts so foun:i to be void are held
inseparable fran the remaining portion of the a':L==ment.
