'!his i!': leement represents the full ani integrated agreement reached between the parties. SECl'ICN 1: NO DTSCRIMINATICN City ani 1Issociation agree they shall not discriminate in arr¡ way on aOOClIDt of race, creed, religion, sex, age, national origin, political affiliation, sexual preference, or for 1Issociation activity. SECI'ION 4: HOORS OF WJRK: 0VERl'IME Hours of Work Defined Hours INOrJœd shall include all time not under the control of the enployee whether such hours are INOrJœd in the City's INOrk place, or in sane other place where the euployee is can:yin;J oot the duties of the City. Rest Periods Each euployee shall be granted a rest period of fifteen minutes durin;J each INOrk period of nore than three hours duration. No wage deduction shall be made nor time off charged against enployees ~ authorized rest periods, nor shall any rights or overtime be accrued for rest periods not taken. 2 Overtime Overtime shall be defined as any 1tIOrk in excess of regular 1tIOrk hours defined above. Holidays am paid time off shall count toward the acx::uIm1lation of the 1tIOrk week. Overtime 1tIOrk for the City by an enployee shall be authorized in advance by the Department Head or their designee. In the event of unforeseen circumstances, overtime shall be ~ after the work is CXIIpleted. '!he 2% at 55 trust fun:i established in 1990 will be used by the city exclusively to assist in the payment for the \D'1fI.mied liability created by the 2% at 55 PERS =tract amendment. SECI'ION 6: INSURANCE COVE:RAGE Health - Medical Insurance - City agrees to pay a maxinum of $343.50 for medical coverage for employee am deperx ents through the Meyers-<>eddes state Ellployees Medical am Hospital Care Act. Instances in which the premium for medical am hospital insurance plan selected by an employee is less than the City's maxinum premium contribution, the City agrees to contribute a sum, equal to the difference effective at that tilne, to a deferred c:œq:¡ensation plan in the employee's name. '!he City retains the right of selectioo am ac1ministratioo aver the plan or plans utilize::l to defer '-'Ut~lSation. An employee may accrue no ¡rore vacation credit than twice the annual rate being earned. Upon teDnination of employment, unused vacation may not be used to exten::l final employment date beyon:l the annual rate being earned. 8 Represented employees may convert, on a once per calerx1ar year basis, unused vacation time for payment subject to the followin;¡' corx:titions: 1. 'Ihe employee must have an earned vacation of a rni.ninI.mt of 15 days. 2. If this is not possible, sick leave may be used for these p.nposes. 9 with proper notice arxi approval of the supervisor, sick leave shall be taken in periods of no less than one-half hour increments . 'lhe City shall pay an employee for unused balance of sick leave upon retirement, or termination for other than just cause, a=rcling to the follow:in3' schedule: 1. If upon retirement, an employee has aocrued 320 hours of sick leave, which shall require the fonnal fil:in3' of the appropriate forms with the Public Employee's Retirement system, a cash payment will be made equivalent to seventy-five percent (75%) of the dollar value of the unused sick leave. SUch payment to be calculated at a wage rate which is the average of the p~iT¥} five (5) years for the employee. 2. If upon termination for other than discharge with a just cause, an employee has 320 hours of aocrued sick leave, a cash payment will be made equivalent to fifty percent (50%) of the dollar value of the unused sick leave balance. '!he dollar value for such payment shall be calculated at a wage rate which is the average of the pr........(jiT¥} five (5) years for the employee. Represented employees will have the option, subject to approval, of converting sick leave to vacation leave on a two-to-one basis. '!he maxil!Imt allowable ~e will be 96 hours of sick time for 48 hours of vacation leave per calerrlar ear. Minimum ~e will be 8 hours sick leave for 4 hours of vacation. An employee may convert sick leave in excess of 320 hours to vacation leave on a one-to-one basis with a max:i.mum of 48 hours arxi a m:in:inu.nn of 4 hours. 10 As a corxlition of corwertin;r sick leave to vacation, all employees will be required to use at least one-half of the vacation a=ed durin;r the previous twelve m:mths. SUCh corwersion, either to exc:han;¡e sick leave for vacation or vice versa shall be subject to the followin;r oon:litions: 1. All requests to exc:han;¡e sick leave for vacation time shall be su1:mitted in writin;r to the Department Head at least sixty (60) calen:Jar days in advance of intended vacation utilization. 2. The grantin;r of such exc:han;¡e and su1:Jsequent use will be at the discretia1 of the Department Head. 3. If twelve (12) DDnths have elapsed since ~ of the exchan;Je of sick leave for vacation, and the employee has not been peDllitted the use of the converted vacation time, (after su1:mittin;r at least one written request for utilization) the elIployee will have the right to re-convert the vacation time to sick leave in reverse ratio to the original exc:han;¡e. '!his exchan;Je will be allO!o'ed onlv for previously converted sick time to vacation and will not be peDllitted for regularly accrued vacatia1 time. 11 4. If an employee, after convertin;¡ sick leave to vacation tÌlne, exhausts all of hisjher remainin;J sick leave due to injury or illness, he/she may make a written request to the Deparbnent Head to re-=nvert vacation tÌlne to sick leave on a reverse ratio basis. Approval will be subject to an assessment by the Department Head as to the validity of the illness/injury am whether or not a written Iñysician's statement attestin;¡ to the illness/injury is required will be at the sole c:pt:ion of the Department Head. 5. SECrION 13: PERSONAL lEAVE '!he City shall allow sick leave to be used for =rx:iucting personal business which cannot be conducted outside regular INOrlå.n;J hours. '!he enployee m.JSt request personal leave, if non-emergerx:y, at least forty-eight (48) hours (bic INOrlå.n;J days) prior to the time desired. SUch leave can be granted. In cases of emergency, the forty-eight (48) boor notification pz:oced1u-e may be waived by the :iJmnediate supeJ:Visor provided the fOIm is campleted arñ the reason for the request is state:! upon return. SECI'ICN 14: BERFAVEMml' lEAVE En'ployees shall be granted paid bereavement leave not to exceed three (3) 1NOrk days upon the occasion of death of a close relative. Close relatives are defined as m:rt:he.r, father, sister, brother, wife, husband, child, grandparent, gran:kh:ildren, rrother-in-law arñ father-in-law. SECrICN 15: MII.I'D.RY lEAVE Military leave shall be granted in aocordaIv::e with the provision of state law. All enployees entitled to military leave shall give their supeJ:Visor an '-M-"'..tunity, within the limits of military requirements, to determine when such leave shall be taken. 13 SECI'ION 16: PRÐ3NANCY DISABILITY lEAVE A pregnant employee is entitled up to four (4) IOOI1ths leave of absence without pay for temporary disability resulting from pregnancy, miscarriage, childbirth or reo:Nery therefrom. Enployees shall take unpaid leave of absence during such leave except that accrued vacation pay am sick leave may be taken at the c.ption of the employee. As with all other temporary disabilities, a PtYsician's certificate is required to verify the extent am duration of the temporary disability. An employee who plans to take a pregnancy leave must give a reasonable notice (not less than four (4) 'tIeeks) before the date she expects to take the leave am the estimated duration of the leave. '!he City will pay health am welfare benefits at the same rate as prior to the leave until the employee is released by her physician to return to work or for sixty (60) days, whichever canes first. SECl'ION 17: AOOPl'ION lEAVE Upon request, a leave of absence without pay for up to four (4) 'tIeeks will be granted to adoptive parents. Accrued vacation pay am sick leave may be taken at the c.ption of the employee during this leave time. '!he City will pay health am welfare benefits at the same rate as prior to the leave. 14 SECrION 18: C'ATASTROEHIC rEAVE 1. '!he City will fom a ccmnittee to establish a definition of catastrq:hic or life-threatenin;} illness. 'Ihis ccmnittee will evaluate each iIxlividual case when it is su1::mitted to qualify to receive fun::1s. '!he only limitation is that the employee TII.ISt be the one fac~ the illness. '!he ccmnittee has the right to ask the awlicant to su1::mit further dccl1ntøTTtation fran their ¡::hysician to detemine the awlicant does suffer a catast.ro¡::hi.c or life-threatenin;} illness. 2. All benefitted E!IIployees who have ra.;o"'ßd initial probation with the city will be eligible to receive assistance. An E!IIployee does not have to be a contribItor to be eligible. An enployee or their repl.:5 lltative 11I.1St OCIIplete a prescribed awlicatic:n fom together with ~ medical documentation to the Personnel Office when awly~ for fun::1s . 3. An eq¡loyee may not donate vacation leave hours which would reduce hisjher total a=ed leave balances to less than 120 hours. All leave donations are irrevocable. 6. A vacation transfer drive will be held once a year for eq¡loyees to donate vacation leave. Transfers may be in increments of 1 ha.1r or TlDre. All donations will be confidential. '!here will be no sellin; or COE!ZCion of eq¡loyees to donate. If the bank is depleted a vacation transfer drive may be held at the request of the Camnittee. 7. Donated vacation leave hours will be =nverted to cash and deposited in a time-bank where it will be available for distribution. Interest aocruin;J fran the bank shall be credited to the time-bank. Unless prior arrangements are made, an E!IIployee who, for arr:¡ reason, fails to report for work 1IIJSt make a sincere effort to i:nunediately notify hisjher supervisor of hisjher reason for beirg absent. Ðrployees who wish to seek reimbursement fran the City for ~ PJ:<..yLCUU costs shall provide a written request for reimbursement to their DepartJœnt Head. '!he fODII provide::l shall include the type .of program, sponsorin;¡- organization or institution, meetin;¡- times am costs for such program. Once a trainin;¡' program has been ~roved by the Department Head any employee covered by this Agreement. ~d be eligible for reimbursement unless furDs budgeted for this activity have been exhausted. SECl'ION 23: IAYOFFS layoffs of euployees may be made by the ~intin;r Authority for lack of fums, lack of writ or for other similar ani just cause. '!he order of layoff shall be that which, in the opinion of the ~intin;¡ Authority, will cause the least clisn1ption of setVice to the City.
