CAMPUS HOLDINGS INC., a Delaware corporation ("CHr') and a fully owned subsidiary of
Apple Inc., grants to the CITY OF CUPERTINO ("CITY") a non-exclusive easement for public
service purposes and all improvements which shall be or become necessary for the operation of
public services, including but not limited to poles, wires, conduits, cabinets, other public utilities,
and all appurtenances above, under, upon, or over the hereinafter described property which is
situated in the City of Cupertino, County of Santa Clara, State of California, and is described as
follows ("Easement Area"):
(see Exhibits "A" & "B")
The Easement Area shall be kept open and free from buildings and stnuctures of any kind except
public service structures, irrigations systems and appurtenances thereto, lawful fences and all
lawful unsupported roof overhangs.
This easement shall be a burden on the Property, which burden shall run with the land and shall be
binding upon and shall inure to the benefit of the successors and assigns of the parties hereto.
