(:.i August 5, also at the Monta Vista Community Center, staff met with residents and/or property owners of the islands designated ";'ionta Vista (West) 80-34" and "Pasadena K-35". Once again major concerns were code enforcement, fiscal implications and wheth=_r or not annexation would bring about the need for street im- provements. Staff met wit'- residents and/or property owners of the remaining islands on August 13 at the Library Community Room. Questions asked were still concerning fiscal implicate-)ns, street improvements and code enforcement. Major concern regarding code enforcement in each instance seemed to be noise. STAFF RECOMMENDATION No recommendation. Should Council wish to ir_iti_ate annexation proceedings, it will be necessary to approve each Site Specific Plan and adopt each resolution. AL.t The above-referenced area consists of approximately 45.4 acres located along Adriana Avenue, Mann Drive and encompassing those unincorporated parcels fronting Dos Palos Court, Meadowview Lane, Corte Madera Lane, Woodbury Drive, Monte Court, Gardenview Lane and Oakview Lane. The subject area consists of 133 parcels and is at or near complete build out. The subject properties are presently used for single-family purposes and the prezoning action would basically re-establish the minimum lot size regulation and does not represent a significant alteration from the County zoning classification. Application 39-Z-80 should be looked upon as a companion prezoning application with Application 40-Z-80 which was initiated by the City to prezone and rezone the Stevens Creek Boulevard frontage in Old Monta Vista. -1- Application 39-Z-80 - City of Cupertino (Mann Drive/Adriana Avenue) July 25, 1980 -------------------------------------------------------------------------------------- Lot Size All of the lots involved in the subject applications are proposed to be prezoned R1-10. While some of the lots may not equal the minimum lot size of the district, they woul.- ill remain buildable , The R1 Zoning Ordinance contains a clause which recognizes -hat- a lot legally created in the County prior tr annexation to the City mF.y be used as a building site even when it is of less area than required by the zoning district. Setbacks,'_?on-Conforming Structures Structures or portions of structures which do not meet the setback restrictions would be considered non-conforming with Cupertino ordinances upon annexation, and, if legal, could remain until a substantial modifiction or rebuilding of the structure was requested. If any structure is illegal (i.e. constructed without permits) it will remain illegal in the City of Cupertino. The setback provisions between the City and County are not significantly different, hence it can be assumed that most structure legally constructed in the County would remain legal in the City. The County and City setbacks are summarized as follows: County R1-10 City R1 Front 25' 20' s Side 1.0' ( 5' one-story) (10" two-story) Rear 25' or 20% lot depth, (20' one-story) whichever is lesser (10') if rear yard equals 20 X lot width. (25' two-story) Keeping Animals Cupertino's R1 Ordinance resembles County laws with respect to the keeping of conventional household pets such as dogs and cats. Cupertino permits no more than two adult dogs and two adult cats per home. Cupertino laws do permit the keeping of less conventional household pets such as chickens, ducks, rabbits, etc. provided that the total number of household pets does not exeed four. The keeping of larger animals such as horses, goats, etc. are somewhat more re- strictive Cupertino's ordinances, wherein a use permit is required and the lot must equal one acre. Recommendation The Environmental Review Committee recommends the granting of a Negative Declaration. The staff recommends approval of Application 39--Z-80 per the attached resolution. Enclosures : Recommended Resolution Environmental Review Committee Materials Exhibit A of Application 39-Z--80 City of Cupertino RECO?DIENDATION OF ENVIROTi MENTAL REVIEV COiTMITTEE July 8, 1.980 As provided by the Environmental Assessment Procedure, adopted by the City Council of the City of Cupertino on March 27, 1973, as amended, the following described project was reviewed by the Environmental Review Committee of the City of Cupertino on July 8, 1980 at which time the Committee determined that the project does not have a significant impact on the environment and therefore is recommending to the decisionmaking body that a Negative Declaration be filed. Project Description and Location Application: 57-EA-80 Applicant: City of Cupertino (Mann Drive/Adriana Avenue) Location: The subject property consists of those C unincorporated parcels fronting Adriana Avenue from a point approximately 200 ft. northerly of Stevens Creek Blvd. to the northerly terminus of Adriana Avenue and those unincorporated properties fronting Mann Drive from a point approximately 175 ft. northerly of Stevens Creek Blvd. to a point approximately 130 ft. northerly of Dos Palos Court and including all unincorporated parcels fronting Dos Palos Court, Meadowview Lane, Coutc Madera Lane, Woodbury Drive, Monte Court, Gardenview Lane and Oakview Lane. Discretionary Action Request: Prezoning approximately 45.4 acres presently zoned Santa Clara County R1-10 (One-family residence, 10,000 sq. ft. minimum lot size) and .25 acre. presently zoned Santa Clara County OA (Administrative and Professional Office ) to City of Cupertino R1-10 (Residential, Single-family, 10,O00 -,q. ft. minimum lot size) zone and annexation of said property into the City of Cupertino. Findings of Environmental Review Committe, The Committee recommends the granting of a Negative Declaration si ce the project is consistent with the General Plan and has no significant environmental impacts. ff mes H. Sisk Planning Director MANN 80-32 This Site Specific Plan has been prepared in response to LAFCO planning require- ments for evaluating annexation proposals under the Municipal Organization Act of 1977. This plan is based upon the Master Plan for services which was approved by the Cupertino City Council on March 19, 1979. The City of Cupertino has planned its ser-ices as to provide for the entire area and population within the perimeter city limits. Therefore, there is ample cap- acity to extend services to each of the island areas. Islands are currently receiving benefits in the form of access to services provided by the City. Advantages gained by residents who annex to the City include: increased traffic enforcement; increased level of code enforcement, traffic complaints and request for traffic control devices; City maintenance of streets; increased accces to City recreation programs; shorter distance between residents and government service center; increased government representation (vote as both City and County resident, opportunity to serve on City commissions or boards, opportunity to run for Council) ; improved efficiency in delivery of servic,�s;• this is an opportunity to annex without paying processing fees. I. Fire Protection and Prevention Services There will be no change in agency upon annexation. This area is presently part of the Central Fire Protection District, as is Cupertino. Annexation would not affect fire prevention and protection service ar funding. II. Police Protection The area designated Mann 80-32, upon annexaticn, would receive traffic enforcement from the Santa Clara County Sheriff': Department. One car, 60 hours, two cars each 40 hours; three Sheriff's vehicles patrol Cupertino 140 hours per week for traffic enforcement. The Santa Clara County Sheriff's Department currently provides other protection services to the island area. This would not change. Currently, the California Highway Patrol responds to accidents and special needs on unincorporated roads and highways. Routine patrol. on these roadways was found to be poor ec6nomically. Patrol and enforcement is provided in areas where such needs are clearly identified and called to their attention. Cupertino's Code Enforcement Officer also responds to complaints of citizens within the City. Annexed area would have traffic and code enforcement extended to them without lowering level of service to current City residents. The Sheriff's services are funded through the General Fund. III. Library Service There will be no change in Library Service. No library expansion or reorganization will be required upon annexation of an island. IV. Parks and Recreation - Varian Park is nearest to this area. This 6.0 acre park features open space and tennis courts. Annexation has no effect on park development. Barbeque tables, -2- barbeques and playground equipment are to be installed in this park. Also nearby is the Monta Vista Park and Community Center on Voss Avenue. The City has budgeted $150,000 for redevelopmemt of the park during the 1980-81 fiscal year. Plans include a parking area and neighborhood play equipment. The existing turf and approximately 15,000+ jq. ft. of the community center will be retained. Super- vised recreation programs for all ages will be conducted in the center. Recreation and park facilities are available regardless of residency. However, non-residents pay an additional $2.00 fee for programs held at City owned faciltie .. Cu;ertino's Community Park, Memorial Park, is just a short distance away on Stevens Creek Blvd. and Mary Avenue. The senior center is located in this park. V. Streets - Substantially Developed or Developing Territory Except in cases of .further development or redevelopment, no upgrading of facilities will be required. The City will maintian all public streets as required. Service level and funding will bp in accordance with the Master Plan for Services. Vi: Street Sweeping -The City of Cupertino provides regular street sweeping on all curbed and guttered streets within the City. This island does have rolled curbs and sweeping will be done every two weeks. The City required no improvements to be made because of anr--xation. Municipal street sweeping is financed from the General Fund and Gas Tax. VII. hater Supply This area is currently served by the City of Cupertino hater Utility. No change of agengy or rates will occur with annexation. Refer to Master Plan for Services for City policy regarding hookup, the available capacity, and costs of financing. VIII. Gas and Electricity Annexation will not affect Pacific Gas and Electric Company rate structure. IX. Garbage Collection Los Altos Garbage Company provides refuse collection to unincorporated areas in Santa Clara County at a rate of $4.50/2 cans. The same service is available to Cupertino residents for a rate .of $3.50/2 caca for front yard pickup. Cupertino residents also receive a free Spring and Fall pickup. The Senior Citizen rate in Cupertino is $2.00 for 1. can. X. Sanitary Sewer This island is located within the Cupertino Sanitary District. There are sewers available in part of the island , but not thrc.t•ghout. Existing septic tanks are under the control of. the Sar,'ca Clara County Health Department. 4:hile Health Department safety criteria are met, connections to sanitary sewers are not required. -3- XI. Storm Drains Storm drains are located along Mann Drive to Stevens Creek Boulevard. Annexation will not mean additional storm drains will be required. If property owners request storm drains or if storm drains, at some future point, are deemed necessary to ensure safety, they will be financed by property owners and/or the Master Storm Drain fund. XII. Flood Control The City of Cupertino participates in the National Flood Insurance Program. This territory is not located within a flood plain. XIII. Street Lighting Mann 80-32 does have some street lights. The City's replacement policy is to convert all incandescent lamps to the more energy efficient type. Costs of energy and maintenance are financed by the general fund and/or gas tax. Annexed areas will be eligible for City maintenance. XI6'. Other Services Cable TV is not available in Cupertino at this time. However, the City is currently negotiating with United Cable TV regarding a franchise. Annexation will not require any change in address or po6tal service. Although funds were not directly expended on Mann Drive, the Monta Vista area has been one of primary emphasis for housing rehabilitation with Housing and Community funds administered by the City of Cupertino. Recently Cupertino has expended funds for the Mann Pump Station. There is now emergency power for the pump station which results in better water service and increased fire protection. There is also increased pumping capacity. XV. Special Assessment Districts Special Districts within the area of proposed annexation include: Cupertino Union School District Fremont Union High School. District Foothill Community College District Mid Peninsula Regional Open Space District Santa Clara Valley 1Hater District Central Fire Protection District Cupettino Sanitary District XVI. Fiscal Implications Under Proposition 13 the basic tax rate for all areas is : 4.00 per hundred dollars assessed valuation. The Citv has an additonal .023 per $.100 assessed valuation for 1980-•81 for Park and City Hall Bonds.
