WHEREAS, the Board of Supervisors of the County of Santa
Clara has held a duly noticed public hearing pursuant to the
Municipal Organization Act of 1977 on the proposed annexation
of territory designated as MONTE VISTA WEST 80-34
to the City/Zewff of CUPERTINO
and
WHEREAS, the Board of Supervisors is authorized by the
Santa Clara County Local Agency Formation Commission to order
annexation of this territory without an election pursuant to
Government Code Section 35150(f) of the Municipal Organization
Act of 1977 ;
NOW, THEREFORE, the Board of Supervisors of the County of
Santa Clara does hereby resolve, determine and order as follows:
1. The territory described in Exhibit A is annexed to the
City of CUPERTINO y A map of this territory
marked Exhibit B, is attached.
2. The annexation is effective on

Consideration of Possible Annexation of Various Islands
BACKGROUND
On July 31, staff met at tha Monta Vista Community Center with residents and/or
property owners of the island designated "Mann 80-32". Questions were answered
concerning code enforcement, a rat problem in the area and fiscal implications of
possible annexation. On August 5, also at the Monta Vista Community Center, staff
met with residents and/or property owners of the islands designated "Monta Vista (West)
80-34" and "Pasadena 80-35". Once again major concerns were code enforcement, fiscal
implications and whether or not annexation would bring about the need for street im-
provements. Staff met with residents and/or property owners of the remaining islands
on August 13 at the Library Community Room. Questions asked were still concerning
fiscal implications, street improvements and code enforcement. Major concern regarding
code enforcement in each instance seemed to be noise.
STAFF RECOMMENDATION
No recommendation. Should Council wish to initiate annexation proceedings, it will
be necessary to approve each Site Specific Plan and adopt each resolution.

I had arranged my personal plans so as to be able to attend the schec:uled
August 18th council proceedings concerning specifically annexation #80-34,
which includes my home and property. Since the proceedings have been
rescheduled, I will not be able to attend, hence this letter of protest.
I attended the informational meeting at the Cupertino Voss Road facility
cond•v�ted by planners and staff on August 5th and believe myself to be
cognizant of the implications of annexation.
My first draft of this .letter was very long and very strong. However,
upon reflection, I decided that you have probably heard all of my objections
many times before, although I may have iden:ified some new ones.
My position is summarized as follows:
o I do not cunt to be annexed.
o I do not understand why Cupertino wants to annex me.
o Regardless of existing state law, I believe that the procedure is
unconstitutional without a vote of the people affected.
(Note Sunnyvale lawsuit.)
If this annexation process is not found to be unconstitutional, it is at
the least "high-handed, dictatorial, and undemocratic. Why would you, as
individual citizens with individual consciences, associate yourselves with
such an action?
It is requested that this letter be made a part of the minutes of the
annexation proceeding whenever it is held.

MONTA VISTA 80-34
This Site Specific Plan has been prepared in response to LAFCO planning
requirements for evaluating annexation proposals under the Municipal Organization
Act of 1977. This plan is based upon. the Master Plan for services which was
approved by the Cupertino City Council on Parch 19, 1979.
The City of Cupertino has planned its services so as to provide for the entire
area and population within the perimeter city limits. Therefore, there is ample
capacity to extend services to each of the island areas. Islands are currently
receiving benefits in the form of access to services provided by the City.
Advantages gained by residents; who annex to the City include: increased traffic
enforcement; increased level of code enforcement, traffic complaints and
request for traffic control devices; City maintenance of streets; increased
access to City recreation programs; shorter distance between residents and
government service center; increased government representation (vote as both
City and County resident, rpportunity to serve on City commissions or boards,
opportunity to run for Council); improved efficiency in delivery or services;
this is an opportunity to annex without paying processing fees.
I. Fire Protection and Prevention Services
There will be no change in agency upon annexation. This area is presently
part of• the Central Fire Protection District, as is Cupertino. Annexation
would not affect fire prevention and protection service or funding.
11. Police Protection
The area iesionated Monta Vista upon annexation, would receive traffic
enforcement from the Santa Clara County Sheriff's Department. One car,
60 hours, two cars each 40 hours; three sheriff's vehicles patrol Cupertino
140 hours per week for traffic enforcement. The Santa Clara County Sheriff's
Department currently provides other protection services to the island area.
This would not change.
Currently, the California Highway Patrol responds to accidents and special
needs on unincorporated roads and highways. Routine patrol on these roadways
was found to be poor economically. Patrol and enforcement is provided in areas
where such needs are clearly identified and called to their attention.
Cupertino's Code Enforcement Officer also responds to complaints of citizens
within the City. Annexed area would have traffic and code enforcemeac extended
to them without lowering level. of service to current City residents. The
Sheriff's services are funded through the General Fund.
III. Library Service
There will be no change in library service. No library expansion or reorgani-
zation will be required upon annexaLion of an island.

IV. Parks and Recreation
The nearest park facility is McClellan Ranch Park, a rural nature reserve.
Naturalist classes are conducted on this 23.5 acre site, and community gardens
are available .for residents only.
The Monta Vista Park and Commun- y Center on Voss Avenue is also nearby. The
City has budgeted $150,000 for redevelopment of the park during the 1980-81
fiscal year. Plans include a parking area and neighborhood play equipment.
Approximately 15,000+ sq. ft. of the community center will be retained. Super-
vised recreation programs for all ages will be conducted in the centers planned
to start in September. .
Also closeby is Stonydale Drive - Varian Park. This park is 6.0 acres and
features open space and tennis courts. Annexation has no effect on park devel-
opment. Barbeque tables, barbeques and playground equipment are presently being
installed in this park.
Recreation and park facilities are available regardless of residency. However,
non-residents pay an additional $2.00 fee for programs held at City owned facilities.
V. Streets - Substantially Developed or Developing Territory
Except in cases of further development or redevelopment, no upgrading of facilities
will be required. The City will maintain all public streets as required. Service
level and funding will be in accordance with the Master Plan for Services.
VI. Street Sweeping
The City of Cupertino provides regular street sweeping on all curbed and guttered
streets within the City. This island does have curbs and gutters in some areas.
These will be swept every two weeks. In portions where there are no curbs and
gutters sweeping is done once or twice a year, the same level of service as Santa
Clara County.
The City requires no improvements to be made because of annexation.
Municipal street sweeping is financed Ltom the goneral fund and gas tax.
VII. water Supply
This area is currently served by City of Cupertino crater Utility. No change
of agency or rates will occur with annexation. Rates and capacity availability
are listed in the Master Plan for Service, as is City policy regarding hookup,
cost, and financing.
VIII. Gas and Electricity
Annexation will not affect Pacific Gas and Electric Company rate structure.
IX. Garbage Collection
Los Altos Garbage Company provides refuse collection to unincorporated areas
in Santa Clara County at a rate of $4.50/2 cans. The sane service is avail-
able to Cupertino residents for a rate of $3.50/2 cans for front yard pickup.
Cupertino residents also receive a free Spring and Fall pickup. The Senior
Citizen rate in Cupertino is p2.00 for one can.

X. Sanitary Sewer
Service is provided by the Cupertino Sanitary District. There will be no change
on annexation. As long as Santa Clara County Health Department safety criteria
are being met, hookup is not required. Refer to Master Plan for Services for
user charge and capacity. If, in the future, property owners ulish sanitary
sewer facilities, these would be financed through an assessment district or
other means.
XI. Storm Drains
Storm drains are available on Mira Vista, Palo Vista, & Scenic Blvd. Additional
storm drains will not be required because of annexation. If property owners
request them, these could be financed by said owners.
XII. Flood Control
The City of Cupertino participates in the National Flood Insurance Progre A
small portion of this island is contiguous to Stevens Creek flood plain. Cuper-
tino has appropriate General Plan restrictions so no habitable building will
be constructed in that area.
X1II. Street Lighting
There are street lights located within this area. If annexed, the City will
maintain these lights from the general fund and/or gas tax. Additional lighting
will not be required. If additional. lighting is desired by the citizens,
property owners will bear the cost of installation.
XIV. Other Services
Cable TV is not available in Cupertino at this time except in the San Jose transfer
area. However, the City is currently negotiating with United Cable TV regarding
a franchise.
Annexation will not require any change in address or postal service.
XV. Special Districts
Special Districts within the area of proposed annexation include:
Cupertino Union School District
Fremont Union High School District
Foothill Community College District
Mid Peninsula Regional Open Space District
Santa Clara Valley Water District
Central Fire Protection District
Cupertino Sanitary District
XVI. Fiscal Implications
Under Proposition 13 the b- +_c tax rate for all areas is $4.00 per hundred
dollars assessed valuation. The City has an additional .023 per $100 assessed
valuation for 1980-81 for Park and City Hall Bonds. Other agencies bonded
indebtedness, if any, would apply regardless of annexations.

XVII. Land Use .Regulation
Any parcel with an existing use that is non-conforming to City zoning regula-
tions and/or the Ceneral Plan will be considered a legal non-conforming use
under the following circumstances:
- The land must have been developed prior to City zoning.
- Land use must have been consistent with County zoning at the time of
development.
Incremental improvements are allotted up to 25% of the value of the existing
structure as determined by the Building Official. Any improveitent in excess
of the stated 25% will require consistency with City zoning re; ulations and
the General Plan.
The General Plan calls for the City of Cupertino R1-10 (residential, single-
family, 10,000 sq. ft. minimum lot size) and was prezoned July 7, 1975.
Current County zoning is County R1-10.
The only exceptions are APN 357-8-8 and 20 and APN 357-8-2 thru 5, 91
and 10 which were prezoned August 25, 1980. Parcels 8 and 20 were
prezoned Planned Development and the others were prezoned R1-10
