Annexing of area designated "Permanence 78-8"
BACKGROUND
In order to annex area designated "Permanente 78-8" IAF—1 required that a small
parcel approximately .03 acre also be included in the anr. -�xation., thereby
creating a non-100% annexation. Council conducted the required public hearing
November 20, 1978. No protests were filed against the annexation. at any time
prior to the conclusion of the hearing and, therefore, Council approved the
annexation.
The legally required waiting period has passed and adoption of Resolution No.
4880 completes the City's process in the annexation.

Resolution. No. 4819: "A Resolution of the City Council of the City of Cuper-
tino --vitiating Annexation. Proceedings Pursuant to Section 35031 of the
Government Code and Setting Time and Place for the Public Hearing of 'Permanente
78-8' "
BACKGROUND
The proposed annexation designated "Permanente 78-8" has been approved by the
Local Agency Formation Commission of the County of Santa Clara. However,
as both City staff and members of LAFCO have been. unable to contact owner of
record of a small parcel. involved and, therefore, obtain 100% consent, 1IORGA guidelines
require the City to conduct a public hearing.
STAFF RECOMMENDATION
Adopt Resolution No. 4819 initiating annexation proceedings and setting time
and place of public hearing for proposed annexation.

The undersigned certifies as follows:
I am the duly selected and acting Executive Officer of the Santa Clara
County Local Agency Formation Commission.

was filed with me on July 19
Said petition is signed by landowners an ', pursuant to Sections 35110 to
35124/ 5.0.4 ,602, inclusive, Government Code, I have examined the
petition.
The results of my examination are as follows:
1. All signatures on the petition were secired within six months of
the date on which the first signature on the petition was affixed, and the
petition was submitted for filing within 60 days after last signature as
affixed.
2. Said petition was signed by all of the landowners owning land
within the territory proposed to be annexed/deta aAjzed who also
own all of the assessed value of land within such territory.
3. The petition and supplemental application filed on this proposal
contain all of the information and data required by Section 35110/6 61.40 of
the Government Code, and all the information and data requested by the
Santa Clara County Local Agency Formation Commission.
Based upon such examination, it is HERLBY DETERMINED AND CERT-jrIED that
the petition is a sufficient petition and was signed by all of the owners
of land within the territory proposed to be annexed/dat&chadZ=o ganiz-qj�
and said petition is hereby being certified for filing on the date shown
below.
This petition will be considered at the Sept. 6 , 19 78 meeting
of the Local Agency Formation Commission.
