a Petition requesting the aaaemtion to the City of Cupertino all of the terri-
tairy hereinafter described; and
WHEIM, this Council has received evidence shoving that, and finds a
mitten description of the proposal to anarx *,.aid territory to the City of
Cupertino was filed with the Local Agency Amixetion Commission of gents,Clara
County and with the Secretary of the Boundary Commission of Santa Clara County,
California, and that said Boundary Comission has prepared, or caused to be
prepared a report to the proponents of said annexation upon said ennesatlan
paWasal, all as required by law, and that said Local Agency Annexation Com-
mdssion and said Boundary Commission have approved the boundaries of said
proposed annexation; and this Council has received evidence showing, and
finds that the above mentioned petition was not circulated, signed or filed
with the Council until after said Boundary Commission had made, or caused to
be made said report and bad approved said boundaries and until after said
Local Agaucy Annexation Commission had approved said annexation proposal;
and

1. T', 4 the said territory is situate immediately adjacent to and
touches and is caatiguo»s to the boundaries of the City of
Cupertino; and
2. That less than tolve registared voters resided within said
territory at the time ttm above mentioned petition was filed
with this Council, and that said territory is therefore unin-
habited;,and
3. That said petition is signed by owners of not less then one-
fourth of the land in said territory by area and by assessed
value as shown an the last equalised assessment roll of the
County of Santa Clara, California, in which said County such
territory is situsted.

Annexation of Uninhabited Territory Act of 1939, a petition signed by owners
of not less than one-fourth of the land in the hereinafter described territory
by area and by assessed value as shown on the last equalised assessment roll
of the County of Santa Clara, California, requesting annexation of the hersin-
after described terfitM to said City of Cupertino as Uninhabited Territory
Act of 1939 of the State of California, was filed with the Council of the City

Cupertino but within the County of Santa Clara, Caalitwula, of the proposed

4. The territory proposed to be amazed to the City of Cupertino is here-
by described as all that territory situate in the County of Banta Clare, State
of California, bounded and ae a fully described w follore a
Beginning at a point on the Centerline of Stevens Creek Boulevard as
said centerline intersects the southwesterly line of the Soutbarn Pacific
Compamy's Right of Nay, said centerline ad southwesterly line also being
the City Limits line of the City of Cupertino as said line was established
by City r^ Cupertino Ordinance No. 83 and passed March 2, 1"91 titled
"McClellan No. 1-A", thence from said point of intersection Southeasterly
slang said City Limits line and said Southern Pacific Right of Way to the
Intersection thereof with the easterly line of Subdivision No. 1, Tram of
Monte Vista, a map of whieh is filed for record in Book P of fte, Page P49
