WHERHAS, on the 4th day of October 1968 there was filed with this Council a
pitRSion requesting the annexation to the City of Cupertino all of the territory
bsme1nafter described; and
WHEREAS, this Council has received evidence showing that, and finds a written
dmaeription of the proposal to teax said territory to the City of Cupertino was
EZW with the Local Agency Formation Commission of Santa Clara County and with the
le metery of the said Commission of Santa Clara County, California, and that, said
Cwnoission has prepared, or caused to be prepared, a report to the proponents of
sa!-8 annexation upon said annexation proposal; a'1 as required by law, and that
sold Local Agency Formation Co iaslon has appr-ved the boundaries of said proposed
annexation; and this Council has received evidence showing, and finds that the
above mentioned petition was not circulated, signed or filed with the Council until
after said Commission had made, or caused tt; ha vwde, said report and had approver
saSd boundaries and until after said Local Agency Formation Commission had approved
said annexation proposal; and
WHEREAS, this Council has received evidence showing, further finds:
1. That .tie said territory is situate immediately adjacent to and touches
and is contiguous to the boundaries of the City of Cupertino; and

2. That less than twelve registered voters resided within said territory
at the time the above mentioned petition was filed with Council, and
that said territory is therefore uninhabited; and
3. That said petition is signed by owners of not less than one-inurth of
the land in said territory by area and by assessed value as shown on
the last equalized assessment roll of the County of Santa Clara,
California, in which said County such territory is situated.
NOW, THEREFOn:
1. NOTICE HEREBY IS GIVEN that, pursuant to the provisions of the Annexation
of Uninhabited Territory Act of 1939, a petition signed by owners of not less than
ome-fourth of the land in the hereinafter described territory by area and by
mssed value as shown on the last equalized assessment roll of the County of
Smsta Clara, California, requesting annexation of the hereinafter described terri-
tory to said Cicy of Cupertino as Uninhabited Territory pursuant to the provisions
of the Annexation of Uninhabited Territory Act of 1939 of the State of California,
was filed with the Council of the City of Cupertino on October 4, 1968.

Granada Street, between Pasadena and Orange Avenues, containing approximately 2.84
acres, bounded and more fully described in attached Exhibits "A" and "B".

All that certain real property situate in the County of Santa Clara,
State of California, described as follows:
Approximately 2.84 acres lying on the south side of
Stevens Creek Bculevard and the rvjrth side of Granada
Street between Pasadena and Orange Avenues.
Section 2. Pursuant to the provisions of the Government Code of the
State of California, the City Clerk shall and he is hereby directed to file
with the Secretary of the State of California a certified copy of this
Ordinance immediately upon the said Ordinance becoming effective.
Section 3. That all expenses ci proceedings for the annexation of
the said uninhabited territory be paid, and that the same be and they are
hereby allowed.
Section 4. If any section, subsection, sentence, clause, phrase or
portion of this Ordinance is, for any reason, held to be unconstitutional,
void, or invalid, by any court of competent jurisdiction the validity of the
remaining port-ion of this Ordinance shall not be affected thereby.

All that real property situate in the County of Santa Clara, State of
California more particularly described as follows:
Beginning at a point at the intersection of the centerline of Pasadena
Avenue with the prolongation of the southerly line of Lot 15 as said lot is
shown upon that certain map entitled "Subdivision No. 1, Town of Monte Vista",
which map was filed for record in the office of the Recorder of the County
of Santa Clara, State of California, in Book M of Maps at Page 4; thence
along said southerly line of Lot 15 N. 89" 56' W. 165 feet to the southwesterly
corner thence along the westerly line of said Lot 15 and Lot 14 of said tract
due North 50.00 feet to the northwesterly corner of said Lot 14; thence along
the northerly line of said Lot 14 S. 89° 56' E. 130 feet to the point of inter-
section of said northerly line at the westerly line of Pasadena Avenue; thence
along said westerly line due North 366 feet more or less to the intersection of
said westerly line with the centerline of Stevens Creek Boulevard, thence along
said centerline of Stevens Creek Boulevard No. 89" 56' W. 295 feet to the inter-
section of said centerline with the northerly prolongation of the westerly line
of that one-foot strip reservation lying contiguous along the westerly line of
Orange Avenue as shown on the above referenced map; thence along the said
westerly line of said one-foot reserve due South 446 feet more or less to the
intersection of said westerly line with the westerly prolongation of the center-
line of Granada Street; thence along the centerline of Granada Street S. 89° 56'
E. 330 feet to the point of intersection with the centerline of Pasadena Avenue:
thence along the centerline of Pasadena Avenue due N. 30.00 feet to the point of
beginning.
Containing approximately 2.84 acres.

Upon receipt of the certified cups of t1je ordinance, the
Secretary of State shall file it and tranrmlt certificates of filing
to the clerk of the legislative body and board of supervisors of the
county in which the city is situated. From the date of filing by the
Secretary of State, the annexation proceedinge are complete.
The 5th day of February will be 30 days from enactment and this
is the date the ordinance will be sent to the Secretary of State for
filing.
