DE ANZA CIRCLE, CUPERTINO, CA Dear Mr. Zeng, This report is an amended arborist report for the Valley Oak tree growing in the side yard within the deck of the home at 22286 S. De Anza Circle. The tree is growing within the deck space and the house was either designed around the tree or the deck was built around the landscape tree. The home was built approximately 60 years ago around the tree and the roof eaves have already been modified with a reduced size to provide space for the tree to grow. The tree has grown to fill the space the modified eaves have provided. Any further growth of the tree has the likelihood to provide damage to the structure. In order to retain the tree for long term growth, the structure will need to be modified further to change the roofline, potentially the location of the sliding door, and modification of the deck to allow space for the trunk expansion. The tree has a one- sided crown, with end weights on the branches growing towards the neighbor's property to the west. The City requested the following items to be included in the arborists report and additional information: 1. You are not listed in our system as the owner of this property. Please clarify whether you are a new owner and then please provide evidence of ownership of the property such as the grant deed for the residence. If you are not the owner, the owner of the proper will need to sign the tree removal application as the applicant. 2. This tree seems to be located immediately between two residences that appear to be joined, but owned separately. Per the Senior Planner's direction,please obtain a letter from the adjoining property's owner authorizing the tree removal as the tree appears to straddle the property line between the two properties. The aerial image in Appendix 1 clearly shows the tree is located on the subject property. Please review the images and photos showing it growing within the deck and house footprint on the subject property, not a jointly owned tree. We would have had the rship discussion if that was the situation. 3. Please sign and return the attached Hold Harmless Statement required for all City of Cupertino applications. 4. If the subject property is within the R1, Al, A, RHS, and R2 zones, the person requesting the tree removal permit has the option to pay the fee in-lieu of planting a replacement tree. Where the applicant would like to plant a replacement tree,but demonstrates it is physically infeasible to plant on the subject property, the in-lieu fee shall be based on the purchase and installation cost of the replacement tree as determined by the Director of Community Development. In cases where it is physically feasible to plant, but the applicant chooses to pay the in-lieu fee instead of planting a replacement tree on the subject property,payment shall be equivalent to one and one-half the calculated in-lieu tree replacement fee. Based on the table 14.18.160A, a 36-inch boxed tree should be planted as mitigation. The existing site improvements and property design has challenging space for a large-scale canopy tree in a 36-inch boxed container to be planted. There is a spot in the front yard between the cable connection and the small tree for a 36-inch boxed tree. Mr. Zeng intends to plant a 36" boxed Coast Live Oak(Quercus agrifolia) trees his repl4@1Eftt mitigdlh&Seale image in A replacement tree should not be planted within the deck area. The branch spread and crown would not allow use of the deck space. The opening in the deck will likely accept the trunk, but the lower branching habits on 36-inch boxed size container trees would fill up and block use of the deck until the tree could be pruned over the use area of the deck, and then would have a difficult time obtaining adequate roof clearance for 10 feet of firesafe roof clearance. Pruning the young tree for use of the deck and roof clearance would be over-pruning the young tree. The deck would need to be partially or fully removed to plant the 36-inch boxed container tree. The 36-inch boxed tree would likely have to be moved by a crane to plant the tree in the deck after the deck was removed. The deck would need to be replaced with a smaller opening around the young tree trunk smaller diameter. Based on these site conditions, planting the tree in the deck is not a reasonable idea. There is limited space in the rear landscaping for 36-inch boxed large scale tree to be planted within existing landscaping and the grade and slope of the property. The tree is a VaWP ftV'`Quercus lobata), with a trunk diameter of 43.20 inches at approximately 4.5 feet above grade, above the deck. The tree is growing within an area surrounded by 3 sides of the house. The area around the flare under the deck is at grade, and the flare has been excavated to grade. The trunk grows through the deck and there are 2 large leaders at approximately six feet of 36 and 42 inches diameter, both growing near the house, and near the eaves on the east side and south side of the tree. The eaves have been modified to create more space for the tree to grow, and the tree is 1 inch and 4 inches from the eaves, and the tree blocks clear access into the sliding door on the south side of the tree. The 1-sided tree crown leans significantly south and west, with end weights. There is limited space for the tree to continue to grow, and the eaves have no room to be further modified without substantial roof design changes, and likely wall design changes. The area under the deck and under the house were inspected and no cracks in the foundation were observed. There were no signs of oak root fungus. The reason for the requested removal is the lack of space between the tree leaders and the house, and the potential costs of investing in pruning the tree to reduce end weights, while waiting for the tree to impact the house. The tree could be pruned, and it would be a relatively expensive pruning only to delay the removal until the tree actually grows into the house, which could be within 2 to 5 years. The tree has outgrown the available space over the 60 years the home has been around the tree, and removal is a reasonable treatment due to the lack of space around the leaders. Observations: The site was inspected on Wednesday, July 20, 2022 at approximately 6:00 pm. The tree is a Valley Oak(Quercus lobata). The tree was measured with a diameter tape and found to be 43.20 inches at approximately 4.5 feet above grade above the deck. The crown radius was paced and found to be 38 feet. The condition was found to be 50, in the middle of the Fair range. The tree has normal foliage. There is some thinning of branch tips. The tree is growing within an area surrounded by 3 sides of the house. The area under the flare is at grade and the flare has been excavated to grade. The trunk grows through the deck and there are 2 large leaders at about six feet of 36 and 42 inches diameter, both growing near the house. The eaves on the east side and south side of the roof line have been modified to create more space for the tree to grow. There is no room for the eaves to be modified without re-designing the roof, and possibly the walls adjacent to the tree. The smaller leader has a cavity at an old branch wound to remove a branch approximately 6 feet that would have been growing into the house. There are end weights on the long branches. Discussion: The tree is growing within an area surrounded by the house on 3 sides. A limited inspection under the deck and under the house did not find any cracking of the foundation on 2 sides of the tree, south and east. The south leader is approximately 1 inch from the roof eave. The east leader is approximately 4 inches from the roof eave. The tree does move a small amount in the wind. There is no space for the tree to grow on the south side without impacting the roof. There is limited space for the tree to grow on the east side without impacting the roof. There are significant end weights on the long branches that should be reduced to avoid branch failures. This could be accomplished through pruning. The flare was at grade under the deck. There were no signs of Oak Root Fungus on the lower trunk. There is decay in the leader to the south, but not significant enough to justify removal for the decay. The tree is taking up a substantial amount of the deck space and access from the south sliding door is partially blocked by the tree. In discussions with the Mr. Zeng, he is not in favor of retaining the tree and waiting for the damage to the structure to occur before removing the tree. Any further investments in pruning will be part of a phased removal plan before the tree impacts the house with enlarged branch growth. In this situation, the choices are to remove the tree, or re-design and re-build the roof of the house on two sides of the tree. The home rebuild is very expensive and the long-term growth of the tree is not assured. Removal is the preferred solution in this situation. Conclusion: The tree is a large Oak tree in fair condition. The tree has outgrown the space the home was designed to provide. Tree removal is the desired treatment solution to avoid damage to the home and investing in a tree that may not have a long life in the current situation. The pruning will do nothing to reduce the future impact of the leaders impacting the house. Objective: Reduce long end weights to reduce the risk of branch failure on the subject and neighbor's properties,while retaining as large a crown as possible. System: Natural Location of pruning: Upper crown in the outer branches to shorten branches and reduce leverage. Pruning cuts will be branch removal cuts and reduction cuts. Trees are living organisms that can fail in ways we do not fully understand. Conditions are often hidden within trees and below ground. Arborists cannot guarantee that a tree will be healthy or safe under all circumstances, or for a specified period of time. Likewise,remedial treatments, like any medicine, cannot be guaranteed. Treatment,pruning, and removal of trees may involve considerations beyond the scope of the arborist's services such as property boundaries,property ownership, site lines, disputes between neighbors, landlord-tenant matters, etc. Arborists cannot take such issues into account unless complete and accurate information is given.
