Application: Applicant: Location: R-2005-35 David Wong (Siripoke residence) 884 S. Blaney Ave. Residential Design Review for an exception to have 5-foot sideyard setbacks to construct a new 2,698 square foot single-story residence. Design Review Committee decision final unless appealed. This item was continued from the October 6, 2005 Design Review Committee meeting to review the neighboring property side setbacks. Staff member Chao stated that the 2 Design Review Committee October 20, 2005 immediate neighboring properties, 876 and 868 S. Blaney, both had approximately 5- foot side setbacks on one side and 890 S. Blaney had 5' 9" side yard setbacks on one side. The surrounding lots were all of similar lot size, however, he couldn't find any other examples in this neighborhood where the side setbacks were 5' on both sides. An exception to the 6-foot side set back had been granted in other neighborhoods where similar lot and house sizes occurred. An exception is asked for so that the garage door doesn't overwhelm the front elevation of the house. Chairperson Miller confirmed the side setback sizes for the neighboring houses and that the public hearing notice stated that the application was to request a 5-foot side setback. The applicant, Mr. Wong restated that the reduction from a 6-foot setback to 5-feet was in the best interest of the proposed new house design. If a 6-foot side set back were to be maintained, then the house would need to be redesigned such that the rear setback footage would be reduced. Commissioner Giefer was not in favor at all of granting approval of reducing the side setback from it's current 6-foot to 5 feet. She did not want start making exceptions which could start the neighborhood to look "crowded". Chairperson Miller agreed with Commissioner Giefer's concerns, but did not feel that strongly himself. He explained to the applicant that they could either accept the approval with conditions or have the decision of the Design Review Committee appealed to the Planning Commission. Commissioner Giefer was in favor of an exception to maintain the existing 6' side setbacks. Mr. Wong decided that in the interest of time, a re-design of the proposed development would be the best way to proceed with the application. MOTION: Commissioner Giefer moved to approve application R-2005-35 under the condition that the side setbacks remain at the existing 6 feet size and that revised development plans are submitted to the Planning Department for review prior to the issuance of the building permit.
