Action
The Design Review Committee approved the application on a 2-0 vote. This is
effective April 6, 2006. The fourteen-calendar day appeal will expire on April 24,
2006.

PROJECT DESCRIPTION: Sign exception to allow signs to exceed the maximum
height limitation and for several tenants to have additional signs as part of a sign
program at an existing shopping center (Marketplace).
RECOMMENDATION:
Staff recommends approval of EXC-2006-02, based on the model resolution.
BACKGROUND:
The applicant, Todd Lee (Evershine VI, LLP), requests a sign exception to allow signs to
exceed 24 inches in height and to allow several tenants to have three signs when two
signs are allowed. The proposed sign exception applies to the sign program for the
entire shopping center that governs buildings A, B, C & the original shopping center.
Building A and B are recent additions to the center and building C is approved but
construction is pending.

DISCUSSION:

with the building designs. When buildings A, B & C were approved, certain wall
facades and tower features were designed to facilitate larger signs for the anchoring
tenants. In fact, these wall facades or sign bands would appear awkward if the signs on
them were too small (please refer to diagram 1 & 2). The applicant is requesting a sign

exception for two tenants (Merlion & Newthings Wes) in Building A to have signs
greater than 24 inches (see diagram 2).

The applicant is also requesting a sign exception, as part of the shopping center sign
program, to provide tenants the option to exceed 24-inch of sign height by stacking the
signs in two rows (please see attached sign program matrix - page 5). This is similar to
the previous request by Wells FargojStarbucks Coffee approved by the Design Review
Committee (DRC) on March 2, 2006. The applicant is agreeable to a condition that
limits the allowable linear width of the stacked signs to be no more than 50% of each
corresponding business frontages (when 70% is allowed by Code). This is consistent
with the past DRC decisions in allowing exceptions for taller sign heights when the
lengths of the signs are not maximized (i.e., Elephant Bar Sign Exception in building B).

According to the City's Sign Ordinance (17.24.060), each commercial business (tenant)
with exterior frontage shall be permitted one wall sign. A second wall sign is permitted
provided that one of the following conditions is satisfied:
1. For businesses which do not have a ground sign and the business is adjacent to
more than one than one street; or
2. The sign is directed to the interior of the project and not visible from a public
right-of-way.

The intent of the Sign Ordinance is to "provide architectural and aesthetic harmony of
signs as they relate to building design" and to "promote attractive and effective signs."
Due to the unique building placement and orientation, additional wall signs are
necessary in order to provide effective and visible signs from Stevens Creek Blvd. In
addition, the proposed signs are architecturally compatible with the existing building
and the taller sign heights are proportional to the existing building sign bands.
B. The granting of the exception will not result in a condition which is materially detrimental to
the public health, safety, or welfare

The additional signage and taller sign heights will not be detrimental to the public
health, safety, or welfare. Instead, patrons will have an easier time locating the
businesses in the shopping center.
C. Least Modification and Minimum Variance to Accomplish Purpose
The proposed signage shall be consistent with the sign ordinance in terms of size. The
exceptions requests are consistent with the intent and spirit of the sign ordinance.
Staff therefore recommends approval of the sign program per the model resolution.

SECTION II: FINDINGS
WHEREAS, the Design Review Committee of the City of Cupertino received an
application for a Sign Exception, as described in this Resolution; and
WHEREAS, the Design Review Committee finds that the changes beneficial and
compatible with the surrounding area;
1, That the literal enforcement of the provisions of this title will result in restrictions
inconsistent with the spirit and intent of this title;
2. That the granting of the exception will not result in a condition which is
materially detrimental to the public health, safety, or welfare; and
3. That the exception to be granted is one that will require the least modification of
the prescribed regulations and the minimum variance that will accomplish the
purpose.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the application no. EXC-2006-2, is hereby approved; and
That the subconclusions upon which the findings and conditions specified in this
Resolution are based and contained in the public hearing record concerning Application

SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY
DEVELOPMENT DEPT.
1, APPROVED EXHIBITS
Approval is based on the sign program titled: "Exhibit C" consisting of 9 pages and
the colored sign exhibits attached to the staff report except as may be amended by
conditions in this resolution,
2, SIGN AREA
The proposed sign areas shall be consistent with the City Sign Ordinance,
3. DOUBLE ROW SIGNS
The total height of the double row signs shall be consistent with the approved sign
program referenced in the staff report. The linear widths of the double row signs
shall not exceed 50% of the corresponding businesses frontages.
4. SIGN APPROVAL
This approval does not constitute design review approval of the signs for future
tenants unless otherwise stated in the staff report or shown on the approved
exhibits attached to the staff report, Each signs must receive Planning Department
approval via a director's minor modification prior to issuance of building permits.
The Wahoo Fish Taco sign exhibit shall be revised to be consistent with the
approved sign program,
5. BUILDING C
The applicant shall provide a detailed signage plan and program for Building C
consistent with the approved sign program, Said plan/ program shall be reviewed
and approved by the Director of Community Development via a Director's Minor
Modification prior to issuance of building permits of each signs.
6. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant
to Government Code Section 66020(d) (1), these Conditions constitute written
notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified that
the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a),
has begun. If you fail to file a protest within this 90-day period complying with all

I. PURPOSE AND INTENT:
A. TIns criteria-has been established for the purpose of maintaining a continuity of
quality and aesthetics throughout the Shopping Center for the mutual benefit of all
Tenants, and to comply - with the regulations of the City of Cupertino, California
according to current city sign ordinances and Heart of the City Development
Standards and Design Guidelines enacted by the City Council October 2,1995.
B. The intent of the sign criteria is to offer the Tenant design flexibility and to
encourage different types of letter styles, -logos and colors. The signs specified will
offer optimum tenant identifY when designed in confonuance with the design
standards. '
c. Conformance will be strictly enforced, and any installed non-conforming or
unapproved signs will be removed at Tenant's expense.
D, Unique signage designs proposed that do not meet the Landlord's Master Sign
Criteria or the regulations governed by of the City of Cupertino shaH be reviewed by
the Landlord on a case by case basis and are subject to obtaining approvals for an
exception by the Landlord and/or City of Cupertino.
II. GENERAL REOUlREMENTS:
A. Prior to fabrication or applying for city approvals, each Tenant shall submit to the
Landlord, for written approval, three (3) copies of detailed shop drawings in full
color) indicating the location, size, layout, design, color, illwnination, materials,
power demand, and method of attachment. Additionally, shop drawings to include
building elevations illllstrating proposed signage. Sign pennits shall not be issued
without the Landlord's prior written approval ofshap drawings.
B, All signs shall be reviewed by the Landlord for confOlmance with the sign criteria.
Approval or disapproval of sign submittal shall remain the sole and absolute right of
the Landlord.
c, All penuits and fees for signs and their installation shall be obtained by the Tenant or
its representative.
D. All signs shall be constructed at the Tenant's expense.
E. Tenant shall b~ responsible for the installation and maintenance of his sign. Should
Tenant's sign require maintenance or repair, Landlord shall give Tenant ten (10)
days written notice to effect the maiptenance or repair. Should Tenant fail to do so;
Landlord shall undertake repairs and Tenant shall reimburse Landlord within ten (10)
days fÌ'om receipt of invoice.
Ill. STYLE:
Tenant signs must be neon internally self-illuminated individual channel metal letters, 5"
deep, with plexiglass face.
Signs consisting of 2 rows shall be pennitted subject to the maximum heights set forth in
the attached table for the overall sign display.
In no instance shall the maximum height of the letters exceed the heights set forth in the
attached table whether the sign be 1 row or 2 rows.
For signs consisting of 2 rows, the 2nd l~owheight of the sign display lette~ shall not
exceed ~ the height of the 1st row.
IV, CONSTRUCTION REOUIREMENTS:
A, All channel letters are to be fablicated IIsing 24 gage paint-lok'sheet metal with full
welded construction and automotive enamel finish or precoated finish.
B. All sign bolts, fastenings and clips shall be hot-dipped galvanized iron, stainless
steel, aluminum, brass, bronze, nickel or cadmium plated. No black iron materials of
any type will be pennitted.
c. All conductors, cross-overs, transfOlmers, wiling and other equipment must be
concealed in an outdoor rated raceway or behind the sign fascia as specified in the
Landlord's installation details

D, Raceways and angle iron supports shall be painted to match color of the building
background to which the sign is being affixed. Paint color matching fonnulas to be
provided by the Landlord.
E. Metal birdspikes shall be installed by the Tenant's sign installtion conctractor 'on the
tops of all raceways.
F, The face of the channel letters and logos shall be acrylic plastic (3/16" thick
minimum) fastened to the metal frame by a %" trim cap.
a, All signs and their installation must comply with all local building and electrical
codes and bear a V.L. label if required by the local governing agency.
H. The stroke of the letter will dictate the number of rows of neon tubing and the milli-
amp requirements for internal illumination, The tubing is to be installed and labeled
in accordance with the "National Board of Fire Underwriters Specifications".
v. INSTALLATION:
A. All signs are to be installed under the direction of the Tenant's pre-qualified sign
installation contractor subject to Landlord's installation criteda. Sign wOl:k is not to

cmrunence on Tenant's Premises unless a signed copy of the approved shop
drawings have been reviewed by the Landlord or Landlord's other representative and
the required approvals and pennits have been issued by the City of Cupertino. Each
sign will be inspected for confonnance with the detailed shop drawings.
B. Tenant's sign installation contractor(s) shan completely install 'and connect the sign
display to Landlord's provided power for sign circuits and centralized timer
controller. Sho.uld centralized power for sign circuits and timer controller not be
available to the building, then Tenant's contractor shall provide power to sign
display directly from Premises of Tenant's electlical subpanel with control by a
photocell.
c, The sign contractor shall repair any damage to the Building caused by his work. All
penetrations of the Building shall be neatly sealed in a water tight condition and
shall be patched to match the adjacent finish. Penetrations shall be limited to three
(3) penetrations per character of Tenant's sign. For instances requiring Tenant's sign
to be attached to a wood glu lam bemn façade, channel letters must be affixed to the
sign display raceway with penetrations occuning only for attaching the raceway to
the face of the wood glu lam beam, Dmnage to the Building that is not repaired by
the sign-contractor shall be corrected at Tenant's expense.

D. Landlord will inspect Tenant's sign installation and require Tenant to have any
discrepancies and/or code violations corrected at Tenant's expense.
VI. LocATION:
All signs shall be located as detailed on the attached drawings.
vn. GUARANTEE:
The entire sign display shall be guaranteed for one (1) year against defects in material and
workmanship, Defective parts shall be replaced without charge Landlord or Tenant.
VIII. INSURANCE:
The sign company shall carry workmen's compensation and public liability insurance
against all damage suffered or done to any and all persons and/or property while engaged
in the construction or installation of signs in the amount of $1,000,000 per occurrence.
Such proof of current certificate of insurance shall be provided to the Landlord prior to
scheduling of sign display installations. Tenant's sign installation company shall be
required to name as additionally insured the Landlord, any applicable lender, and other
entities associated with the Premises or project.
IX. ALLOWABLE AREA:
"Total area pennitted for commercial wall signs is to be increased from 1 squre foot per
linear foot of store frontage to 1.5 square feet" per City of Cupertino Heart of the City
Development Standards and Design Guidelines enacted by the City Council October 2,
1995. Maximum height ofletters and length of wall signs shall be in conformance with the
table below as set forth by the City of Cupertino Sign Regulations:

x. OUANTITY OF SIGN DISPLAYS:
Each 'Tenant will be permitted and required to furnish one (I) only fascia sign unless the
Premises has store ftontage on more than one side of the building, in which case Tenant
will be required to furnish signage on a minimum of two (2) building elevation ftontages.
XI. COLOR: '
Variations of color fi-om one Tenant to another is encouraged.
The side returns of the metal channel letter must be painted with Kelly Moore Paints 701-
M Stone Age. The trim cap must be anodized dark bronze.
Chain Tenants with sign and logo colors not provided by the aforementioned colors will be
considered on an individual basis by Landlord.
XII. LOGOS:
Tenant will be pennitted to display one (I) logo at each sign location. The logo area shall
be included within the sign area limitation, The logo shall be defined as a graphic symbol
commonly used by the Tenant for identification. The logo shall have a metal channel
outline of the symbol with construction as required for Tenant's channel letters.
Logos shall be permitted to exceed the height of the overall sign by a margin of 2" at the
top and 2" at the bottom.
XIII. STORE FRONT AND RECEIVING DOOR SIGNAGE:
A. Tenant shall be permitted to place a sign of not more than 144 sqIlare inches at the
bottom of the window panel adjacent to the store ftont entry door. The sign shall be
decaled or adhered lettering indicating hours of business, emergency phone numbers,
approved credit cards, etc. No other window signage will be pennitted at any time
without the Landlord's prior written consent.
Street address numbers will be installed by Landlord above store ftont entry door.
Tenant may install a sign 3" high, black- vinyl adhesive helvetica medium letter on
rear service door for business identification. Lettering shall be centered on door 5'
above the finished floor.
XIV. PROHIBITED SIGNAGE:
A. Except as provided herein, no -advertising placards, neon or illuminated signs,
external displays, decorative lighting, flags, balloons, banners, pennants, names,
insignia, trade marks or other descriptive material, shall be affixed or maintained
upon either the interior or exterior glass panes and supports of the show windows
and doors or upon the exterior walls of the buildings without Landlord's prior written
review and approval.
B. Signs on or affixed to trucks, automobiles, trailers or oth'er vehicles which advertise,
identify, or provide direction to a use ,or activity not related to its lawful making of
deliveries of sales or merchandise 'Or reÎ1dering of services from such ~ehicles is
prohibited.
xv, EXPIRATION OF LEASE TERM:
At the expiration or a sooner tennination of Tenant's lease tenn, Tenant shall remove its
signs and patch the sign fascia to match the adjacent finish.
XVI. MAJOR TENANTS:
The provisions of this sign criteria shall not be applicable to identification signs of
occupancies designated by the Landlord as major tenants. These tenants may install their
standard signage, which appears on buildings operated. by them in California providing the
signs are architecturally compatible and have been approved by the Landlord and the local
governing agency.

I. PURPOSE AND INTENT:
A. This criteria has been established for the purpose of maintaining a continuity of
quality and aesthetics throughout the Shopping Center for the mutual benefit of all
Tenants, and to comply with the regulations of the City of Cupertino, California
according to current city sign ordinances and Heart of the City Development
Standards and Design Guidelines enacted by the City Council October 2, 1995.
B, The intent of the sign criteria is to offer the Tenant design flexibility and to
encourage different types of letter styles, logos and colors. The signs specified will
offer optimum tenant identify when designed in confonnance with the design
standards.
c. Confonnance will be strictly enforced, and any installed non-confonning or
unapproved signs will be removed at Tenant's expense,
D. Unique signage designs proposed that do not meet the Landlord's Master Sign
Criteria or the regulations governed by of the City of Cupertino shall be reviewed by
the Landlord on a case by case basis and are subject to obtaining approvals for an
exception by the Landlord and/or City of Cupertino.
11, GENERAL REOUIREMENTS:
A. Prior to fabrication or applying for city approvals, each Tenant shall submit to the
Landlord, for written approval, three (3) copies of detailed shop drawings in full
color) indicating the location, size, layout, design, color, illumination, materials,
power demand, and method of attachment. Additionally, shop drawings to include
building elevations illustrating proposed signage. Sign pennits shall not be issued
without the Landlord's prior written approval of shop drawings.
B. All signs shall be reviewed by the Landlord for confonnance with the sign criteria,
Approval or disapproval of sign submittal shall remain the sole and absolute right of
the Landlord,
c. All pennits and fees for signs and their installation shall be obtained by the Tenant or
its representative.
D. All signs shall be constructed at the Tenant's expense,
E. Tenant shall be responsible for the installation and maintenance of his sign. Should
Tenant's sign require maintenance or repair, Landlord shall give Tenant ten (10)
days written notice to effect the maintenance or repair. Should Tenant fail to do so;
Landlord shall undertake repairs and Tenant shall reimburse Landlord within ten (10)
days rrom receipt of invoice,
III, STYLE:
Tenant signs must be neon internally self-illuminated individual channel metal letters, 5"
deep, with plexiglass face.
Signs consisting of 2 rows shall be pennitted subject to the maximum heights set forth in
the attached table for the overall sign display.
In no instance shall the maximum height of the letters exceed the heights set forth in the
attached table whether the sign be 1 row or 2 rows.
F or signs consisting of 2 rows, the 2nd ;ow height of ¡he sign display letter~ shall not
exceed Y2 the height of the 151 row,
IV. CONSTRUCTION REOUIREMENTS:
A, All channel letters are to be fabricated using 24 gage paint-loksheet metal with full
welded construction and automotive enamel finish or precoated finish.
B, All sign bolts, fastenings and clips shall be hot-dipped galvanized iron, stainless
steel, aluminum, brass, bronze, nickel or cadmium plated, No black iron matelials of
any type will be pennitted,
c, All conductors, cross-overs, transfonners, wiring and other equipment must be
concealed in an outdoor rated raceway or behind the sign fascia as specified in the
Landlord's installation details

D. Raceways and angle iron supports shall be painted to match color of the building
background to which the sign is being affixed. Paint color matching fonnulas to be
provided by the Landlord,
E. Metal birdspikes shall be installed by the Tenant's sign installtion conctractor on the
tops of all raceways,
F. The face of the channel letters and logos shall be acrylic plastic (3/16" thick
minimum) fastened to the metal rrame by a y." trim cap.
G. All signs and their installation must comply with all local building and electrical
codes and bear a U,L. label ifrequired by the local governing agency,
H, The stroke of the letter will dictate the number of rows of neon tubing and the milli-
amp requirements for internal illumination, The tubing is to be installed and labeled
in accordance with the "National Board ofPire Underwriters Specifications",
v. INSTALLATION:
A. All signs are to be installed under the direction of the Tenant's pre-qualified sign
installation contractor subject to Landlord's installation criteria. Sign work is not to
,"'. "
commence on Tenant's Premises unless a signed copy of the approved shop
drawings have been reviewed by the Landlord or Landlord's other representative and
the required approvals and pennits have been issued by the City of Cupertino. Each
sign will be inspected for confonnance with the detailed shop drawings.
B. Tenant's sign installation contractor(s) shall completely install 'and connect the sign
display to Landlord's provided power for sign circuits and centralized timer
controller. Should centralized power for sign circuits and timer controller not be
available to the building, then Tenant's contractor shall provide power to sign
display directly from Premises of Tenant's electJical subpanel with control by a
photocell.
c. TIle sign contractor shall repair any damage to the Building caused by his work. All
penetrations of the Building shall be neatly sealed in a water tight condition and
shall be patched to match the adjacent finish, Penetrations shall be limited to three
(3) penetrations per character of Tenant's sign, For instances requiring Tenant's sign
to be attached to a wood glu lam beron façade, channel letters must be affixed to the
sign display raceway with penetrations occuning only for attaching the raceway to
the face of the wood glu lam beam, Dronage to the Building that is not repaired by
the sign contractor shall be cOlTected at Tenant's expense,

D.Landlord will inspect Tenant's sign installation and require Tenant to have any
discrepancies and/or code violations conected at Tenant's expense,
VI, LOCATION:
All signs shall be located as detailed on the attached drawings.
VII, GUARANTEE:
The entire sign display shall be guaranteed for one (I) year against defects in material and
workmanship, Defective parts shall be replaced without charge Landlord or Tenant.
VIII, INSURANCE:
The sign company shall carry workmen's compensation and public liability insurance
against all dronage suffered or done to any and all persons and/or property while engaged
in the construction or installation of signs in the amount of $1,000,000 per occunence,
Such proof of cunent certificate of insurance shall be provided to the Landlord prior to
scheduling of sign display installations, Tenant's sign installation company shall be
required to name as additionally insured the Landlord, any applicable lender, and other
entities associated with the Premises or project.
IX. ALLOWABLE AREA:
"Total area pennitted for commercial wall signs is to be increased from 1 squre foot per
linear foot of store frontage to 1.5 square feet" per City of Cupertino Heart of the City
Development Standards and Design Guidelines enacted by the City Council October 2,
1995, Maximum height ofletters and length of wall signs shall be in confonnance with the
table below as set forth by the City of Cupertino Sign Regulations:

x. OUANTITY OF SIGN DISPLAYS:
Each Tenant will be pennitted and required to furnish one (1) only fascia sign unless the
Premises has store frontage on more than one side of the building, in which case Tenant
will be required to furnish signage on a minimum of two (2) building elevation frontages,

Variations of color from one Tenant to another is encouraged.
The side returns of the metal channel letter must be painted with Kelly Moore Paints 701-
M Stone Age, The trim cap must be anodized dark bronze.
Chain Tenants with sign and logo colors not provided by the aforementioned colors will be
considered on an individual basis by Landlord.
XII, LOGOS:
Tenant will be pennitted to display one (1) logo at each sign location, The logo area shall
be included within the sign area limitation. The logo shall be defined as a graphic symbol
commonly used by the Tenant for identification, The logo shall have a metal channel
outline ofthe symbol with construction as required for Tenant's channel letters.
Logos shall be pennitted to exceed the height of the overall sign by a margin of 2" at the
top and 2" at the bottom.
XIII, STORE FRONT AND RECEIVING DOOR SIGNAGE:
A. Tenant shall be pennitted to place a sign of not more than 144 square inches at the
bottom of the window panel adjacent to the store front entry door. The sign shall be
decaled or adhered lettering indicating hours of business, emergency phone numbers,
approved credit cards, etc. No other window signage will be pennitted at any time
without the Landlord's prior written consent.
Street address numbers will be installed by Landlord above store front entry door.
Tenant may install a sign 3" high, black vinyl adhesive helvetica medium letter on
rear service door for business identification, Lettering shall be centered on door 5'
above the finished floor.
XIV, PROHIBITED SIGNAGE:
A Except as provided herein, no advertising placards, neon or illuminated signs,
external displays, decorative lighting, flags, balloons, banners, pennants, names,
insignia, trade marks or other descriptive material, shall be affixed or maintained
upon either the interior or exterior glass panes and supports of the show windows
and doors or upon the exterior walls of the buildings without Landlord's prior written
review and approval.
B. Signs on or affixed to trucks, automobiles, trailers or other vehicles which advertise,
identifY, or provide direction to a use ,or activity not related to its lawful ,making of
deliveries of sales or merchandise 'or reÏldering of services from such Ýehicles is
prohibited,
xv. EXPIRATION OF LEASE TERM:
At the expiration or a sooner tennination of Tenant's lease tenn, Tenant shall remove its
signs and patch the sign fascia to match the adjacent finish,
XVI, MAJOR TENANTS:
The provisions of this sign criteria shall not be applicable to identification signs of
occupancies designated by the Landlord as major tenants, These tenants may install their
standard signage, which appears on buildings operated by them in California providing the
signs are architecturally compatible and have been approved by the Landlord and the local
governing agency.

APPROVING SIGN EXCEPTION TO ALLOW SIGNS TO EXCEED THE
MAXIMUM HEIGHT LIMITATION AND FOR SEVERAL TENANTS TO
HAVE ADDITIONAL WALL SIGNS AS PART OF A SIGN PROGRAM AT
AN EXISTING SHOPPING CENTER (MARKETPLACE)

SECTION II: FINDINGS
WHEREAS, the Design Review Committee of the City of Cupertino received an
application for a Sign Exception, as described in this Resolution; and
WHEREAS, the Design Review Committee finds that the changes beneficial and
compatible with the surrounding area;
1. That the literal enforcement of the provisions of this title will result in restrictions
inconsistent with the spirit and intent of this title;
2, That the granting of the exception will not result in a condition which is
materially detrimental to the public health, safety, or welfare; and
3. That the exception to be granted is one that will require the least modification of
the prescribed regulations and the minimum variance that will accomplish the
purpose,
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the application no. EXC-2006-2, is hereby approved; and
That the subconc1usions upon which the findings and conditions specified in this
Resolution are based and contained in the public hearing record concerning Application
Resolution No. 233

April 6, 2006, and are incorporated by reference herein.
SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY
DEVELOPMENT DEPT.
1. APPROVED EXHIBITS
Approval is based on the sign program titled: "Exhibit C" consisting of 9 pages and
the colored sign exhibits attached to the staff report except as may be amended by
conditions in this resolution.
2. SIGN AREA
The proposed sign areas shall be consistent with the City Sign Ordinance,
3. DOUBLE ROW SIGNS
The total height of the double row signs shall be consistent with the approved sign
program referenced in the staff report. The linear widths of the double row signs
shall not exceed 50% of the corresponding businesses frontages.
4, SIGN APPROVAL
This approval does not constitute design review approval of the signs for future
tenants unless otherwise stated in the staff report or shown on the approved
exhibits attached to the staff report. Each signs must receive Planning Department
approval via a director's minor modification prior to issuance of building permits,
The larger single rowed signs (30" to 36" - Merlion Restaurant & Bridal Store) shall
be reviewed and approved by the Design Review Committee prior to issuance of
building permits. The Wahoo Fish Taco sign exhibit shall be revised to be
consistent with the approved sign program,
5. BUILDING C
The applicant shall provide a detailed signage plan and program for Building C
consistent with the approved sign program, Said plan/ program shall be reviewed
and approved by the Director of Community Development via a Director's Minor
Modification prior to issuance of building permits of any signs on Building C.
6. NEON
All exposed neon signs shall be approved by the Planning Commission via a sign
exception application.
7. TRELLIS EMBLISHMENTS
The trellis feature along the Stevens Creek Boulevard shall be embellished to better
frame the proposed sign and/ or any future signs. The applicant shall work with
staff to revise the trellis design. A revised trellis plan shall be reviewed and

approved by the Directors of Community Development prior to issuance of any
signs on and/ or around the trellis,
8. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant
to Government Code Section 66020(d) (1), these Conditions constitute written
notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified that
the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a),
has begun. If you fail to file a protest within this 90-day period complying with all
of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.

I. PURPOSE AND INTENT:
A. This criteria has been established for the purpose of maintaining a continuity of
quality and aesthetics throughout the Shopping Center for the mutual benefit of all
Tenants, and to comply with the regulations of the City of Cupertino, California
according to current city sign ordinances and Heart of the City Development
Standards and Design Guidelines enacted by the City Council October 2, 1995.
B. The intent of the sign criteria is to offer the Tenant design flexibility and to
encourage different types of letter styles, logos and colors. The signs specified will
offer optimum tenant identitY when designed in confonnance with the design
standards.
c. Confonnance will be strictly enforced, and any installed non-confonning or
unapproved signs will be removed at Tenant's expense.
D. Unique signage designs proposed that do not meet the Landlord's Master Sign
Criteria or the regulations governed by of the City of Cupertino shall be reviewed by
the Landlord on a case by case basis and are subject to obtaining approvals for an
exception by the Landlord and/or City of Cupertino.

Prior to fabrication or applying for city approvals, each Tenant shall submit to the
Landlord, for written approval, three (3) copies of detailed shop drawings in full
color) indicating the location, size, layout, design, color, illumination, materials,
power demand, and method of attachment. Additionally, shop drawings to include
building elevations illustrating proposed signage, Sign pennits shall not be issued
\yithout the Landlord's prior written approval of shop drawings.
All signs shall be reviewed by the Landlord for confonnance with the sign criteria.
Approval or disapproval of sign submittal shall remain the sole and absolute right of
the Landlord.
All pennits and fees for signs and their installation shall be obtained by the Tenant or
its representative,
All signs shall be constructed at the Tenant's expense.
tenant shall be responsible for the installation and maintenance of his sign. Should
1'enant's sign require maintenance or repair, Landlord shall give Tenant ten (10)
days written notice to effect the maintenance or repair. Should Tenant fail to do so;
Landlord shall undertake repairs and Tenant shall reimburse Landlord within ten (10)
days ITom receipt of invoice.
STYLE:
Tenant signs must be neon internally self-illuminated individual channel metal letters, 5"
deep, with plexiglass face.
Signs consisting of 2 rows shall be pennitted subject to the maximum heights set forth in
the attached table for the overall sign display.
In no instance shall the maximum height of the letters exceed the heights set forth in the
attached table whether the sign be I row or 2 rows,

For signs consisting of 2 rows, the 2nd row height of the sign display letters shall not
exceed Y, the height of the 151 row,
IV. CONSTRUCTION REOUIREMENTS:
A, All channel letters are to be fabricated using 24 gage paint-loksheet metal with full
welded construction and automotive enamel finish or precoated finish,
B, All sign bolts, fastenings and clips shall be hot-dipped galvanized iron, stainless
steel, aluminum, brass, bronze, nickel or cadmium plated. No black iron materials of
any type will be pennitted.
c. All conductors, cross-overs, transfonners, wiring and other equipment must be
concealed in an outdoor rated raceway or behind the sign fascia as specified in the
Landlord's installation details

D, Raceways and angle iron supports shall be painted to match color of the building
background to which the sign is being affixed. Paint color matching fonnulas to be
provided by the Landlord.
E, Metal birdspikes shall be installed by the Tenant's sign installtion conctractor on the
tops of all raceways.
F. The face of the channel letters and logos shall be acrylic plastic (3/16" thick
minimum) fastened to the metal frame by a ÿ,í" trim cap,
G. All signs and their installation must comply with all local building and electrical
codes and bear a U,L,label if required by the local governing agency,
II, The stroke of the letter will dictate the number of rows of neon tubing and the milli-
amp requirements for internal illumination, The tubing is to be installed and labeled
in accordance with the "National Board of Fire Underwriters Specifications",

All signs are to be installed under the direction of the Tenant's pre-qualified sign
installation contractor subject to Landlord's installation criteria, Sign work is not to
commence on Tenant's Premises 'unless a signed copy of the appròved shop
drawings have been reviewed by the Landlord or Landlord's other representative and
the required approvals and pennits have been issued by the City of Cupertino. Each
sign will be inspected for confonnance with the detailed shop drawings.
Tenant's sign installation contractor(s) shall completely install 'and connect the sign
display to Landlord's provided power for sign circuits and centralized timer
çontroller. Should centralized power for sign circuits and timer controller not be
¡¡vailable to the building, then Tenant's contractor shall provide power to sign
display directly from Premises of Tenant's electrical subpanel with control by a
photocelL
The sign contractor shall repair any damage to the Building caused by his work. All
penetrations of the Building shall be neatly sealed in a water tight condition and
shall be patched to match the adjacent finish. Penetrations shall be limited to three
(~) penetrations per character of Tenant's sign, For instances requiring Tenant's sign
to be attached to a wood glu lam beam façade, channel letters must be affixed to the
sign display raceway with penetrations occurring only for attaching the raceway to
the face of the wood glu lam beam, Damage to the Building that is not repaired by
the sign contractor shall be corrected at Tenant's expense.

D. Landlord will inspect Tenant's sign installation and require Tenant to have any
discrepancies and/or code violations corrected at Tenant's expense.
VI. LOCATION:
All signs shall be located as detailed on the attached drawings,
VII. GUARANTEE:
The entire sign display shall be guaranteed for one (I) year against defects in material and
workmanship. Defective parts shall be replaced without charge Landlord or Tenant.
VIII. INSURANCE:
The sign company shall carry workmen's compensation and public liability insurance
against all damage suffered or done to any and all persons and/or property while engaged
in the construction or installation of signs in the amount of $1,000,000 per occurrence.
Such proof of current certificate of insurance shall be provided to the Landlord prior to
scheduling of sign display installations, Tenant's sign installation company shall be
required to name as additionally insured the Landlord, any applicable lender, and other
entities associated with the Premises or project.
IX. ALLOW ABLE AREA:
"Total area pennitted for commercial wall signs is to be increased from I squre foot per
linear foot of store frontage to 1.5 square feet" per City of Cupertino Heart of the City
Development Standards and Design Guidelines enacted by the City Council October 2,
1995, Maximum height ofletters and length of wall signs shall be in confonnance with the
table below as set forth by the City of Cupertino Sign Regulations:

x. OUANTITY OF SIGN DISPLAYS:
Each Tenant will be permitted and required to furnish one (1) only fascia sign unless the
Premises has store fÌ"ontage on more than one side of the building, in which case Tenant
will be required to furnish signage on a minimum of two (2) building elevation fÌ"ontages,
XI. COLOR:
Variations of color from one Tenant to another is encouraged,
The side returns of the metal channel letter must be painted with Kelly Moore Paints 701-
M Stone Age. The trim cap must be anodized dark bronze,
Chain Tenants with sign and logo colors not provided by the aforementioned colors will be
considered on an individual basis by Landlord.
XII, LOGOS:
Tenant will be pennitted to display one (1) logo at each sign location. The logo area shall
be included within the sign area limitation. The logo shall be defined as a graphic symbol
commonly used by the Tenant for identification. The logo shall have a metal channel
outline ofthe symbol with construction as required for Tenant's channel letters.
Logos shall be permitted to exceed the height of the overall sign by a margin of 2" at the
top and 2" at the bottom.
XIII. STORE FRONT AND RECEIVING DOOR SIGNAGE:
A. Tenant shall be permitted to place a sign of not more than 144 square inches at the
bottom of the window panel adjacent to the store fÌ"ont entry door. The sign shall be
decaled or adhered lettering indicating hours of business, emergency phone numbers,
approved credit cards, etc. No other window signage will be permitted at any time
without the Landlord's prior written consent.
Street address numbers will be installed by Landlord above store front entry door.
Tenant may install a sign 3" high, black vinyl adhesive helvetica medium letter on
rear service door for business identification. Lettering shall be centered on door 5'
above the finished floor.
XIV. PROHIBITED SIGNAGE:
A. Except as provided herein, no advertising placards, neon or illuminated signs,
external displays, decorative lighting, flags, balloons, banners, pennants, names,
insignia, trade marks or other descriptive material, shall be affixed or maintained
upon either the interior or exterior glass panes and supports of the show windows
and doors or upon the exterior walls ofthe buildings without Landlord's prior written
review and approvaL
B. Signs on or affixed to trucks, automobiles, trailers or other vehicles which advertise,
identify, or provide direction to a use ,or activity not related to its lawful .making of
deliveries of sales or merchandise or rendering of services fÌ"om such vehicles is
prohibited,
xv. EXPIRATION OF LEASE TERM:
At the expiration or a sooner termination of Tenant's lease term, Tenant shall remove its
signs and patch the sign fascia to match the adjacent finish,
XVI, MAJOR TENANTS:
The provisions of this sign criteria shall not be applicable to identification signs of
occupancies designated by the Landlord as major tenants, These tenants may install their
standard signage, which appears on buildings operated by them in California providing the
