Chair Stanek called the meeting to order at 7:00p.m. via remote teleconference.

CEREMONIAL MATTERS AND PRESENTATIONS
1. Subject: Drought Measures and Impacts to Recreation Facilities
Recommended Action: Receive a presentation on drought measures being implemented
by the City and impacts to recreation facilities.
Joanne Magrini, Director of Parks and Recreation, introduced Jimmy Tam, Assistant
Director of Public Works, and Brian Gathers, Public Works Supervisor, to present on the
item.
Chair Stanek recommended updating the annual water use comparison chart
percentages to reflect the same date ranges as well. Commissioner Tambe suggested
considering greater water conversation methods and policies and incorporating them as
much as possible into all park projects. Commissioner Kumarappan suggested the City
work with water companies to create some water comparison method for residents to
compare their water use to others.

3. Subject: Nature Play
Recommended Action: Receive a presentation on Nature Play regarding future projects
and implementation and provide feedback.
Jason Bisely, Recreation Coordinator, presented to the Commission on the item.
Commissioner Kumarappan suggested collaborating with local artists, talent, and
residents to incorporate their artistic ideas and creations into future projects.
Commissioner Tambe shared research of the mental and physical health benefits of
nature play elements and structures and emphasized nature play as a way to expose
kids and adults to nature and increase awareness. Chair Stanek referred to the labyrinth
at the Saratoga Quarry Park as an example of nature play and suggested it as a possible
idea to incorporate into City parks.
4. Subject: Outdoor Recreation Diversity
Recommended Action: Receive a presentation on Outdoor Recreation Diversity
regarding future projects and implementation and provide feedback.
Alex Corbalis, Recreation Coordinator, presented on the Commission on this item.
Commissioner Tambe recommended incorporating natural and environmental
elements into the outdoor recreation diversity fitness and workout equipment. Also
suggested incorporating turf area at parks for yoga or tai chi. Vice Chair Xu commented
on the benefits of outdoor recreation diversity to all ages. Chair Stanek referenced the
ropes course that was originally at Shoreline, highlighting the opportunities and
benefits for the users and instructors.
5. Subject: Response to the Mayor Regarding Potential Use of the Discretionary Funds
by Commissions.

Recommended Action: Discuss and provide a response to the Mayor regarding
potential use of their discretionary funds by Commissions.
Chair Stanek presented on this item, explaining about the $100 discretionary fund
offered by the Mayor for each Commission to utilize to provide a benefit to the
community. Commissioner Begur shared the history of this item.
Chair Stanek shared her thoughts on what to utilize the fund for and presented a
proposal: a community event to encourage the public to visit a labyrinth, located at the
trail from the McClellan Ranch West Parking lot. Visitors would take their photo at the
site and submit to the City to enter into a raffle.
Requested feedback from the Commission whether to proceed with the proposal and
for any input. Suggested forming a subcommittee to continue and initiate the project.
Commissioner Kumarappan supports the proposal, but also suggested utilizing it as
seed money to invoke ideas from the community to incorporate into current and
ongoing projects. Commissioner Tambe suggested incorporating it into a digital
passport idea to engage the community. The passport could encourage residents to visit
the labyrinth, answer a City survey or sign up for a City emailing list, and attend an
upcoming City event or visit another City site for example. Commissioner Begur
supported Commissioner Kumarappan's and Commissioner Tambe's idea and
suggested acquiring the raffle prizes from local businesses.
Chair Stanek and Commissioner Begur volunteered to form a subcommittee to continue
this project. The Commission agreed to acquire the prizes from local businesses.
Commissioner Tambe motioned to create a subcommittee to move forward with the
project as discussed and initiate it. Commissioner Kumarappan seconded. Motion
passed unanimously.
STAFF AND COMMISSION REPORTS

Recommended Action: Receive monthly update reports from the Director of Parks and
Recreation and Commissioners.
Parks and Recreation Director, Joanne Magrini, provided the Director's update.
Commissioner Tambe attended the ribbon cutting for Linda Vista Trail and McClellan
Ranch Community Gardens. Encouraged residents to apply for a garden plot and walk
the Steven Creek Trail.

Chair Stanek attended and spoke at the ribbon cutting for the Linda Vista Trail and
McClellan Ranch Community Gardens. Shared a garden program led by the Master
Gardeners called "Plant an Extra Row". Shared details on the upcoming Silicon Valley
Day n Night Festival on September 11.

Update on the Dog Off-Leash Area Trial at Jollyman Park and Review of the
Administrative Policy for the Ongoing Program
Recommended Action
Receive an update on the Dog Off Leash Area trial at Jollyman Park and provide
feedback and input on the Administrative Policy for the ongoing program.
Discussion
The Dog Off Leash Area(DOLA) trial was extended until June 30, 2022 due to COVID-
19 and the lack of sufficient data.When prioritizing the City Work Program, City
Council prioritized the DOLA as number 50 out of 50 items. Parks and Recreation staff,
after returning to in-person work in the middle of July,has collected data using an
observation log during DOLA hours and non-DOLA hours. Observation log statistics
and incident logs with data from the City's 311 application, Code Enforcement, San Jose
Animal Control, and Sheriff's Office were recorded by staff.
The trial was intended to continue until sufficient data is collected on the DOLA,
implementation of the updated Athletic Field Use Policy, and to account for any
developments in current COVID restrictions.However, even with the limited
observation data collected thus far, in response to the input received from the public,
staff will now be recommending the conclusion of the trial and to move forward with
the establishment of an ongoing DOLA program at Jollyman Park. The ongoing
program will be monitored by an administrative policy(attachment A) that will allow
for flexibility.
Based on discussions between the City Manager and the DOLA users group,further

Dog Off Leash Area (DOLA) Administrative Policy
Purpose
The purpose of this policy is to outline DOLA rules and regulate the use of the ongoing DOLA
program at Jollyman Park.
Hours
• Seven days a week
• One hour before sunset to one hour after sunset
Incidents and Injuries
• If there is an emergency, please immediately call 9-1-1
• Violation of posted rules and regulations can be reported to
o Code Enforcement (408) 777-3128 or
o Non-emergency Sheriff(408) 299-2311
• Report dog bites/incidents immediately to
o San Jose Animal Care and Services (408) 794-7297
DOLA Rules
Dog owners are required to follow the City's rules for off-leash use during designated hours,
including:
• Dogs must have current licenses and vaccinations [M.C. 8.03.0501
o Licenses must be on the dog's collar
o Collar must be on the dog
• All dogs must be on leash at all times except when in the designated DOLA during
permitted times [M.C. 13.04.130]
• Respect other park users
o Stop bothersome behavior immediately
o Owners are responsible for proper disposal of trash [M.C. 13.04.140]
• Owners must be in control of their dogs at all times
o Dogs with known history of dangerous behavior are not allowed
o Leaving dogs unsupervised is prohibited
• Cleaning up after your dog is mandatory
• Consumption of food and the use of glass containers not allowed during DOLA hours
• Dogs in heat are not allowed
• No puppies less than four months of age allowed
• Owners must provide their own drinking bowls
• Owners must stop their dogs from digging and fill any holes caused by their dogs
Owners are legally responsible and liable for the action of their dogs and injuries, or damage
caused by their dogs. The City of Cupertino assumes no liability for the users of the DOLA.

Violations [M.C. 1.12.010]
A. It is unlawful for any person to perform any act that is prohibited, made, or declared to
be unlawful or an offense by the code, or to violate any provision or fail to comply with
any of the requirements of this code. A violation of any provision or failing to comply
with any of the mandatory requirements of the code shall constitute a misdemeanor,
except where the violation is specifically declared to be an infraction.
B. Notwithstanding the above, any violation constituting a misdemeanor may, in the
discretion of the City Attorney, be charged and prosecuted as an infraction.
C. When a violation of a provision of this code which otherwise constitutes an infraction
continues to occur and the violator has been charged with a violation of the same
provision as an infraction on at least four separate occasions and within one year has
forfeited bail on each such occasion, in that event, the City Attorney, in his or her
discretion, may charge a violation of any such provision as a misdemeanor.
D. Unless otherwise specified by this code, an infraction is punishable by:
a. A fine not to exceed $100 for the first violation of a code provision.
b. A fine not to exceed $200 for a second violation of the same code provision
within one year; and
c. A fine not to exceed $500 for each subsequent violation of the same code
provision within one year.
E. Unless otherwise specified by this code, a misdemeanor is punishable by a fine not to
exceed $1,000, imprisonment for a term not exceeding six months, or by both such fine
and imprisonment.
F. Notwithstanding the foregoing and unless otherwise specified by this code, a code
violation of§ 8.01.030, Animals Running at Large, § 8.01.030, Public Nuisance,
§ 8.03.010, Restraint of Dogs, § 13.04.130D, Behavior of Persons in Parks, and
§ 13.04.130P, Feeding Waterfowl Prohibited, shall be subject to a maximum fine as
follows:
a. Fifty dollars for the first violation of a code provision.
b. One hundred dollars for the second violation of the same code provision within
one year; and
c. Two hundred dollars for each subsequent violation of the same code provision
within one year.

JM DOLA Has Partnered With the City Since 2017
2017 In collaboration with the city and the community, JM DOLA residents
researched, petitioned, surveyed and gathered information
Feb 2018 We presented to the Parks and Recreation Commission for the first time.
March 2019 We presented to the City Council again. Council unanimously approved a
JM DOLA trial. Presentation with all its data is available as DOLA
Addendum 1 to this meeting. It shows the extensive, in-depth work and
data collected by DOLA residents from 2017-2019.
October 1, A 10 month JM DOLA trial officially began and has been renewed twice.

Oct 7, 2021 Today, two years later, the Parks and Recreation Commission is
meeting to consider a recommendation to vote to make the DOLA
permanent.

DOLA Data Collection since Trial Began in 2019
We have been faithfully collecting JM DOLA data since November 2019. DOLA
Data Log -Addendum 2 shows our data collection.
To date there are 139 separate observations, backed up by time-stamped
photos provided by different DOLA users.
► Observations include counts of number of dogs and people, date and time of
collection, what and whether there were any adjacent activities occurring with
the DOLA.
► Showing reliability of data, sometimes different observations were made on
the same day at similar or different times by different observers.
► To insure validity of data, the raw data from observations were only entered
by four trained DOLA leaders onto the DOLA Data Log.
The observation data collection by JM DOLA will continue indefinitely until the
DOLA achieves permanent status from the Cupertino City Council.

No Serious Incidents Since 2017
Further data to support JM DOLA is that there have been no
serious incidences or occurences in the DOLA from 2017 to the
present.
We are self monitoring and even have a DOLA "sheriff" who daily
ensures rules are being followed including boundaries and
appropriate behaviors.
Close reading of data from the Sheriff's Office, 311, Code
Enforcement, San Jose Animal Control, show NO SERIOUS
INCIDENTS AT DOLA SITE since 2017.

No Conflicts with Sports Activities Since 2017
The DOLA Data Log since 2019 documents the very light use of the athletic field
next to the DOLA. The athletic field next to DOLA historically has never been
heavily used.
r The updated Field Use Policy was implemented in July 2021. Since then, there has
been a decline in field use.
► In July and August 2021, there were no permits issued for the field adjacent to
DOLA.
► In September 2021, only 2 hours once a week was permitted.I Field use ended 2 hours before DOLA.

DOLA leaders interviewed Sports Team Coaches who stated tt the updated Field
Use Policy made it too expensive for them to apply for a Cupertino permit
Since 2017, when occasional athletic activity has occurred, the DOLA has
always operated without any complaints or difficulty from adjoining activities.

JM DOLA Discussion Is Specific to the JM DOLA Only
► JM DOLA leaders are only asking for recommendation for JM DOLA
permanence.
► Future DOLAs at other parks were never discussed between City
staff and JM DOLA. JM DOLA residents cannot and do not speak for
residents near other city parks.
► The City Council had already put future DOLAs on the City
Workplan for 2022-2023
No Issues Anticipated in the Future
Any potential future changes in COVID restrictions will not
increase interference or difficulties between groups outdoors.
The data from 2017 to 2019 before COVID and from 2020 to
present during COVID document this.
In the future in the winter, if the Parks Department wants to
adjust the winter hours for JM DOLA and/or adjacent athletic field
use, the DOLA will readily accept that.

• To establish off-leash dog hours in the south-east portion of Jollyman Park
where well-behaved canine citizens can exercise in a clean, safe environment
without endangering or annoying people, property or wildlife.
• To keep the space open to all dog lovers and friends who are willing to uphold

• To view this as a community project, in partnership with the City of Cupertino,
designed to satisfy the needs of dog-owners and non-dog owners alike.

Logistics
• Start a 6-month trial for off-leash hours at the south-east portion of Jollyman

• Off leash hours can be 1 hour before sunset to 1 hour after sunset (2 hours in
total) daily. These recommended off leash hours do not interfere with

during the season.

• This presentation was given to the Cupertino Parks and Rec Commission on February 1 , 2018
• Between June 29 and July 22, 20181, the Parks and Rec department conducted a "joiiyman Park:
Unfenced Dog Off-leash Area (DOLA) Trial Survey"
o The survey had 304 respondents. More than 75% of the respondents live within 1 mile of
Jollyman park
• In response to the question "Based upon your knowledge of park use and this proposal, do you
support establishing the dog off-leash area on a trial basis at Jollyman Park as proposed?" more
than 72% of respondents said yes.
• The Parks and Recs director presented his recommendation to the Parks and Rec Commission on
October 4, 2018. The plan for an off leash trial was unanimously recommended for approval.

• It is important for Tycho to play with other dogs freely because play is an integral part of his life. As a responsible pet owner 1 want
to provide this among other things for my dog so that he is healthy and happy and well socialized and does not become unhealthy
and a nuisance to anyone. It also creates a wonderful community of dog lovers and a support system for us.
• Dogs just like people deserves space to release energy and enjoy life!Proof is dogs that are exercised are healthier happier pets. Being
asked, a "few hours"a day for the dogs to be able to run.
• The dog (pet) community need a designated area for play and socializing. We have so many families in the area with dogs but
unfortunately no proper place for the furry animals to play and mingle.All dogs are trained and well behaved so there is no worry of harm
to public. Moreover the field side of Jollyman Park can be fenced for the dogs to stay inside. The dog park on Mary Ave, Sunnyvale is
dirty, very small and unsafe. I'm not comfortable taking my dog there. Please approve this petition.
• My pet dog, Ivy, an important part of my life. Having an area for dogs near where I live will be a great way for her to enjoy the outdoors

• 1 am a senior with 2 dogs. 1 have lived in the Bay Area all of my life and in Cupertino for 40+years. Besides the important
requirement for dog exercise that allows them to RUN and socialization, there is the fairness issue of equal access to City services./
pay all my taxes and have voted for all local and state bond initiatives for schools and other governmental services that have a
favorable benefit for Cupertino and CA. I do not have children and was not educated and raised in Cupertino and therefore did not
receive those benefits which come with living in Cupertino. Even so, 1 always voted for all the bond initiatives that would make
Cupertino a better city. 1 should have equal access to all local parks as do other people. Most cities now allow unleashed dogs in
parks in the early morning and then later in the early evening before sunset. This is equal access!As regards damage to the park,
more maintenance is required to active sports (soccer, rugby,football, etc.) which rip up the grass and required new turf. These
sports are loud and impact the neighborhood-no doubt more often and louder than barking dogs. Many of these sports
participants also leave refuse that is then required to be picked up. 1 tried the Cupertino and Sunnyvale dog parks. These are not my
local parks and require that 1 drive there as opposed to walking with my rollator to Jollyman-my neighborhood park. I have medical
issues. Because dog parks are very small, there were dogs that could have knocked me over. At Jollyman, which is much larger, I
would never have these issues. It is long overdue and time to be fair and equitable and allow us to take our dogs to Jollyman during
specific hours. The issues is NOT whether your like dogs nor not or whether you or your child participates in sports at Jollyman, or
whether you enjoy any of these sports- this is a matter of FAIRNESS! Cupertino City Council please do the right and fair thing...

• IV. What is working?
o Ali said that most users are generally happy and using off-leash areas respectfully. Many
people are involved with their local off-leash area and want to know about work parties,
stewardship groups and how to be more involved. These people are willing to put a great deal
of effort, time and fundraising into keeping off-leash areas desirable places to take their dogs
and encouraging responsible off-leash use. Most of the off-leash areas are in good condition.
Amenities and infrastructure are okay, with the most significant damage being to ground cover.

o Self enforcement does work as does random enforcement (Rangers and Animal Control)
o Off-leash areas create a sense of community

Existing law governs the tort liability and immunity of, and claims and actions against, a public entity, including, but not limited to, a city,
county, city and county, district, and any other political subdivision. Existing law makes the owner of any dog civilly liable for the
damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, as specified, regardless
of the former viciousness of the dog or the owner's knowledge of such viciousness.
This bill would provide that a public entity, as defined, that owns or operates a dog park shall not be held liable for an injury or death of
a person or pet resulting solely from the actions of a dog in the dog park.

The Cupertino Parks and Recreation Commission Invites you to participate in the
Cupertino Labyrinth Quest
De-stress while you, your family and friends enjoy a peaceful stroll around one or both of Cupertino's
hidden labyrinths.
Where: Labyrinth 1 - McClellan Ranch Preserve (22221 McClellan Road) near the additional parking area
Look for signs to the trail leading from the back of the McClellan Ranch Preserve additional parking area
Labyrinth 2 - Creekside Park (10455 Miller Avenue)
At the back of the picnic area behind the clubhouse and play area
After visiting one or both of the labyrinths, email a picture of yourself, your family, or a friend at the
labyrinth and be entered into a drawing to win one of ten $10 gift certificates for a local Cupertino
coffee or tea shop.
Email your name and photo to CupParksRecCommission@gmail.com by 11:59pm on Sunday,
October 31, 2021. Winners will be notified by email by November 15, 2021.
Additionally, visit finyurl.com/CupLabyrinthQuest to provide your feedback about the labyrinth and Cupertino
Parks and Recreation programs and amenities to the Cupertino Parks and Recreation Commission.
