Dear Planning Commission:
I may be late in attending the Planning Commission meeting tonight (9/14/21), But I am sending my comments on Item
Number 4, concerning Density Bonus Ordinance Changes.
I am very concerned about AB 2345 and its affect on building in Cupertino. This bill was Passed without much ability
from the public to comment on it. It suffers from many of the Issues that the other housing bills do, in that the target of
the bill is also to take Away local control from cities, the Public and counties.I
There are already some very serious issues with HCD and RHNA and MTC and ABAG.
They do not seem to be operating in an arena of reality, and are throwing unachievable And erroneous housing numbers
at Cupertino and other cities across the state as they Try to enact the much flawed Plan Bay Area 2050 upon the public
and the cities Of California. Again, the public was never asked their opinion of Plan Bay Area, Yet Plan Bay Area was
implemented by ABAG and MTC and HCD when they came up With their outrageous RHNA numbers for the cities across
the state.
Again, Cupertino and other cities are left picking up the pieces from these disastrous Housing bills, as evidenced this
time by AB 2345. It is poorly written and is meant to Enable developers to just build high density housing with out any
regard to affordability Or environmental constraints.
Like SB 9 and SB 10, AB 2345 is a total sellout and give away to developers.
Please proceed cautiously with any modifications to city density codes. Cupertino has to Make sure this law does not
take advantage of it.
It sounds like our staff have some good ideas and I am sure with our caring elected Planning Commissioners we can
come up with a good plan to protect Cupertino from the ravages Of AB 2345.
Please do not to give any developer 80 per cent or 100 percent density bonus increases.
This is an appropriate and it would have to studied in more depth. The goal of laws like AB 2345 are 100 percent density
and that is not something that is appropriate at This time of state in the roll out of these high density housing bills since
the Public have not been allowed to voice their opinions on them or vote on them
The pattern is that Sacramento politicians just pass bills like AB 2345 and SB 9 and SB 10 Without the public's consent
and this type of activity has to stop immediately.
In fact, so serious is this problem that it is already affecting whether the governor is Recalled or not.
