He was asked questions by the Commissioners, which they answered. The Planning Commissioners discussed the application process. They felt Staff was making good progress in setting up a streamlined, user friendly application process. The Commissioners discussed the need to have a variety of pre -approved plan sets that would include adaptive or inclusionary housing options. They also discussed funding options and potential incentives to encourage low income, teacher, and disabled housing in ADUs. The Planning Commissioners would like to see this item at a future study session to provide additional suggestions as the program evolves. NEW BUSINESS: Vice Chair Wang introduced a future agenda item. He would like to review the City’s Municipal Code to identify areas that are needing clarity, are confusing, or are in conflict with other sections of the Code. Director of Community Development, Ben Fu, stated that this topic could be added to the Planning Commission’s Work Program for the upcoming fiscal year. Chair Moore also said she would like to see the re-instatement of the Senior Commission. Vice Chair Wang stated he would support the re-establishment of the Senior Commission to the City Council in terms of raising awareness of potential necessary changes to density rules and construction methodologies for this population group to plan for future public health emergencies. Subject: Consider approving a development proposal to demolish a 71,250 square foot retail center (The Oaks), remove and replace 74 protected trees, and construct a mixed -used development consisting of 267 housing units (88 Rowhouse/Townhomes, 179 senior apartments of which 131 are senior licensed assisted living units and 48 are affordable or below market rate (“BMR”) senior independent living units), 27 memory care licensed assisted living residences (“memory care residences”), and 20,000 square feet of commercial space. The applicant is requesting a Heart of the City Exception for retail frontage along Stevens Creek Boulevard. The applicant is also requesting a density bonus, including associated density bonus parking reduction and density bonus waivers for height , slope line setback, and dispersion of BMR housing units. The Commissioners discussed at length the various concerns of the project with Staff, the City’s legal Representatives and the applicant. While in overall support of the project, the discussion regarding whether the density bonus waiver for the BMR unit dispersion was appropriate to be granted with a waiver or if the applicant should be required to produce additional documentation and apply for a concession due to financial considerations. There was a motion to deny the project per Staff’s analysis of the project as shown on page 27 of the Staff Report and the Draft Resolution: Find that this action is not subject to environmental review under Section 21080(b)(5) and 15270 of the California Environmental Quality Act (CEQA) guidelines because CEQA does not apply to projects which a public agency rejects or disapproves; and Deny the following permits, as set forth in the attached draft resolution: Development Permit (DP-2018-05), Architectural and Site Approval (ASA-2018-05), Vesting Tentative Map (TM-2018-03), Tree Removal Permit (TR-2018-22), Use Permit (U-2019-03), and Heart of the City Exception (EXC-2019-03) Moved by Chair Moore, second by Com. Recommend that the City Council consider the Planning Commission FY 2020-21 Work Program. Background The City Council adopted the City Work Program FY 2020-21 (Amended 6.2.20) on June 2, 2020. Commissions have been directed to review the approved City Work Program and create a Planning Commission FY 2020-21 Work Program with items from the City Work Program that the Commission would like to weigh in on or review. Discussion The City Work Program FY 2020-21 indicates items pertaining to a particular commission/committee. The following items have been identified for the Planning Commission FY 2020-21 Work Program. 1.Development Accountability Analyze methods to limit the implementation timeline for entitled/future projects and encourage development. Monitor implementation of development agreements and conditions of approval. Review and establish accountability in the project approval process. 2.Update General Plan (GP) and Municipal Code Evaluate the General Plan and Municipal Code per industry standards for areas where objective standards and zoning/design guidelines can be provided and/or revised. Amend General Plan and Municipal Code and zoning code to provide objective standards. Re-evaluate the Heart of the City Specific Plan for sections of the plan that could be clarified and updated easily with objective standards. 3. General Plan Authorization Process Evaluate the existing City Council authorization process for General Plan Amendment projects. 4. Sign Ordinance Update Update existing provisions, particularly in the temporary sign regulations. 5. Residential and Mixed-Use Residential Design Standards Create objective design standards for residential and mixed-use residential projects, including ensuring adequate buffers from neighboring low-density residential development. 6. Study session for the impact and requirement for the next RHNA cycle Review preliminary RHNA numbers. Look at strategies for RHNA compliance including evaluating sites for potential upzoning, and jobs-housing ratio and statistics. 7. Establish Preapproved ADU Plans Establish procedures and policies on streamlining the ADU review process. 8. Consider Policies and Related Code Amendments to Regulate Mobile Services Vendors (w/ CMO) Develop and adopt policies to regulate mobile services vendors to include a variety of use types, as well as incorporating SB 946. 9. Study Session on Regulating Diversified Retail Use (w/ CMO) Identify ways to encourage retail diversity and vital services. Find creative solutions to re-tenant vacant spaces and attract independent operators. Evaluate pros and cons of Retail Formula Ordinances in other cities. 10. Comparative studies that compares standards for mixed use developments and high-density residential guidelines with other cities. Specifically, on parkland, green space, and parking space requirements (Carryover from FY 19-20) Evaluate existing Cupertino standards for consistency with industry standards and best practices. 11. Dark Sky/Lights Out Policy and Bird Safe Design Guidelines (Carryover from FY 19-20) Create dark sky policy and bird safe design guidelines for the protection of public health and wellbeing and the facilitation of habitat friendly developments. Reevaluate street lighting and other lighting that can benefit residential areas. Additional Work Program Items Additional minor items may be added to the Commission Work Program as resources allow. It is important that all items are within the purview of the Commission as defined in the Municipal Code. It is also anticipated that there will be uncertainty and fluctuation with the City’s workload this year due to COVID-19. The City Work Program includes special items that commissions may be asked to advise on, in addition to the commission’s routine work. Role of Commission Staff Liaison The staff liaison is responsible for coordinating the work of the commission and ensuring that the Brown Act and Municipal Code are followed. The staff liaison, as well as all other City staff and Departments, are directed by the City Manager. Overview of the Process In the December/January timeframe, Council requests that each Commission submit suggested ideas for the City Work Program for the upcoming fiscal year. These suggestions are taken into consideration by Departments and the City Manager in developing the proposed City Work Program for Council consideration. When the proposed City Work Program is presented to Council in March, suggested ideas submitted by Commissions are provided as attachments.
