PUBLIC HEARINGS
8. Application 3-U-77 (Revised) of AAA Ambulance Company: Modificatio
of an existing use permit to allow an ambulance company within
an existing commercial/office center and Environmental Review:
The Environmental Review Committee recommends the granting of a
Negative Declaration. The subject property is located on the
northwest corner of Stevens Creek Boulevard and Blaney Avenue in
a P (Planned Development with commercial intent) zoning district.
First hearing. Tentative City Council hearing date - July 19, 1982
Director of Planning and Development Sisk reviewed the application with
the Commission.
Mr. Jim Jackson, representing Mr. Arbuckle, owner of AAA Ambulance,
requested two changes in the proposed conditions of the use permit.
He requested the hours of operation in Condition 16 be changed from
"8:00 a.m. to 11:00 p.m." to "7:00a.m.to 11:00 p.m.". Condition 17,
second sentence, regarding limitation of use of sirens, he requested
the following be added: "or if otherwise required by law or regula-
tion. II
Mr. Richard Arbuckle, Lamar Drive, owner, AAA Ambulance, stated that
the service does not use red lights and sirens often as it is
basically a medical transport service. He felt that a letter received
from Dr. Spector, resident in the area, really addressed emergency
calls. The law does require emergency vehicles to stop at red lights
before continuing on.
Charnel Wedgwood, PTA President, Eaton School, expressed her concern
regarding increased traffic.
James Cox, 10139 N. Blaney, submitted a petition requesting denial of
the application. Concerns were increased traffic, cars going into

bike lanes to let ambulances pass, noise, lack of parking facilities
and an additional 24-hour business in the neighborhood.
Mark Fantozzi, former resident of Judy Drive (present location
of ambulance service) stated that he had never had any problems
with the ambulance service.
It was moved by Com. Blaine, seconded by Com. Binneweg and passed
unanimously to close the public hearing,
It was moved by Com. Blaine, seconded by Com. Binneweg and passed
unanimously to recommend the granting of a Negative Declaration
for Application 3-U-77 (Revised).
It was moved by Com. Blaine, seconded by Com. Binneweg and passed
unanimously to recommend approval of Application 3-U-77 (Revised)
per Standard Conditions 1-14; Condition No. 15 as submitted; Condition
16, change 8:00 a.m.. to 7:00 a.m.; Condition No. 17 with the addition of
"except where otherwise required by law or regulat-ions"; Conditions 18
and 19 per staff reports, findings and subconclusions per staff report.
It was moved by Com. Blaine, seconded by Com. Koenitzer and passed
unanimously to send a minute order to Council requesting the waiver
of standard condition pertaining to sidewalk improvements along
Stevens Creek Boulevard, because the use change is a minor part
of the center and it is a relatively new center.

9. Application 2-V-82 of Mark Fantozzi: Variance from Section
8.5.1 of the Rl (Residential Single-family) Zoning Ordinance
to permit a height of 17 ft. 6 inches on a detached garage
in lieu of the maximum 15 ft. height permitted by ordinance
and Environmental Review: The project is categorically exempt,
hence, no action is required. The subject property is located
on the west side of Linda Vista Drive approximately 650 ft.
south of Hyannisport Drive between Evulich Court and Baxley
Court at 10915 Linda Vista Drive in a Rl-7.5 (Residential
Single-family, 7,500 sq. ft. minimum lot size) zoning
district. First hearing. Tentative City Council hearing
date - July 19, 1982.
Director of Planning and Development Sisk reviewed the request
for variance with the Commission and showed slides of the house
and garage.
Mr. Mark Fantozzi, applicant, informed the Commission of his future
plans regarding remodeling of his home and garage.
Bob Hambleton, plan designer, informed the Commission that the
improvements would be phased in and that the roofline being re-
quested was very important.
Discussion followed regarding use of solar panels , their placement
on the roof and their effectiveness in relationship to the slope
of the roof.

It was moved by Com. Blaine, seconded by Com. Koenitzer and passed
with Commissioners Adams and Binneweg dissenting to recommend denial
of the application as they felt they could not make the necessary
findings to grant the variance.
10. Application 3-V-82 of Donald F. & Connie S. Dooley: Variance from
Sections 20.24.060 and 20.08.220(D.6) of the San Jose Ordinance
to permit a rear setback of 18 ft. for the main building and 10
ft. for a deck in lieu of the 27 ft. main building and 15 ft.
deck setback required by Ordinance and Environmental Review:

First hearing. Tentative City Council hearing date - July 19,
1982.
As the applicant was not present, the City Attorney recommended that
the hearing be continued.
It was mòved by Com. Koenitzer, seconded by Com. Blaine and passed
unanimously to continue the hearing to the next regular meeting at
which time it will be the first item on the agenda.
Director of Planning and Development will contact the applicant and
request that he be present.
The Commission requested that staff inquire regarding legislation to
eliminate the necessity of sending notices to every homeowner in the
San Jose/Cupertino reorganization area in order to bring that area
into conformance with City of Cupertino zoning. The Director of Plan-
ning and Development informed the Commission that Council had
approved August 30, 1982 for a joint Planning Commission/City Council
meeting regarding the. General Plan.
Com. Adams stated that he would not be present for the August 9
meeting. Com. Binneweg stated that she will not be present for the
August 9 and August 23 meetings.
At 9:25 p.m., the meeting was adjourned.
