MINUTES OF THE REGULAR ADJOURNED MEETING OF THE PLANNING COMMISSION
HELD ON AUGUST 2, 1982 IN THE COUNCIL CHAMBER, CITY HALL
CUPERTINO, CALIFORNIA
Chairperson Claudy called the meeting to order at 7:30 p.m. in the
Council Chamber, City Hall.

PUBLIC HEARINGS
1. Application I-GPA-80 of City of Cupertino: General Plan Amendment
to consider a comprehensive amendment of the City of Cupertino
General Plan and a Specific Plan for the Stevens Creek Boulevard
Planning Area. The General Plan Amendment will concentrate on
land use, traffic circulation, housing and economic issues which
affect the entire community. The Stevens Creek Boulevard Specific
Plan will concentrate on the development of a more detailed land
use, circulation and urban design plan for properties which abut
the reach of Stevens Creek Boulevard between Stelling Road on the
west and Stern Avenue on the east. First Hearing continued.

Assistant Planning Director Cowan presented the Commission with a
review of general consensus positions reached at the Commission's July
26, 1982 meeting regarding land use and community character.
}fr. FrankJuszczyk of Grosvenor International stated that he was sur-
prised regarding the height restriction decided upon by the Commission.
He felt that Vallco could be developed with successful mixed use,
especially along Stevens Creek Boulevard. This would include pro-
fessionaloffice with a hotel or high technological offices with a
hotel. He felt that such development would not cause traffic problems

and was consistent with the Sedway-Cooke traffic report. He felt
that the Planning Commission had not heard from the general public
but from a limited segment of the community. Grosvenor recommends
higher intensity be given further consideration and recommends such
to Council. He suggested that the Planning Commission set a density
but height be determined at some later date.
Mr. Walter Ward, General Manager, Vallco, recommended that the Commission
not be fixed and rigid at this time so that proposals could be considered
in the future. He felt that a hotel design could be done so it was
acceptable to the Central Fire Protection District. He requested
I· approximately one hour time for Vallco's consultant to address the
Commission. Mr. Ward stated that 5-8 stories in a hotel is not as
high as 5-8 stories in a commercial or office building.
Paul Sonnenblick, Upland Way, said that Cupertino is presently a
nice blending of rural and suburban character. He has lived in
new York and London and does not want similar high rise buildings
to be in Cupertino. However, he does want a hotel in Vallco, probably
from 2-3 stories in height. He expressed concern regarding fire risk
with high rise buildings. He requested information regarding the
cost/tax ratio with different height buildings and expressed the
hope that the cost/benefit ratio would be considered. However, he
also requested that that not be the only factor to be considered.
Assistant Planning Director Cowan urged the Co~~ission to be cautious
in regard to figures in the General Plan pertaining to 1990 projections
as these obviously could not be accurate.
Mr. Alf Modine, 10385 Prune Tree Lane, stated that he had served
on the Citizens Goals Committee and that the proposed hotel in Vallco
was not to be obtrusive and was not to be on the perimeter of Vallco.
He stated that the Goals Committee was concerned regarding traffic.
He also expresed concern regarding permits for bars in the Blaney
Avenue/Stevens Creek Boulevard area.
Mr. Steven Hays, 22681 San Juan Road, felt that transitional type
developing was occurring in Cupertino. He asked how far outside
the core area 5-8 story buildings would be considered. He asked
if this height would work its way into surrounding areas. He requested
that some rural aspects be maintained. He stated that his neighbors
did not feel they had any leverage with the Planning Commission and/or
Council compared to developers. He stated that Cupertino had become
an exclusive community and was not open to all.
Sanford Diller, Prometheus Development Co., told the Commission that
they intended a mixed use in Town Center and that there would be
interaction with the community. In regard to heights in relationship
to fire protection, he felt this was a technical matter and the company
would work with the Central Fire Protection District to solve problems.
They would also pay their fair share of any costs. He stated that
the project would be designed to keep cars out of the neighborhoods.

Discussion followed regarding fire protection and fire fighting. It
was stated that the Central Fire Protection District is a suburban
fire fighting district, and their methods and equipment would have to
change should highrise buildings develop within their district. If
there is a cost differential in methods, the developer would pay that
difference.
Mr. Roger Mack, Cupertino, stated that Cupertino is as much a job cent
as a residential area. He stated that the Commission and Council
needed to decide what they wanted the community to be and then deter-
mine how to reach that point.
Ann Anger, 10185 Empire Avenue, a member of the original Goals
Committee, stated that prior to its development many citizens did not
want ValleD to go in. Now everyone praises Valleo. She stated that
they are not talking about a massive highrise as there is not very
much land left to be developed. She stated that she would like a
highrise hotel in Vallco and did not see why people were so concerned.
She was against industry in the Seven Springs Ranch area and stated
that she would prefer nice urban housing there.

Ray Shannon, 1157 Yorkshire Drive, stated that he would like a feeling
for the dollars generated per square foot in office and industrial
space. He said that the Questor report does not include sales tax
and that revenues generated were low. He asked what was considered
in "other income".
Barbara Shannon, 1157 Yorkshire Drive, stated that she has talked to
approximately 200 people. The concept of a hotel in Vallco was well
received by these people. A major concern seemed to be what would
happen to Cicero's when Town Center is developed. There was also
much concern regarding traffic.
Assistant Planning Director Cowan stated that the hotel is still
planned to be within Vall co and would still not be near residential
areas.
RECESS: 9:00-9:15 p.m.
Chairperson Claudy stated that the Commission would not be ready for a
joint meeting with the City Council by August 30. It would more likely
be the end of September, but maybe not even then.
Director of Planning and Development Sisk was requested to inform the
City Council at their regular meeting of August 16 that the Planning
Commission would meet August 30 for a regular hearing on the General
Plan but would not be ready to present the plan to them at that time.
It was determined that the Circulation Element would be presented to
the Planning Commission at their meeting of August 30. Trip con-
straints will be discussed August 30 with the Circulation Element.
Other elements of the Plan will be presented August 23.

Location of bars along Stevens Creek Boulevard between the Town Center
and Vallee was discussed. The Commission felt that this area could
be acceptable for restaurants but not businesses that are primarily
bars. There should also be adequate parking provided. Staff was
requested to draw up standards for night uses along Stevens Creek
Boulevard. The use of the facility (food, liquor, music, dancing)
should be tied into required parking. Such high activity commercial
could be acceptable in Town Center and ValleD areas as long as nearby
residential was not impacted. North De Anza Boulevard was also con-
sidered acceptable for restaurants. It was suggested that use permits
could be contingent upon acoustical studies, parking facilities and
performance standards. The Crossroads Shopping Center would also
be acceptable for high activity commercial but not for office buildings.
The predominant use should remain commercial with buildings no more
than 2-3 stories.
Buildings along Stevens Creek Boulevard should also remain at 2-
3 stories. Staff was requested to review height limitations and,
rather than set limits by number of stories, to set them by feet
and should it be from street level or curb level. Large scale manufac-
turing and industry could be acceptable in both Vallco and along
North De Anza Boulevard but not at the Crossroads or Town Center.
Administrative office buildings but not manufacturing facilities
could be acceptable along Stevens Creek Boulevard.
Staff was requested to check with the Cupertino Sanitary District
regarding the sewer situation prior to the August 23 meeting.
