Assistant Planning Director Cowan reviewed the application for Commission.
It was moved by Com. Claudy, seconded by Com. Koenitzer and passed
unanimously to close the public hearing.
It was moved by Com. Claudy, seconded by Com. Koenitzer and passed
unanimously to recommend approval of Application 8-U-83 per Planning
Commission Res. No. 2375 with findings and subconclusions per staff reports.
2. Application 2-TM-83 of Hare, Brewer & Kelley: Tentative Parcel
Map to consolidate three parcels consisting of approximately 1.2
acres into one parcel and Environmental Review: The project is
categorically exempt, hence, no action is required. The subject
property is located on the west side of North De Anza Boulevard
approximately 25~ north of Stevens Creek Boulevard in a P (Planned

Assistant Planning Director Cowan reviewed the staff report with the
Commission.
Michael Hoffman, 1032 Westlynn Way, applicant, stated that the proposed
single-story addition to the existing building will not materially alter
the app~arance of the structure as seen from the street. He stated
that one window will be alterable.

imously to close the public hearing.
It was moved by Com. Blaine, seconded by Com. Binneweg and passed
unanimously to approve Application7-U-83 per Planning Commission

5. Application 3-U-83 of Pacific Properties (Sahara Sands Apartments):
Use Permit to add two additional second story units to an existing
33-unit apartment complex and Environmental Review: The project is
categorically exempt, hence, no action is required. The subject
property is located on the north side of Fallenleaf Lane between
Saratoga-Sunnyvale Road and Westlynn Way in a P (Planned Development!
with multiple family residential intent) zoning district. First I
Hearing. Tentative City Council hearing date - Harch 21, 1983. .
Assistant Planning Director Cowan reviewed the proposed plan with the
Planning Commission.
Jim Fox, Pacific Properties. applicant, answered questions regarding
the masonry wall, trash area and parking places. ~
Alex Gernert, 1052 Westlynn Way, informed Commission he was also speaki g
for the Cardelli family. He wished to reinforce staff recommendation.
He stated that the complex had improved over the last few year; however,1
there was a problem with trash. He stated that dumpster lids are left
open and trash blows around the area. He requested an 8 ft. wall
around the trash area. He also mentioned that parking overflows into
the neighborhood. He expressed concern regarding four or five more
parking places. On Condition No. 19 of the proposed resolution, he re-
quested that the height of the enclosure be listed.
A woman resident of Sahara Sands expressed concern regarding the con-
dition of the apartment over which the new apartments would be built.
She stated there was a leaking problem and the roof and apartments
were soggy.

Mr. Fox stated that the present masonry wall is approximately 4 ft.
high. This wall also acts as a retaining wall. In regard to the down-
stairs unit, Mr. Fox stated that he had previously gone to staff regarding
the roofline and staff had suggested that repairs be done in conjuncion
with the addition. He informed the Commission that he had coated the
roof two or three times. He stated that it would be necessary to add
structural membranes in order to hold the weight of the additional
units.
It was moved by Com. Blaine, seconded by Com. Binneweg and passed unan-
imously to close the public hearing.
Chairperson Adams inquired regarding the trash containers and the height
of the wall. Mr. Fox answered those questions as well as others re-
garding landscaping. Mr. Adams requested that staff ensure the adequacy
of trash enclosures prior to issuance of building permits.
It was moved by Com. Koenitzer, seconded by Com. Blaine and passed
unanimously to recommend approval of Application 3-U-83 per Planning
Commission Resolution No. 2379, Standard Conditions 1-14; Conditions 15-18
as submitted; Condition No. 19 amended to require a six ft. high trash
enclosure on three sides with a gate to accommodate the trash bins;
findings and subconclusions per staff report and discussion at the Planning
Commission meeting.
6. Application 6-U-83 of AEC Electric, Inc.: Use Permit to construct
a two-story office building consisting of approximately 3,200 sq,
ft. and Environmental Review: The Environmental Review Committee
recommends the granting of a Negative Declaration. The subject
property is located on the northeast corner of Stevens Creek Boule-
vard and Foothill Boulevard in a P (Planned Development with office
intent) zoning district. First Hearing. Tentative City Council
hearing date - March 21, 1983.
Director of Planning and Development Sisk reviewed the history of
I this application with the Commission.
Mr. Louis Hop Lee, attorney for the company owning the property,
addressed Council regarding the application, He stated that the property
owoer to the east of the proposed building has no problems with the
plans as drafted. He requested that the Commission recommend approval
without lowering the proposed roof line. He informed the Commission
that because of certain road dedications to the City, the remaining lot
is quite small.
Kenneth Elvin, architect, Los Altos, presented Council with a model
of the proposed building. He stated that the owner does agree to the
dedication the City is requiring. However, he stated that if the owner
gave the City a certain area plus a lifetime easement for utilities, he
would give five feet and could meet certain City requirements. He stated
that the eastern wall of the proposed building is on the property line
and it would be necessary to remove the eave overhang of the proposed
building on that side. He stated that the building included a sun room

to introduce light into the center of the building, and it would be open!
to the sky. It also functions as an exit. This would be professional office.
Ann Anger, Monta Vista, stated that she was quite staisfied with the use¡
of the building; however she would not want any electrical shop there. ¡
(It was pointed out that AEC is an electrical consulting service.)
It was moved by Com. Blaine, seconded by Com. Binneweg and passed unan-
imously to close the public hearing.
Com. Koenitzer stated that in his opinion the building was approximately
twice as large as it should be for that site. He also expressed con-
cern regarding traffic and felt that the access off Stevens Creek
Boulevard was a hazard. He felt access from the northern property line
on Foothill Boulevard would be more appropriate.
Director of Planning and Development Sisk stated that staff has said no
access along Foothill Boulevard. He informed the Commission that the
proposed access for this building would also be the access for the nor-
therly property.
Discusssion followed regarding traffic problems.
Com. Blaine stated that she too felt the building was too large for the I
site. It was pointed out that there would be no windows along the east-,
erly wall. Slope drainage would be away from the building. Concern was
expressed regarding a solid expanse of wall along the easterly side if I
no windows were to be there.
It was moved by Com. Claudy, seconded by Com. Binneweg and passed with
Com. Koenitzer dissenting to recommend the granting of a Negative Dec-
laration.

16 amended to read, "The main access drive from De Anza Boulevard shall
be redesigned to provide a more direct access to the main body of park-
ing. The redesign may involve a shift in driveway location to line up
with the southerly side of the main building. The Director of Planning
and Development shall have the authority to approve the design changes. '
Conditions 17-27 as submitted; the addition of Condition No. 28 to
read, "In the event the applicant cannot comply with Condition No. 17
above, it is understood that this project approval is contingent upon

Phase II): Modification of existing use permit to allow a restaur-I
ant/bar and expansion of an existing 2,300 sq. ft. building by ,

Committee recommends the granting of a Negative Declaration. The :
subject property is located on the west wide of Wolfe Road approxi-I
mately 900 ft. south of Homestead Road (opposite Pruneridge Avenue)
in a P (Planned Development with commercial, office and recreation-I
al intent) zoning district. First Hearing. Tentative City Councill
hearing date - !1arch 21, 1983.
Assistant Planning Director Cowan reviewed the application with the
Commission.
Walter Ward, General Manager, Vallco Park, Ltd., stated that although
the staff report says that there is a five parking place deficit, he
feels that there is actually an excess of four parking places. He re-
quested that Condition 16 be deleted.
Mr. Cowan stated that Vallco is still restricted and therefore Conditioh
No. 16 should remain. He stated that Condition No. 16 does leave flex-Ir-
ibility and the staff would work with Vallco representatives.
David Neale, president, British Pubs, Inc., informed the Commission '[
that they presently are operating in Saratoga. The business emphasizes
dining rather than bar, and he submitted a menu and brochure to each I
Commissioner.

7. Applications 4-U-83 and 4-TH-83 of Carl N. Swenson (Itsuo Uenaka):
use Permit to construct a four-story office building consisting
of approximately 74,700 sq. ft., Tentative Parcel Hap to consolidate
two parcels consisting of approximately 3.1 acres and Environmental
Review: The Environmental Review Committee recommends the granting
of a Negative Declaration. The subject property is located on the
west side of North De Anze Boulevard approximately 200 ft. south
of Mariani Avenue in a P (Planned Development with General Com-
mercial, Industrial and Residential intent) zoning district.
First Hearing. Tentative City Council hearing date for Use Permit -
March 21, 1983.
Director of Planning and Development Sisk reviewed the application for
the proposed development with Commission.
Brad Krouskup representing Carl N. Swenson, introduced the chief
designer of the proposed building and was avilable to answer any ques-
tions.
Bill Corsick, chief designer, Carl N. Swenson, reviewed photos of the
site, a site aerial and a rendering of the interior of the proposed
building with the Commission. He stated that the building was designed
for use by either a single tenant or multi tenants.
Chairperson Adams asked what would be done should the applicant not
acquire the necessary 29 trips for development of this building. Mr.
Krouskup stated that he is making arrangements with the landowners
regarding transfer of trips.
Dr. Joseph Brown, an adjacent property owner, stated that he is quite
satisfied with the proposed building.
Ann Anger, Monta Vista, said that she had attended the ASAC meeting
at which this building was reviewed and they have said it was a pleasure
to see two adjacent property owners trying to complement each others'
development.
It was moved by Com. Koenitzer, seconded by Com. Binnwewg and passed
unanimously to close the public hearing.
Suggestions made by the Commission were moving the driveway but keeping
it away from bus stops, enriching the pavement at the driveway,
placement of a sign at the pedestrian entry, and the southern end of
parking aisle for driveway.
It was moved by Com. Claudy, seconded by Com. Blaine and passed unan-
imously to recommend the granting of a Negative Declaration.

to add a second story to an existing single-story residential duplex
and Environmental Review: The project is categorically exempt,
hence, no action is required. The subject property is located, on
the north side of Bollinger Road between Alderbrook Lane and Lancer
Drive at 6435 Bollinger Road west of Miller Avenue in a P (Planned
Development with duplex intent) zoning district. First Hearing.
Tentative City Council hearing date - March 21, 1983.
Associate Planner Piasecki reviewed the proposed development with the
Commissioners
Mr. John Indiveri, reprsenting Ms. Troy, was available to answer any
questions of the Commission.
Tu-Lung Weng, owner of the duplex east of the applicant's property,
stated that the area consisted of very small lots and houses were close
to the apartments. He stated that he did want to make sure that tenants
continued to have privacy, even with this addition. He stated there
appeared to be no gutters on the side of the apartment complex adjacent
to his property and asked if the addition would worsen the dampness
in his building. He also stated that parking could be a problem in the
future.
Mr. Indiveri stated that the new addition would have gutters.
It was moved by Com. Koenitzer, seconded by Com. Binneweg and passed
unanimously to close the public hearing.

Com. Koenitzer dissenting to recommend approval of Application 5-U-83
per Planning Commission Resolution No. 2384; Standard Conditions 1-14;
