MINUTES OF THE REGULAR MEETING OF THE PLANNING COMMISSION
HELD ON APRIL 25, 1983 IN THE COUNCIL CHAMBER, CITY HALL
CUPERTINO, CALIFORNIA
Chairperson Adams called the meeting to order at 7:35 p.m. in the
Conference Room of City Hall.

APPROVAL OF MINUTES: Minutes of March 16 approved

PUBLIC HEARINGS:
1. Application 9-U-83 of INTERLAND DEVELOPMENT COMPANY (SEVEN
SPRINGS RANCH): USE PERMIT to construct approximately 413
residential dwelling units on approximately 107 acres in a P
(Planned Development with residential intent) zoning district
and ENVIRONMENTAL REVIEW: the project was previously assessed,
hence, no action is required. The units shall consist of
detached houses, semi-detached townhouses and attached town-
houses. The subject property is bounded by Rainbow Drive
to the north, Stelling Road to the east, Prospect Road to
the south and Fremont Older Preserve/Upland Way to the west.
First Hearing continued. Tentative City Council hearing
date - May 2, 1983.

Assistant Planning Director Cowan presented a handwritten outline
to the Commission identifying issues that were not resolved at
the last meeting. Issues covered were site planning} architectural
design and miscellaneous items including, a fire station, development
staging and hillside units. He went on to state that Fire Station
Chief Moore had expressed a need for a lot depth of 150 feet from
the perimeter road for the project site fire station.
Claude Stoller, Stoller & Ong Architects made a presentation
to the commission which consisted of sketches reflecting changes
made since the last meeting.
Jim Jackson addressed the Commission regarding the lack of a
tentative map explaining his misunderstanding of the proceedure.
He went on to address the various concerns of his client regarding
the following conditions: Condition 16 Mr. Jackson stated that
there was no objection to having the precise plan as recommended
to be subject to a public reiew. Condition 17 presented no problem
but Mr. Jackson suggested a revision of language in the resolution
suggesting that the plan be subject to an informational consensus
vote by the affected neighbors but that City Council make the
final decision. He went on to state that condition 20 should
state that the City Council should address the policy issues
regarding San Jose as opposed to Cupertino Water in the project.
Mr. Jackson addressed the item regarding the fire station, stating
that he would like to see a specific size requirement from the
Central Fire District and Chief S'porleder. Condition 22 concerns
were regarding the retention of the four lots on Upland Way.
Paul Sonnenblick, 11525 Upland Way presented a letter from the
homeowners living opposite the Seven Springs Ranch development
on Upland Way. Mr. Sonnenblick stated that the concerns presented
in the letter had not been suffieciently and properly addressed.
The concerns listed in the letter to Commission were, preservation
of the rural nature of Upland Way, integration of the new homes
wi th exis ting homes, preference of a landscaped fence ins tead
of homes fronting Upland Way, insurance of enforcement for conditions
lBC and lBD of the City Council prezoning resolution and recommendation
of a final public hearing with ASAC.
Discussion ensued between the commission, staff and Mr. Sonnenblick
regarding conditions IBC and l3D and traffic circulation.
Rona Wooley, 11593 Upland Way, addressed the commission regarding
commuter traffic on Upland Way and stated that she felt the homes
built across Upland Way should be approximately the same width
as the lots on the other side of the street.
Jerry Pressman, 7925 Rainbow Dr., remarked to the CJrnmission
that he would like to see the commission retain the condition
of resident approval of any plan before its finally approved.

It was moved by Com. Binneweg, seconded by Com. Claudy and passed
unanimously to close the public hearing.
Commission conducted an item by item dfscussion of conditions
as outlined by staff.
There was a majority consensus of 3 with Com. Binneweg dissenting
regarding modification of condition .16 to reflect that ASAC would
have authority to proof the final design of the dwelling units.
Planning Commission, by consensus,directed a minute order to the
City Council requesting that the Central Fire District set down
in writing what their minimum site standards consist of.
It was moved by Com. Claudy, seconded by Com. Blaine and passed
~nanimously, with Koenitzer absent, for approval of Application
9-U-83 with standard conditions 1-14, Condition 15 - as modified
by additional drawings and so forth as submitted tonight, Condition
16 - lead-in paragraph should be modified to be that the ASAC
shall be the one to approve the final design of the dwelling
units and ASAC shall base their decision on building setback
and site concepts and so forth, Condition 16 - eliminate Upland
Way, Condition 16B - change the last two sentences to read, the
units adjacent to Rainbow Dr, sh~ll have a minimum 20 foot setback,
Condition 16C - ASAC may be appeal led by the building permit
applicant of the City Council, change it to be the Director,
Condition 17 - the timing of the development for phase one shall
be the start of construction of the Bollinger Rd./De Anza Boulevard
intersection improvement or six months from the date of the use
permit, but no later than the six months, Condition l8B - bicycle
path adjacent to Rainbow Dr., south side of Rainbow Dr. shall
be installed, Condition IBC - two thirty foot wide pedestrian
corridors shall link Rainbow Dr. with the interior of the project,
the exact placement of these shall be in the vicinity of, if not
adjacent to Weymoth and Yorkshire, the exact placement shall
be determined on the basis of safety considerations incorporating
the final Rainbow Dr. configuration, Condition IBE - as per staff
memo April 11, Condition 19 - City Council shall approve the
traffic control plan for Rainbow Dr., the final plan must be
submitted to the directly affected property owners of Rainbow
Dr. For a vote and the results of this vote shall be submitted
to the City Council which may choose to take this information
into account, Condition 20 - substitute Mr. Jackson's version,
Condition 21, 22, 23 - as is, Condition 24 - eliminate entirely
and with the findings and subconclusions as set forth in this
report and in all of our hearings and discussions on the subject.

2. Application I-GPA-80 of CITY OF CUPERTINO GENERAL PLAN AMEND-
MENT: Continued Public Hearing to consider a comprehensive
amendment of the City of Cupertino General Plan and a Specific
Plan for the Stevens Creek Boulevard Planning Area. The

General Plan will concentrate on land use, traffic circulation,
housing and economic issues which affect the entire community.
The Stevens Creek Boulevard Specific Plan will concentrate
on the development of a more detailed land use, circulation
and urban design plan for properties which abut the reach
of Stevens Creek Boulevard between Stelling Road on the west
and Stern Avenue on the east.
Assistant Planning Director Cowan presented a staff report to the
commission stating that staff would like to receive some commission
input on the issues of housing/second units first, then finish
with input on urban design.
Discussion ensued between staff and Commission regarding, limitation
of the size of second units, occupancy, design standards and
parking limitations.
It was moved by Com. Blaine, seconded by Com. Claudy and passed
unanimously with Com. Koenitzer absent to direct staff to create
a draft ordinance amending the General Plan Housing Element with
staff scheduling for further review.
Assistant Planning Director Cowan presented a staff report on urban
design with sketches and diagrams in which was assembled all the
statements that had been made by the commission and City Council
during the previous year and included staff recommendations.
Discussion ensued between staff and Commission regarding the
urban design plan.
Jason Chartier, 1060 Homestead Road presented the fact to the
commission that he would be resubmitting a plan for his portion
of the Town Center property that would be requesting 80,000 square
feet of office space as opposed to 42,000 square feet as presently
submitted.
Charles Newman, PreRident of the Chamber of Commerce expressed
his concern to the Commission that we should re-emphasize our
commitment to Highway 85 by showing it in every document that
comes from the city as something that is going to happen in
the community.
Robert Wagner, representing the Cali portion of Town Center,
questioned staff and Commission regarding a statement made in
the General Plan that said that a majority of automobile parking
spaces in the Town Center area be below grade.
Assistant Planning Director Cowan stated that the statement was
made as a goal and objective and that it would be up to the Comission
as to whether or not they would want to retain it.
Discussion ensued between staff, Commission and Mr. Wagner regarding
parking.

Mr. Wagner stated to the Commission that he also questioned the
fact that there was not a listing of a compact ratio in terms
of the parking requirements and requested a recommendation.
Assistant Planning Director Cowan explained that the normal ratio
in industrial zones is 60%/40% but that the commission has basically
maintained a 75% ratio for compacts and that it varied based on
the type of development in a PD zone.
Sam Young, 1134 Buena Blvd., Alameda, representing the Greens,
explained to the commission that his company would be sending
them a 17 page memorandum on condominium conversions in Cupertíno.
He went on to state that he felt the information on condo conversion
in the General Plan as now recommended is basically negative and
that the memorandum being sent to commission contained significant
data that may warrant a study session on condo conversions.
It was moved by Com. Claudy, seconded by Com. Blaine and passed
unanimously with Com. Koenitzer to continue the discussion to
May 23.
3. Application 3-Z-83 of CITY OF CUPERTINO (STEVENS CREEK BOULE-
VARD ZONING PLAN): REZONING AND PREZONING approximately 160
acres from various zoning districts co P (Planned Development)
zone or whatever zone may be deemed appropriate by the Planning
Commission and ENVIRONMENTAL REVIEW: The Environmental Review
Committee recommends the granting of a Negative Declaration.
The subject property is located on Stevens Creek Boulevard
generally bounded by Stern Avenue on the east and Stelling
Road to the west excluding the Vallco Park area and the Town
Center area. The purpose of the application is to zone the
affected properties to a zoning district which is consistent
with the General Plan. First Hearing. Tentative City Council
hearing date - May 16, 1983.
Assistant Planning Director Cowan presented a staff report to
the commission explaining that the hearing was to consider a
conceptual planned development document or plan for all the proper-
ties influenced by Stevens Creek Boulevard ranging from Stelling
Road to the west to the western side of Stern Avenue on the east
side of town. He went on to state that Vallco Park and Town Center
areas were omitted because they were being resolved through sep-
arate zoning applications.
Discussion ensued between staff and Commission regarding the condi-
tions of the zoning plan.
John Volkmann, Stevens Creek Blvd., requested clarification from
staff and Commission regarding the statements made on the relation-
ship of the Stevens Creek Blvd. conceptual plan to existing zoning
districts.
Assistant Planning Director Cowan answered Mr. Volkman by stating
that all of the conditions on site that relate to architectural
building form would have to remain intact but some of the oper-
ational activity constraints would take precedence in the new
plan.

Herman Hijmans, Top Furniture Company, presented to Commission
some points he would like to see changed in the Stevens Creek
Blvd. zoning plan. He stated that the van pool requirement
should be eliminated, that he would like to see the FAR for commercial
and office become an interchangable 37% and that he felt that
the City Council had taken away any additional development possi-
bilities rather than buying trip ends.
Discussion ensued between staff, Commission and Mr. Hijrnans regarding
plan changes and FAR.
Janice Buriesci, 20900 Alves Dr. presented some views to the Comission
stating 'that the residents west of De Azna Boulevard would like
some of the same conditions afforded to the residents east of
De Anza Boulevard. She went on to state that she was against
higher density of dwelling unit,s over 10 per acre, that she would
like further restrictions on the type of development going into
the area, that she would like back setbacks and side setbacks
a minimum of 50-75 feet, that height restrictions be included,
and that she is advocating a 15' cement fence between the newly
built or remodeled commercial areas on Stevens Creek Blvd. with
a 251 setback from ther parking and the balance of the property
north of Stevnes Creek and east of Stelling.
Discussion ensued between staff and Commission regarding the
information presented by Ms. Buriesci.
Robert Mussetti, 20916 Alves Dr. addressed Commission on two points.
One being that he would like to see the hardcore barrier along
Stelling that separates De Anza College/Memorial Park from the
commercial area extended to include the Alves Drive neighborhood
and also requested clarification on the statement allowing higher
density in lieu of community wide social goals.
Discussion ensued between staff, Commission and Mr. Mussetti
regarding community wide goals.
Kathy Bernard, Deputy Director of Community Housing Developers,
addressed the Commission on the issue of waiving city fees for
their development for the physically limited.
City Attorney Kilian remarked to Ms. Bernard that she may want
to reiterate her statement to the City Council at an upcoming
public hearing.
It was moved by Com. Claudy, seconded by Com. Binneweg and passed
unanimously with Com. Koenitzer absent to close public hearing.
Disscussion ensued between staff and Commission regarding alter-
ations to the zoning plan conditions.

It was moved by Com. Claudy seconded by Com. Binneweg and passed
unanimously to recommend granting of a negative declaration of
Application 3-Z-83.
It was moved by Com. Blaine and seconded by Com. Claudy and passed
unanimously with Com. Koenitzer absent to reccommend approval of
Application 3-Z-83 to the City Council with all of the conditions
as described in the previous discussion.
Chairperson Adams announced to the public that the previous item
was scheduled to go before the City Council on May 16.
4. Application 33-U-79 of GREGG BUNKER (PHOTO DRIVE-UP), A PUBLIC
HEARING initiated by the City of Cupertino to consider the revoca-
tion of Use Permit 33-U-79 (allowing the operation of a drive-up
window) because of non-compliance with conditions of Approval.
Said property is located at the northwest corner of Wildflower
Way and Saratoga-Sunnyvale Road in a P (Planned Development with
commercial and residential! 5-15 dwelling units per gross acre
intent) zoning district. First Hearing continued.
Director of Planning and Development Sisk stated to Commission
that their was no additional information and that work has taken
place on the site although there were some problems related to
the weather interference.
Mr. Hansen, 220 State St., Los Altos, stated to Commission that
he had been informed that as soon as the weather improved they
would put down the resurfacing of the parking lot and then the
landscaping.
Discussion ensued between staff, Mr. Hansen and Commission regarding
conditions needed~to be completed.
It was moved by Com. Claudy and seconded by Com. Blaine and passed
unanimously to continue this hearing to May 23.
It was moved by Com. Claudy, seconded by Com. Blaine and passed
unanimously to adjourn the meeting of April 25, 1983 to Wednesday
April 27, 1983 at 7dO p.m.
