Application l-Z-83 of Vallco Park, Ltd.: Rezoning approximately 42 acres from OP (Professional Office) and CG (General Commercial) to P (Planned Development with commercial, office and hotel intent) zoning district or whatever zone may be deemed appropriate by the Planning Commission and Environmental Review: An Environmental Im- pact Report is being prepared as part of the General Plan Amendment (1-GPA-80). The rezoning is requested to permit construction of a hotel and approximately 1.6 million sq. ft. mixed use development consisting of multi-story office and commercial expansioin to the Vallco Fashion Park Regional Shopping Center. The subject property is located on the north side of Stevens Creek Boulevard, east side of Wolfe Road, south side of Vallco Parkway and at the northeast corner of Stevens Creek Boulevard and Tantau Avenue. First Hearing continued. 6. Application 6-U-73 of Vallco Park, Ltd. (Vallco Fashion Park Region- al Shopping Center): Amendment of the 1973 Use Permit to rescind certain conditions of approval pertaining to street improvements, truck barricades and limitations on expansion of the Regional Shopping Center and Environmental Review: An Environmental Impact Report is being prepared as part of the General Plan Amendment (1-GPA-80). The subject property consists of the Vallco Fashion Park Regional Shopping Center located on the east and west side of Wolfe Road south of Highway 280 and north of Stevens Creek Boulevard. The Regional Shopping Center is located in a P (Planned Development with reginonal shopping center/commercial use intent) zoning distric . First Hearing continued. ?C-414 ?age 2 MINUTES OF THE APRIL 27, 1983 PLANNING COMMISSION MEETING Assistant Planning Director Cowan presented the staff report to Commission and stated that he was looking for a consensuS opinion in the design policies for the zoning portion and a consideration of the use permit approval with certain conditions. He went On to state that the zoning and use permit applications could not be approved by the City Council until the General Plan Amendment had been approved but that law allows them to be heard concurrently. Walter Ward, Vallco Park, addressed the Commission explaining that he would not like to see any confining conditions at this point in time. He went on to state generalities concerning the phasing of the Vallco development and stated that they would not be building the whole 964,000 sq. ft. that the General Plan permitted at this time. Mr. Ward went on to state his concerns on various conditions in the staff report. He addressed the concern of design standards, stating that there would be a varying of height in the facade facing out. He commented on community facilities, stating that they would finance equipment for security and he had talked with the Central Fire District. He also had talked to County Transit with regard to busing facilities in the area. He went on to state that the garage system would be a major point in the mixed use development and would serve both the commercial, hotel and the office. He stated that they would be building in stages so that the project would be completed more or less at the same time. Director of Public Works Viskovich described to Commission and the audience the City Council's development fee structure within the General Plan Amendment. Discussed ensued between the Commission and staff rpgarding the zoning area boundaries for Vallco Park. Commission requested clarification on the exact zoning boundaries. Com. Claudy stated he would not like to see very intense building in the area. He would not like to see land banking in the area and stated that was a hypothetical concern of his. It was moved by Com. Claudy, seconded by Com. Blaine and passed unanimously to continue Applicatioon l-Z-83 to the meeting of June 13, 1983. It was moved by Com. Binneweg, seconded by Com. Claudy and passed unanimously to close the public hearing. It was moved by Com. Claudy, seconded by Com. Blaine and passed unanimously to recommend approval of Application 6-U-73 modified as per staff findings, rescinding conditions 19, 31 and 34. 7. Application 2-Z-83 of Cupertino City Center (Prometheus Development): Rezoning approximately 26 acres from P (Planned Development with residential, commercial and office use intent) zoning district to P (Planned Development with commercial, office, industrial and hotel intent) zoning district or whatever zone may be deem~n ~ppropriate by the Planning CornmiRRi.on and MINUTES OF THE APRIL 27, 1983 PLANNING COMMISSION MEETING PC-414 hp3 Environmental Review: An Environmental Impact Report is being prepared as part of the General Plan Amendment (1-GPA-80). The zone change is requested to allow construction of approximately 1.2 million sq. ft. of multi-story (maximum eight stories in height) office, commercial and industrial buildings and a hotel. The subject property is located on the southeasst corner 6f Stevens Creek Boulevard and De Anza Boulevard. First Hearing continued. Associate Planner Piasecki addressed the Commission with a staff report recommending that the Planning Commission discuss all aspects of the project including land intensity, land use, building design, form, building height, traffic and street improvements. He went on to state that the application should be continued, however, until the Planning Commission has had a chance to view the final Environmental Impact Report on the General Plan Amendment and amended versions of the traffic analysis detailing street improvement phasing had been done by staff. Com. Blaine commented that she would like to see the three story parkin in the design labeled as such. Robert Wagner, representing Prometheus Development, stated that in their plans they now have reduced density and have also included 160 residential units. Jim Fehr, HOK, architects for Prometheus, presented a slide show to the Commission. Com. Adams stated his concern with the traffic from the amphitheater in the design. Dick Ivy, Barton-Aschman Associates, presented a traffic report to the Commission. Com. Blaine stated that she would like to have a diagram showing all mitigating traffic measures and a new report from the traffic engineer of Barton-Aschman. Com. Adams expressed Com. Claudy's apologies for leaving at 9:15 p.m. due to illness. Discussion ensued between Commission and staff regarding traffic con- cerns in the Prometheus project. Assistant Planning Director Cowan recommended continuation of the application to May 9, 1983. Discussion followed between staff and Prometheus regarding the housing structures placed atop the parking structures. Ellen Davis addressed the Commission with her concerns regarding the Prometheus development stating that she felt there was too much commer- cial, she was concerned about the housing and felt that the project may cause traffic restrictions. pc-414 Page 4 MINUTES OF THE APRIL 27, 1983 PLANNING COMMISSION MEETING Discussion followed between staff and Prometheus regarding the design of the development and the structures on the site. Chairperson Adams questioned the fact that there was no building planned for the southeast corner of the site. Mr. Fehr from HOK explained that he did not find that area exciting or integrating with the rest of the project, a'nd therefore had not planned a building in that site. Associate Planner Piasecki stated that staff thought that a single office user for the site would be appropriate, and Commission concurred. Mr. Piasecki went on to state that staff would like to see the project phased or a phased development. Mr. Wagner from Prometheus explained to the Commission that the development was designed as a mixed project and was anticipating mixed tenants. A summary discussion ensued with the staff and Commission regarding the development. It was moved by Com. Blaine, seconded by Com. Binneweg and passed unanimously to continue Application 2-Z-83 to the meeting of May 9, 1983. UNFINISHED BUSINESS None NEW BUSINESS 8. Application 4-U-83 of Carl N. Swenson - Request for minor modification to overall building height. Director of Planning and Development Sisk explained to Commission that this item had been removed from the agenda. REPORT OF PLANNING DIRECTOR 9. Letter from John Carroll notifying City of the tenant change of the Spaghetti Pot located at the northwest corner of De Anza Bou levard and Rodrigues Avenue·. Director of Planning and Development Sisk presented the letter to the Commission. He also stated that the City Council would be reviewing the Open Space Element on Hay 16, 1983. REPORT OF PLANNING CO~ISSION Com. Blaine stated that she had attended a meeting of the Citizens of the Year Awards and reported on the status of that.
