SALUTE TO THE FLAG ROLL CALL Commissioners Present: Binneweg, Blaine, Koenitzer, Chairperson Adams Commissioners Absent: Claudy Staff Present: Dir. of Planning & Development Sisk Director of Public Works Viskovich Assistant Planning Director Cowan Deputy City Clerk Villarante City Attorney Kilian APPROVAL OF MINUTES - None POSTPONEMENTS OR NEW AGENDA ITEMS - None WRITTEN COMMUNICATIONS Director of Planning and Development Sisk presented to the Commission a copy of the draft construction tax ordinance and a copy of the Christian Science Monitor article on suburbs mentioning Cupertino. ORAL COMMUNICATIONS - None PUBLIC HEARINGS (continued) 2. Application 2-Z-83 of CUPERTINO CITY CENTER (PROMETHEUS DEVELOPMENT): REZONING approximately 26 acres from P (Planned Development with residential, commercial and office use intent) zoning district to P (Planned Development with commercial, office, industrial and hotel intent) zoning district or whatever zone may be deemed appropriate by the Planning Commission and ENVIRONMENTAL REVIEW: An Environmental Impact Report is being prepared as part of the General Plan Amendment (1-GPA-80). The zone change is requested to allow construction of approximately 1.2 million sq. ft. of PC-4l6 Page 2 MINUTES OF THE MAY 25, 1983 ADJOURNED PLANNING COMMISSION multi-story (maximum eight stories in height) office, commercial and industrial buildings and a hotel. The subject property is located on the southeast corner of Stevens Creek Boulevard and De Anza Boulevard. First Hearing continued. Director of Planning and Development Sisk presented a staff report to the Commission stating that the application would have to be heard again on June 22. Robert Wagner, Prometheus, commented to the Commission regarding the conditions of the resolution. Discussion ensued between Commission, staff and Mr. Wagner regarding development rights of the property. Mr. MacNeil, attorney for Jason Chartier, addressed the Commission regarding Mr. Chartier's request for additional commercial foot~ge. John Vidovich, remarked to Commission that he did not object to the Prometheus application but that he did object to it to the extent that it restricts his project from having additional commercial square footage. Mark Krohl, Prometheus, discussed condition 20, regarding development rights to open space with the Commission. Discussion ensued between staff, Commission and Mark Krohl regarding open space on the Prometheus Development. Richard Maddigan, attorney, stated to Commission that one of the things he felt needed to be said, related to some dialogue that had occurred earlier about whether or not Council was II giving Prometheus, or Town Center something or whether they were taking it away." He went on to state his analysis of the old General Plan as compared to the new General Plan. Com. Koenitzer commented on changes for items 16 and 12 of the resolution. Chairperson Adams stated that the General Plan Amendment should clarified regarding the square footage allocation. Commission discussion ensued reg~rding changes to the General Plan Amendment resolution. It was moved by Com. Blaine, seconded by Com. Koenitzer and passed unanimously to continue discussion of Application 2-Z-83 Cupertino City Center (Prometheus Development) to the meeting of June 22, 1983. . Application ll-U-82 (Revised) of COMMUNITY HOUSING DEVELOPERS, INC.: USE PERMIT to construct 27 residential dwelling units and ENVIRONMENTAL REVIEW: The Environmental Review Committee recommends the granting of a Negative Declaration. This proposal constitutes a revision to a previously approved use permit and includes a density bonus for providing subsidized housing units for handicapped individuals. The subject property is located approximately 150 ft. south of Stevens Creek Boulevard and 280 ft. east of Stelling Road in a P (Planned Development with residential, 10-20 dwelling units per gross acre intent) zoning district. First Hearing. Tentative City Council hearing date - June 6, 1983. Director of Planning and Development Sisk presented a staff report to the Commission. Linda Smith, Community Housing Developers, commented to the Commission on conditions 17, 18, and 19. Betsy Yost, architect, remarked to the Commission that they had redesigned the site plan because HUD had not liked it and was funding the project. She went on to give Commission a thorough description of the current site plan. Discussion ensued between Linda Smith, staff and Commission regarding the condition of a specific management plan. Robert Zier, architect, explained to Commission the parking plan for the project site. Linda Smith, stated to the Commission that Community Housing Developers had submitted a request to the City Council to install the public improvements using Jobs Bill monies. Edith Saroglia, 10067 Bianchi Way, questioned Commission regarding access to her driveway if Bianchi Way is widened as planned. Director of Planning and Development Sisk stated to Commission that a condition could be added to state that the development would provide an easement to private roads and driveways. It was moved by Com. Koenitzer, seconded by Com. Binneweg and passed unanimously to close public hearings. It was moved by Com. Blaine, seconded by Com. Koenitzer and passed unanimously to recommend a Negative Declaration. It was moved by Com. Blaine, seconded by Com. Standard conditions PC-416 Page 4 MINUTES OF THE MAY 25, 1983 ADJOURNED PLANNING COMMISSION 1-14, 15, 16, 17, 18, Condition 19 subject to review prior to issuance, parking and safety plan document shall state screening. Conditions 20, 21, 22 as stated. Condition 23 added as per driveway findings. Chairperson Adams announced that the application would go before the City Council at their meeting of June 6, 1983.
