MINUTES OF THE REGULAR MEETING OF THE PLANNING COMMISSION
HELD ON JUNE 13, 1983 IN THE COUNCIL CiiAMBER, CITY HALL

APPROVAL OF MINUTES: It was moved by Com. Blaine, seconded by Com.
Claudy and passed unanimously to postpone approval of the minutes
until the end of the meeting.
POSTPONEMENTS OR NEW AGENDA ITEMS: Item #1, Application l-Z-83 of
Vallco Park, Ltd. postponed to June 27, 1983 per staff's request.

imously to hear Item No.7, Application 25-TM-8l, as the first item
of business.

7. Application 25-TM-8l - Ralph Hardie - Request for Extension of
Tentative Parcel Map.
It was moved by Com. Claudy, seconded by Com. Blaine and passed unan-
imously to approve the extension of Application 25-TM-8l, Ralph Hardie
for one year, to the date of June 21, 1984.

1. Application 1-Z-83 of Vallco Park, Ltd.: Rezoning approximately
42 acres from OP (Professional Office) and CG (General Commercial)
to P (Planned Development with commercial, office and hotel intent
zoning district or whatever zone may be deemed appropriate by
the Planning Commission and Environmental Review: An Environ-
mental Impact Report is being prepared as part of the General Plan

Amendment (1-GPA-80). The rezoning is requested to permit con-
struction of a hotel and approximately 1.6 million sq. ft. mixed
use development consisting of multi-story office and commercial
expansion to the Vallco Fashion Park Regional Shopping Center.
The subject property is located on the north side of Stevens Creek
Boulevard, east side of Wolfe Road, south side of Vallco Parkway
and at the northeast corner of Stevens Creek Boulevard and Tantau
Avenue. First Hearing continued.

2. Applications l6-U-83 and 5-TM-83 of D.C.E. Inc. (Richard Childress):
Use Permit to construct five detached single-family homes, Tentative
Subdivision Map to subdivide approximately one acre into five
parcels ranging in size from 7,000 sq. ft. to 8,000 sq. ft. and
Environmental Review: The project was previously assessed, hence,
no action is required. The subject property is located on the
north side of Almaden Avenue approximately 100 ft. west of Orange
Avenue in a P (Planned Development with single-family residential
intent) zoning District. First Hearing. Tentative City Council
hearing date - June 20, 1983.
Assistant Planning Director Cowan presented a staff report to Commission
explaining that the application was a resubmittal of an expired develop-
mental application that was approved in 1980. He went on to state
that the condition to be corrected was Condition 16 which was to be
deleted.
Mr. Richard Childress, DCE Inc., addressed the Commission regarding
the application explaining that in essence it was the same project as
of two years ago.
It was moved by Com. Claudy, seconded by Com. Blaine and passed unan-
imously to close the public hearing.
It was moved by Com. Blaine, seconded by Com. Claudy and passed unan-
imously to recommend approval of Applications l6-U-83 and 5-TM-83,
findings and subconclusions as set forth by staff; tentative map per
Conditions 1-14, 15, 16 to be rewritten; use permit per conditions
1-14 and 15.
3. Application 6-TM-83 of Whaley and Associates: Tentative Parcel
Map to subdivide approximately .7 acre into two parcels and En-
vironmental Review: The project is categorically exempt, hence
no action is required. The subject property is located on the
southwest corner of Alcalde Road and Santa Lucia Road in a Rl-7.5
(Residential single-family, 7,500 sq. ft. minimum lot size)
zoning district. First Hearing.

Assistant Planning Director Cowan presented a staff report to the
Commission, explaining that the applicants request was to consolidate
three lots of record containing approximately .7 acres into two lots.
Staff recommends approval of the application.
John Kolski, 10540 Santa Lucia Road, addressed the Commission regard in
his concerns about the road intersection on his frontage.
Discussion ensued between staff and Commission regarding the parcels
and the site of the proposed intersection.
It was moved by Com. Claudy, seconded by Com. Blaine and passed
unanimously to close the public hearing.
It was moved by Com. Claudy, seconded by Com. Blaine and passed unan-
imously to recommend approval of Application 6-TM-83, Conditions 1-
14, 15, 17, 18 as per staff findings.
Chairperson Adams stated to the public that the City Council would be
hearing this application on June 20, 1983 and that there would be a
five day appeal period for anyone interested in appealing the applica-
tion.
4. Applications 4-Z-83 and l5-U-83 of Design Analysis: Rezoning
approximately 10 gross acres from OP (Planned Office) zone to
P (PLanned Development) zone or whatever zone may be deemed
appropriate by the Planning Commission, Use Permit to construct
two office buildings totaling approximately 39,000 sq. ft. and En-
vironmental Review: The Environmental Review Committee recommends
the granting of a Negative Declaration. The subject property is
located in the southeast quadrant of De Anza Boulevard and Rod-
rigues Avenue. First Hearing. Tentative City Council hearing
date - July 5, 1983.
Assistant Planning Director Cowan presented a staff report with dia-
grams to the Commission. He also stated that the two items staff were
concerned about were ingress/egress to De Anza Boulevard from the
project and also having Commission defer judgment as to the design
and actual need of Condition 21 regarding off-site improvements until
the traffic analysis of the Prometheut project has been finalized.
Mr. John Rintala, representing Town Center Associates, addressed the
Commission, explaining that he felt Condition 21 was equitable between
the property owners. He also commented on parking and commercial
space in the center.
Chairperson Adams recommended that Condition 21 reflect an equitable
participation in the off-site improvements on Rodrigues.
Discussion ensued between staff and Commission regarding parking
standards for the site.

Mr. Mark Williams, architect for Design Analysis, discussed various
aspects of the design with the Commission, such as landscaping and
driveways.
Mr.Richard Maddigan addressed the Commission concerning the speed
bumpö ln the Town Center property.
It was moved by Com. Blaine, seconded by Com. Claudy and passed
unanimously to close the public hearing.
Com. Claudy stated that the application should go back to ASAC for
architectural review.
It was moved by Com. Blaine, seconded by Com. Claudy and passed unan-
imously to recommend the granting of a Negative Declaration for Applications
4-Z-83 and l5-U-83.
It was moved by Com. Blaine, seconded by Com. Claudy and passed unan-
imously to recommend approval of Application 4-Z083, Conditions 1-16 as
per staff findings and subconclusions.
It was moved by Com. Blaine, seconded by Com. Claudy and passed unan-
imously to recommend approval of Application l5-U-83, Conditions 1-20;
21 modified to reflect equitable participation in Torre Avenue paving,
22-24 as per staff findings.
Chairperson Adams stated that the City Council would be reviewing the
applications on July 5, 1983.
5. Application 26-U-74 (Revised) of Bethel Lutheran Church: Use Permit
to construct an elementary school play yard at an existing church
facility and Environmental Review: The Environmental Review Committee
recommends the granting of a Negative Declaration. The subject
property is located on the southwest corner of Finch Avenue and
Sorenson Avenue in a BQ (QuasiPublic) zoning district. First Hearing.
Associate Planner Piasecki addressed the Commission with a staff report
and diagrams. He explained that the Planning Commission's decision
would represent a final action unless appealed to the City Council and
that staff recommended approval per the exhibits and the revised wording
of Condition 19 as listed in the staff findings, and that also staff
recommended the granting of a Negative Declaration.
Mr. Robert Hinkel, 10030 Richwood Drive, presented an amended landscaping
sketch to the Commission.
Mr. Bob Schwenk, 1005 Tulipan, explained that the dotted lines on the
new landscape sketch defined a generalized play area.
Mrs. Irma Tavas addressed Commission regarding her concerns about the
landscaping in the area and expressed her desire to intervene in the
landscaping plan and her desire to be put on a mailing list whenever
this application came up.

Discussion ensued between staff, Commission and Mr. Schwenk regarding
the landscaping plan and the application.
It was moved by Com. Blaine, seconded by Com. Claudy and passed unan-
imously to close the public hearing.
It was moved by Com. Claudy, seconded by Com. Blaine and passed unan-
imously to recommend approval of the revised Application 26-U-74.
Commission concurs with Condition 1 stating that all previous con-
ditions imposed in Planning Commission Resolution No. 2217 shall re-
main in full force and effect with the exception of Condition 19 which
is amended to add a paragraph stating that the materials shall be
worked out with the residents and must have approval of the staff.
The last paragraph stating that the landscaping coatinue around the
corner is deleted. Add a condition stating that the staff will moni-
tor installation of the landscaping.

6. Application l7-U-83 of Town Center Properties (Jason Chartier):
Use Permit to construct 232 attached residential condominium units
and a four story, 81,550 sq. ft. office building and Environmental
Review: The Environmental Review Committee recommends the grant~
ing of a Negative Declaration. The subject property is located
bewteen Stevens Creek Boulevard and Rodigues Avenue east of the
future extension of Torre Avenue in a P (Planned Development with
commercial, office and residential, 15-30 dwelling units per
gross acre intent) zoning district. First Hearing. Tentative
City Council hearing date - June 20, 1983.
Associate Planner Piasecki addressed Commission with a staff report
explaining that the applicant was looking for some general direction
and stating that the proposal was not consistent with the General Plan
and was asking for an additional 40,000 sq. ft. of office building.
Commissiqner Claudy explained that the Town Center Properties were
required to build 366 dwelling units as per request of the property
owner.
John Vidovich, representing Town Center Properties, stated that he
believed the project as previously approved was unbuildable and was
requesting Planning Commission feedback on the new application.
Discussion followed regarding the new app-l-±cantion-'-s plans.
Com. Blaine commented on interest rates, the design of the garages,
and stated that both designs refined the residential and the commer-
cial. She also commented that she would recommend making the whole
site residential.
Com. Claudy concurred with Com. Blaine regarding the current housing
plans. He went on to state that the current office plans were un-
acceptable and that a mixed use might be recommended for the commer-
cial site.

Chairperson Adams concurred and stated that he would like to see all
of the site residential and that he would like to see a seismic assess-
ment made on the site and possibly breaking up the units into smaller
parcels.
Mr. Vidovich stated to the Commission that he would like to receive
staff recommendations and a critique on his current design from the
Conunission.
Commission discussion followed regarding the old plan vs. the new plan
for the site. Staff, Commission and applicant discussed the application
and actions to be taken at this time.
It was moved by Com. Claudy, seconded by Com. Blaine and passed unan-
imously to continue the hearing to the meeting of June 27, 1983.
UNFINISHED BUSINESS
7. Heard earlier in meeting.
8, Application 28-U-80 - Vallco Park, Ltd. (Grosvenor International) -
Informal discussion of site plan modifications.
Assistant Planning Director Cowan presented a staff report with a
diagram showing minor modifications of the Vallco Park Site Plan.
The site plan and site plan modifications were discussed by staff
and Commission.
Mr. Frank Juszczyk, representing Grosvenor International, 44 Montgomery
St., San Francisco, explained to the Commission that the application
was a proposal to develop Parcel No.4. Discussion followed between
staff and Commission regarding control of future development in the
undeveloped areas of Vallco Park.
Mr. Juszczyk stated to the Commission that Grosvenor Int. and Val1co
have negotiated to allocate bonus square footage allotted as per the
City Council's request and that the result was the modified master plan
application. He then gave a brief description of the proposed uses of
the site plan.
It was moved by Com. Blaine, seconded by Com. Claudy and passed
unanimously to send a Minute Order to staff stating that the Commission
was in agreement with the proposed disposition of the parcel in the appli-
cation.
NEW BUSINESS
9. Interpretation of General Plan Land Use Diagram relative to the
Fontainbleu Apartments.
Assistant Planning Director Cowan addressed the Commission with
a staff report explaining that this was an informational item, and that
there was an error in the original zoning map adopted in 1979 concerning

the Fountainbleu Apartments on Miller Avenue and that staff would
like permission from the Commission to change the map to reflect the
existing conditions.
Commission concurred with staff and requested them to change the zon-
ing map.
(City Clerk's Note: City Attorney Kilian left the meeting at 10:30
p.m.)
REPORT OF PLANNING COMMISSION
Com. Claudy reported on some dead trees.
Com. Blaine commented on maintenance of landscaping in the City.
Com. Claudy also commented on the Kester building.

Minutes of Regular Meeting of April 11, 1983 - It was moved by Com.
Claudy, seconded by Com. Blaine and passed unanimously to approve the
minutes of the April 11, 1983 meeting.
Minutes of Regular Meeting of April 25, 1983 - It was moved by Com.
Blaine, seconded by Com. Claudy and passed unanimously to approve the
minutes of the April 25, 1983 meeting.
REPORT OF THE PLANNING DIRECTOR
Assistant Planning Director Cowan brought to the Commission's
attention that Energy Commission would be reviewing the energy portion
of the General Plan on the following Wednesday night and invited
them to attend if they so desired.
