Chairperson Claudy called the meeting to order at 6:32 p.m. in Council
Chamber, City Hall.

APPROVAL OF MINUTES: It was moved by Com. Blaine, seconded by Com. Adams
and passsed unanimously to approve the minutes of the November 9, 1981
Planning Commission meeting as submitted.

Application HC-sl,546.l - Antonio Reyes: Requesting Planning Commis-
sion approval of a 600 sq. ft. addition to an approved 3,100 sq. ft.
industrial building located at the northwest corner of Imperial
Avenue and Lomita Avenue in a ML zoning district.
Director of Planning and Development Sisk reviewed the application with
the Commission. He informed them that parking space problems were not yet
settled.
Mr. James Dyer, 21685 Lomita Avenue, west of the proposed project, told
the Commission that he had been notified of this meeting by the Planning
Department and inquired regarding the space allocation for trash storage
and asked if the Fire Marshal allowed inside storage of trash.

Mr. Dyer stated that there was an increased footage of the proposed
building and not just a shifting of location. He inquired as to the need
for a public hearing and stated his feeling that there had been inadequate
time .allowed for concerned people to see the plans and to respond.

Chairperson Claudy stated that the Commission had received the report
Friday, and that as this is considered a minor deviation, neither
a public hearing nor notice is required.
(City Clerk's Note: City Attorney Kilian arrived at 6:55 p.m.)
Mr. Dyer stated that he had originally been concerned regarding the five
foot dedication and that he felt it had been inappropriate. He felt
there were still bugs in the drawings. He inquired regarding the reciprocal
easement and twelve foot wide handicap parking. lIe preferred a reciprocal
easement with the Reyes' property.
It was moved by Com. Adams, seconded by Com. Blaine and passed unan-
imously to continue discussion of this item to later in the meeting
after the meeting with the Cupertino Sanitary District.
MEETING WITH SANITARY DISTRICT BOARD REGARDING SANITARY SEWER CAPACITY
Dr. Brown introduced members of the Board and Sanitary District staff.
Jack Fleming, Sanitary District Staff, reviewed the history of the District and
stated that there was to be an 8,000,000 gallon daily capacity available, not
including the San Jose Transfer Area. Transparencies were shown pertaining to
the current Cupertino usage and the capacity reserved for future Cupertino use.
He stated that in the core area, there was a change occurring from residential to
industrial/office use. Should there be no unexpected change in growth patterns,
capacity will be reached in approximately 25 years. However, current General
Plan buildout would produce about 8.2 million gallons per day with some alter-
natives going higher. Such increases would require a new trunk line to the plant,
as well as purchase of increased plant capacity. Staff did have some questions
regarding the figures. He stated that at the present time the plant could not
process 8,000,000 per day, but plant capacity is being increased. Most problems
are those of internal cost and engineering. Future planning is going on. It is
planne~ that i~p~ovements would be paid for by new users. The analysis of sewer
capac~ty rema~n~ng was based on the Planning Staff1s figures from the City's
(RECESS: 7:45 - 7:55 p.m.) proposed alternate General Plan Amendments.

The Commission arrived at a consensus that there would be no reciprocal easement
required with property located west of the area in this application, and the
increase in size of the building was approved with Com. Koenitzer dissenting.

3. Application 18-TN-80 of Nonta Vista Development Company - Request for
extension of Tentative Hap.
It was moved by Com. Blaine, seconded by Com. Adams and passed unanimously
to extend Application 18-TM-80 to April 14, 1983.

4. Application 6-TM-80 of Maxine Drummond - Request for extension of
Tentative Map.
It was moved by Com. Blaine, seconded by Com. Adams and passed unanimously
to extend Application 6-TM-80 to December 16, 1982.

1. Application 26-Z-8l of City of Cupertino: Rezoning approximately 20
gross acres from various San Jose zoning districts (noted on table
below) to the City of Cupertino P (Planned Development with commercial
and/or residential 5-15 dwelling units per gross acre intent) zone
or whatever zone may be deemed appropriate by the Planning Commission
and Environmental Review: The Environmental Review Committee recom-
mends the granting of a Negative Declaration. The subject property
is generally located on the west side of Saratoga-Sunnyvale Road
between Rainbow Drive and Prospect Road. First Hearing continued.

Chairperson Claudy reviewed written communications received from James-
town Drive residents regarding the proposed two story height limitation
for the Pollack property.
Mr. Albert K. Ruffo, representing the involved parties, stated that the
conditions proposed in the Conceptual Zoning Plan were acceptable except
that the owners would prefer a three story building. He stated that the
design could be depressed or berms could be used to make the building
look lower. He felt that the ASAC and use permit procedures would control
the design element.
Mr. Angelo Leber, representing Mr. Pollack, showed transparencies com-
paring a two and three story building and possible impact on a neighbor-
hood.

Mr. Peter Schutts, West Main, Los Gatos, presented a transparency showing
buildings of different heights and designs. He stated that he felt the
massing of a building was more important than the height.
Discussion by the Commission ensued with the following results: approval
of a three story building, the setting of a height limit (Com. Binneweg -
No), the height limit set in relation to top of curb (Corn. Binneweg - No
comment), a minimum setback, the height above the top of curb to be 40 feet,
the minimum setback from the westerly property line to the vertical plane
of the three story element to be 50 ft. Also, Item No. l8b shall be amended
to delete "attempt to".
Mr. Dick Chadwick, 1582 Jamestown Drive, expressed concern regarding parking
next to homes.
Mr. L. Hegar, Rainbow and Stelling, was concerned over developers dealing with
generalizations, rather than specifics.
It was moved by Com. Binneweg, seconded by Com. Koenitzer and passed unan-
imously to close the public hearing.
It was moved by Com. Adams, seconded by Com. Binneweg and passed unani-
mously to recommend the granting of a Negative Declaration.
It was moved by Com. Koenitzer, seconded by Com. Adams and passed unani-
mously to recommend approval of Application 26-Z-Sl per Planning Commission
Resolution No. 2261 with the following amendments:
Page 2, under Land Use, second sentence should read, "In recognition of the
predominance of lower intensity suburban uses, the plan limits uses to commer-
cial and office, and the height of the buildings to three stories, not to
exceed forty feet in keeping with suburban design of area".
Page 3, Item 18, Building Height should read as follows:
"a. Three stories not to exceed forty feet above curb line.
b. In recognition of the predominant suburban character of the area,
project designers shall incorporate design elements to reduce the
apparent height of buildings and provide variety in the height, scale,
and architectural detailing of buildings.
c. Elements of buildings located adjacent to the 15-20 ft. westerly land-
scape buffer strip shall not exceed one-story or 15 ft. in height.
Second story elements must be set back a minimum of thirty feet from
the westerly property line. Three story elements must be set back a
minimum of fifty feet from westerly property line."

2. Application 2S-Z-80 of Interland Development Company (Seven Springs Ranch):
Prezoning approximately 148 acres from Santa Clara County Exclusive
Agriculture ("A") zoning district to City of Cupertino P (Planned Develop-
ment with residential intent) zone or whatever zone may be deemed appropriate
by the Planning Commission and Environmental Review: A Draft Environmental
Impact Report has been prepared. The proposed Planning Development prezoning
would permit approximately 419 dwelling units consisting of a mix of
detached and attached single-family dwellings. The property is generally
bounded by Rainbow Drive on the north, Stelling Road to the east, Prospect
Road to the south, and by Fremont Older Open Space Preserve and Upland Way
to the west. First Hearing.
Chairperson Claudy informed those present that hearing on this application
this evening would be limited to two hours. He also stated that audience
speakers would be limited to three minutes apiece.

Assistant Planning Director Cowan stated that a tentative meeting for
December 9, 1981 for further discussion of the application could be
scheduled at Kennedy Jr. High School.
Chief Sporleder, Central Fire Protection District, read a letter into the
record and stated his opinion that a fire station would be needed in the
developing area. Traffic problems would make it difficult for the Dis-
trict to respond to a call in a reasonable time. With the increased
population, there is increased request for service. The City of San Jose
is not part of the Santa Clara County Mutual Aid Program, and the Cox
Avenue and Saratoga area is the nearest Central Fire Protection District
station.
Mr. Edward R. Steefel, attorney for Mrs. Lyddon, stated that quality hous ng
was being planned for the area that would use the beauty of the land.
This would also be mixed housing.
Mr. Jim Jackson, Somerset Court, attorney representing Interland Develop-
ment Co., introduced the next two speakers.
Claude Stoller, architect, reviewed major features of the planned develop
ment which include solar heating, solar water, air movement for cooling,
and stated there would be 70-75 percent energy efficiency and an attempt
would be made to save the orchard as much as possible. Area will be
paved with permeable materials where possible, housing will be clustered
with contiguous open areas. Also planned is a two acre pond, two com-
munity centers and varied unit sizes.
A concern expressed by Commissioners related to existing fruit trees whic
would be in lawns, and the type of watering that would be needed.
Mr. John Mascali, lnterland Corporation, showed slides of various devel-
opments the firm has completed. He also stated that he had met with Mr.
Sonnenblick and other homeowners in the areaa
Mr. Jim Jackson informed Council that the developers' presentation was
concluded and expressed intent to work with neighbors for solutions
to anticipated traffic problems.
Chairperson Claudy opened the meeting for suggestions and rescinded the
three minute time limit as it had not been enforced.
Mra Paul Sonnenblick, president, West Cupertino Homeowners Association,
11525 Upland Way, inquired regarding changes mentioned in a letter dated
February of 1981. He said that he had not seen any of those changes
incorporated into the proposed plan. He informed the Commission that
there were 300 members in the Homeowners Association and he would like to
see a solution to the traffic question prior to Seven Springs development
He felt there were some errors in the EIR such as lack of consideration
of flowers and vegetables in the agriculture section and lack of quanti-
tative data. He also had questions pertaining to the section on noise,
as well as the possibility of no garbage disposals as a mitigating
measure. Other items he addressed were traffic buildup, bicycle riders,
increase of traffic on neighborhood streets, a fire station, and the
creation of a ghetto.

Mr. Stan Koslowski inqiured about sanitation problems and the request
of the San Jose mayor in cutting back of sewage last summer. He asked
about the proposal of pumping sewage up and then having it corne down by
force of gravity. His concern was brownouts or lack of electricity.
Mr. Jerry Pressman, Rainbow Drive, member of the Homeowners Association,
presented some transparencies regarding traffic figures. He expressed
the opinion that this was the most serious problem regarding the develop-
ment, as traffic in the area is heavy even without Seven Springs. He
felt the improvement of Highway 85 would take other traffic off the
streets and would more than compensate for Seven Springs development.
Mr. John Rakich, 11835 Upland Way, Vice President, West Cupertino
Homeowners Association, asked questions regarding "infill developmentll.
He expressed concern regarding optimum development at the expense of
current homeowners in the area.
Mr. Hal Apperson, 1488 Rose Garden Lane, inquired as to why is there
an extreme need for housing in Cupertino. Chairperson Claudy reviewed
the jobs/housing imbalance situation.
Ann McElroy, 13585 S. Stelling Road, asked where the proposed December
9 meeting would be held and who would be able to speak. It was suggested
that the meeting be held in Council Chamber at 7:30 p.m.
Ms. McElroy stated that she had seen surveyors on the property and wished
assurance that no building would be started now.
Martha Sonnenblick stated that she saw a need for roads, not housing.
Concerns of
Commissioners
Concerns expressed by the Commission were traffic: more details on
alternatives (restriping/restricting Stelling at McClellan, Upland
not appropriate for main entrance, parking for recreational vehicles,
parking for Fremont Older Open Space District, access from Upland
\.Jay); the time phasing on improvements to coincide with the develop-
ment; sewage; the necessity of Highway 85; integration with the ex-
isting development along Rainbow; need for a City park; any trail
leading to the Fremont Older Open Space area to be maintained by the
Open Space District and a parking lot on Upland if the trail is located
there; need for caution in amount of dependence on PG&E; possibility of
frontage road; fire station. It was expressed that perhaps Bubb, Stelling
or Prospeçt be made thoroughfares or traffic should be diverted, particu-
larly to lk Anza Boulevard. This would affect present residents as well
as others.
