APPROVAL OF MINUTES: The minutes of the regular meeting of November 23,
1982 were amended as follows:
On page 2, delete the following sentence: "With an increase in plant
capacity it may be necessary for new pipelines also."
After the sentence ending "in 25 years. II, insert I1However, General Plan
buildout would produce about 8.2 million gallons per day with some alter-
natives going higher. Such increases would require a new trunk line to
the plant as well as purchase of increased plant capacity. Staff did
have some questions regarding the figures. II
On page 4, Mr. Regarts statement was clarified to read that he was con-
cerned over developers dealing with generalizations rather than specifics
It was moved by Com. Blaine, seconded by Com. Binneweg and passed unan-
imously to approve the minutes of the November 23, 1981 meeting of the
Planning Commission as amended. The City Clerk was directed to send a
copy of the portion pertaining to the presentation by the Cupertino Sani-
tary District to Mr. Fleming for his review.

PUBLIC HEARINGS
11. Application 26-TM-8l of Lawrence C. Mayerle: Tentative Map to
consolidate and adjust the lot lines of six parcels consisting of
approximately 1.5 acres into three parcels ranging in size from
18,000 sq. ft. to 26,650 sq. ft. and ENVIRONMENTAL REVIEW: The
Environmental Review Committee recommends the granting of a Nega-
tive Declaration. The subject property is located on the north
side of Mercedes Road, approximately 500 ft. west of Cordova Road
and on the west side of San Felipe Road approximately 230 ft.
south of Alcalde Road in a Rl-lO (Residential Single-family, 10,000
sq. ft. minimum lot size) zoning district and RHS (Residential
Single-family, Hillside Development) zone. First reading.
Tentative City Council hearing date - December 21, 1981. Applicant

Permit to construct 14 residential dwelling units: Tentative
Map to subdivide the property into 14 airspace condominium units
on one commmon area parcel and Environmental Review: The Environ-
mental Review Committee recommends the granting of a Negative
Declaration. The subject property is located on the west side
of Saratoga-Sunnyvale Road approximately 700 ft. south of Wildflower
Way (behind the Galaxy Lighting retail facility). First Hearing
continued. Applicant requests withdrawal from calendar.
It was moved by Com. Blaine, seconded by Com. Adams and passed unan-
imously to postpone hearing of Application 26-TM-8l and to withdraw
Applications 23-Z-8l, 2l-U-8l and l8-TM-8l from the agenda.

imously to schedule any continued hearings to an adjourned regular
meeting of Wednesday, January 13, 1982 and to conduct the hearing per-

1. Application l-GPA-8l of City of Cupertino: Public Hearing to
consider a General Plan Amendment involving the Town Center Planning
Area. The Town Center Planning Area is generally bounded by Stevens
Creek Boulevard, Blaney Avenue, Rodrigues Avenue and De Anza
Boulevard. Environmental Review: The Environmental Review Committee
recommends the granting of a Negative Declaration. First Hearing
continued. Tentative City Council hearing date - January 4, 1982.
2. Application 7-U-8l of Lincoln Property Company N.C. Inc.: Use
Permit to construct two office buildings equaling a total of
130,000 sq. ft. in a P (Planned Development with commercial/office
and residential, maximum 30 dwelling units per gross acre intent)
zone and Environmental Review: The Environmental Review Committee
recommends the granting of a Negative Declaration. The subject

3. Applications 27-Z-8l, 23-U-8l and 22-TM-8l of Town Center Properties,
Ltd.: Rezoning approximately 14 acres from P (Planned Development)
to P (Planned Development with commercial, office and residential,
15-30 dwelling units per gross acre intent) zone or whatever zone
may be deemed appropriate by the Planning Commission; Use Permit to
construct 366 residential condominium units and 28,000 sq. ft. of com
mercial/office space; Tentative Map to subdivide 14 acres into 366
residential condominium parcels, one common parcel, and one commer-
cial/office parcel and Environmental Review: The Environmental Re-
view Committee recommends the granting of a Negative Declaration.
The subject property is located between Stevens Creek Boulevard and
Rodrigues Avenue approximately 700 ft. west of South Blaney Avenue.
First hearing continued. Tentative City Council hearing date -
January 4, 1982.
Assistant Planning Director Cowan reviewed the applications with Com-
mission.
Questions were asked by Commissioners regarding Application 7-U-8l of
Lincoln Property Co., the Itgrade separationll referred to on an exhibit
(this will be for pedestrians if development is high intensity. The
Commission requested that that information be included on the key for
the exhibit.). Concern was expressed regarding the safety of the pos-
sible pedestrian underpass.
Discussion followed regarding the levels of service of traffic at the
De Anza/Stevens Creek intersection, the De Anza/Rodrigues intersection
and the Stevens Creek/Blaney intersection.
The possibility of a post office being located in Town Center was also
discussed.
Mr. Burch Boone, Lincoln Property Co., submitted renderings of the pro-
posed project. He stated that he had seen the Commission report Friday
afternoon.
Mr. Tom O'Donnell, lawyer representing Cali Properties, also stated that
he had seen the plan Friday afternoon. He stated that he would prefer
that the Cali mill continue in operation while some development was
going on as the mill did employ many people. He requested that further
thought be given to the need for residential development in Town Center
and its apportionment. He felt that the proposed plan was conceptual but
at the same time was specific. He requested that the Commission allow
May Co. and Lincoln Property Co. to develop.

The Commission discussed the following items: do we want to adopt
16 trip ends for the entire property; in each piece, shall there be
mixed development or shall each piece contain only one type of de-
velopment; if the residential is allocated, what shall be the total
number of units and how shall they be allocated; how much flexibility
will be allowed. The Commissioners agreed that at this time, a 16
trip end constraint would be appropriate. A majority of Commissioners
expressed support for mixed use within each property.
Discussion followed pertaining to the possibility of trading resi-
dential requirement similar to the way trip ends are traded and whether
or not a range or band should be determined for number of residential
units and the developer could develop within that range or band.
Mr. Burch Boone, Mr. Alf Modine and Mr. Tom O'Donnell addressed the
Commission regarding what is fair and equitable as far as determining
where the residential will be built.
Chairperson Claudy expressed concern regarding a proposed band of
numbers of residential units. He felt that the lower limit would most
likely be built.
Mr. Marty Hall, Town Center Properties, Ltd., stated that that particular
firm did want to develop residential units.
Mr. Boone stated that to plan equitably, Seven Springs Ranch should
also have commercial.
Mr. O'Donnell stated that those whom he represented wanted a project
that would be reasonable right now. He expressed the opinion that
housing would not be reasonable in that location and that one could
not trade something no one wanted (reference to trading of residential
requirement).
The Commission expressed a preference for 12 units per acre for the
47.11 acres totaling 570 units. Town Center Properties will construct
approximately 370 units, leaving 158 units on Cali property and 42
units for Lincoln Property Co. In regard to the general site plan,
Commission stated they would be opposed to a solid ring of buildings
around the perimeter of the property and would favor higher intensity
at the Stevens Creek Boulevard/De Anza Boulevard corner. The
Commission stated it would accept a building in airspace over Torre
Avenue tieing together buildings. Also, if residential is developed
there, a pedestrian overpass could be possible. The Commission also
stated that the entire area did not need to be developed at the same
time, but offices could be built first and residential at a later
time. It was pointed out that the exhibit presented to the Commission
was merely conceptual showing general areas for buildings.
Com. Adams suggested that access from Stevens Creek Boulevard be removed.
Trading of
trip ends
By consensus, the Commission approved that trip ends could be traded
with both zones presently formed (Stevens Creek Zone; De Anza Zone).
Commissioners also agreed that the three property owners of Town

Center could trade residential within Town Center but not outside of tha
area.
It was moved by Com. Blaine, seconded by Com. Adams and passed unan-
imously to return Application l-GPA-8l to the Environmental Review
Committee.
It was moved by Com. Blaine, seconded by Com. Adams and passed unan-
imously to continue the public hearing of Application l-GPA-8l to the
meeting of January 13, 1982.
It was moved by Com. Koenitzer, seconded by Com. Adams and passed unan-
imously to continue the hearing of Application 7-U-8l to the meeting of
January 13, 1982.
Mr. Marty Hall representing Town Center Properties, Ltd. asked if
Applications 27-2-81, 23-U-8l and 22-TM-8l were compatible with the
Commissioners' desires.
Com. Adams requested access from Rodrigues Avenue.
Mr. Hall stated that he wished the architect to be present when the Com-
mission reviewed the design.
It was moved by Com. Blaine, seconded by Com. Adams and passed unan-
imously to continue the hearings on Applications 27-2-81, 23-U-8l and
22-TM-8l to the meeting of January 13, 1982.

4. Application 2-GPA-8l of City of Cupertino: Public Hearing to consi-
der a General Plan Amendment to permit public storage uses in
addition to residential uses on a 7.4 acre site located 600 ft. south
of Homestead Road and 360 ft. west of North De Anza Boulevard. The
Cupertino General Plan currently designates the property for medium/
high density residential uses at 10-20 dwelling units per acre.
Environmental Review: The Environmental Review Committee recommends
the granting of a Negative Declaration. First Hearing. Tentative
City Council hearing date - January 4, 1982.
Mr. John Vidovich of De Anza Properties addressed the Commission and
stated that he felt that any difficulties regarding access could be
overcome.
It was moved by Com. Blaine, seconded by Com. Koenitzer and passed unan-
imously to close the public hearing.
It was moved by Com. Adams, seconded by Com. Koenitzer and passed unan-
imously to recommend granting of a Negative Declaration for Application
2-GPA-81.

zoning approximately .58 gross acre from Santa Clara County Rl
(Single-family Residential) zone to City of Cupertino P (Planned De-
velopment with professional office intent) zone or whatever zone may
be deemed appropriate by the Planning Commission; Use Permit to con-
struct a 9,200 sq. ft. office building and Environmental Review: The
Environmental Review Committee recommends the granting of a Negative
Declaration. The subject property is currently in the County of Sant
Clara and is located on the southwest corner of Stevens Creek Boule-
vard and Stern Avenue. First Hearing. Tentative City Council hearin
date - January 4, 1982.
Mr. William G. Irvine, architect, reviewed the proposed plans with the
Commission.
Mr. Ed Anderson, a resident of Stern Avenue, expressed concerns regarding
adequate parking and additional traffic. He spoke in favor of the gate-
way concept, requested a stop light to be installed, and stated that the
dumpster would be all right in its present location if it were picked up
after 6:00 a.m.
Catherine Taylor, homeowner in the area, stated that the trash was picked
up about 10:00 a.m., and it was extremely noisy. She further stated that
traffic in the area was very heavy and inquired how traffic would be kept
off of Stern. She stated that the area of the proposed development is on
of the last containing reasonably priced homes and that the proposed
building takes four of those homes away. She stated that she did not
believe the proposed building was consistent with the rest in the area.
Mr. Anderson stated that even though some of the area being discussed was
not within the jurisdiction of Cupertino, recommendations from the Com-
mission would carry weight.
Mr. Irvine discussed Condition No. 20 of the proposed resolution with the
Commission. He was informed that the Cupertino staff would assist him
in gaining approval from the City of San Jose.
It was moved by Com. Adams, seconded by Com. Blaine and passed unanimousl
to close the public hearing.
It was moved by Com. Blaine, seconded by Com. Adams and passed unan-
imously to recommend granting of a Negative Declaration for Applications
30-Z-8l and 2s-U-8l.
It was moved by Com. Blaine, seconded by Com. Koenitzer and passed
unanimously to recommend approval of Application 30-Z-8l per Planning
Commission Resolution No. 2267.
It was moved by Com. Blaine, seconded by Com. Koenitzer and passed unan-
imously to approve Application 2s-U-8l per Planning Commission Resolution
No. 2268 with the addition of Condition No. 26 stating that if in the
future the location of the trash container became a nuisance to the
neighborhood, it must be relocated. Approvals were granted in accordance
with the findings and subconclusions as in the staff report.

It was moved by Com. Blaine, seconded by Com. Koenitzer and passed
unanimously to send a Minute Order (Planning Commission Resolution
No. 2273) to the Director of Public Works directing him to investi-
gate the traffic situation on Stevens Creek Boulevard and Stern Avenue
and to report back if there is any action the City can take to help
ameliorate the problem.
8. Application 3l-Z-8l of William and Brigitte Fyall: Rezoning approxi-
mately .15 gross acre from City of San Jose Rl-B6 (Single-family
Residential, 6,000 sq. ft. minimum lot size) zone to City of Cuper-
tino Rl-6 (Residential, Single-family, 6,000 sq. ft. minimum lot
size) zone or whatever zone may be deemed appropriate by the

The subject property is located on the north side of Newcastle
Drive approximately 300 ft. east of Aster Lane. First Hearing.

Planning Commission; Tentative Map to consolidate the above-referenced
parcel with an adjoining parcel to equal a total lot size of .3

Committee recommends the granting of a Negative Declaration. The
subject property is "L" shaped and is located on the south side
of McClellan Road approximately 100 ft. west of De Anza Boulevard
and continues around to De Anza Boulevard 145 ft. south of McClellan

1981 meeting - It was moved by Com. Blaine, seconded by Com. Koenitzer
and passed unanimously to cancel the Planning Commission meeting of
December 28, 1981.
Com. Blaine inquired as to the status of the building at Stevens Creek
Boulevard and Foothill Boulevard.
