JANUARY 25, 1982 IN THE COUNCIL CHAMBER, CITY HALL

Chairperson Claudy called the meeting to order at 7:33 p.m. in the Coun-
cil Chamber of City Hall.

APPROVAL OF MINUTES: It was moved by Com. Adams, seconded by Com.
Koenitzer and passed unanimously to approve the minutes of the January
11, 1982 Planning Commission meeting as submitted.
Minutes of the January 13, 1982 Planning Commission meeting - Com.
Koenitzer requested that page 3, paragraph 3, be clarified with the
addition of the words "below roof line" in regard to the enclosing of
air conditioning equipment. Com. Blaine requested that on page 7,
Com. Koenitzer's motion be clarified with the addition of the word
"abolishment" in regard to the BMR Program. It was moved by Com. Blaine,
seconded by Corn. Koenitzer and passed unanimously to approve the January
13, 1982 minutes as corrected.
POSTPONEMENTS OR NEW AGENDA ITEMS - None
WRITTEN COMMUNICATIONS
Chairperson Claudy stated that communications had been received from
Prometheus Development Co. and Terranomics. The letter received from
Prometheus will be reviewed with agenda item no. 1. The communication
received from Terranomics dealt with trip end constraints at Orchard
Valley Market Place Shopping Center.

Area. The Town Center Planning Area is generally bounded by
Stevens Creek Boulevard, Blaney Avenue, Rodrigues Avenue and De Anza
Boulevard. Environmental Review: The Environmental Review Committee
recommends the granting of a Negative Declaration. First Hearing
continued. Tentative City Council hearing date - February 16, 1982.
2. Applications 27-Z-8l, 23-U-8l and 22-TM-8l of Town Center Properties,
Ltd.: Rezoning approximately 14 acres from P (Planned Development)
to P (Planned Development with commercial, office and residential,
15-30 dwelling units per gross acre intent) zone or whatever zone
may be deemed appropriate by the Planning Commission; Use Permit to
construct 366 residential condominium units and 28,000 sq. ft.
of commercial/office space; Tentative Map to subdivide 14 acres
into 366 residential condominium parcels, one common parcel, and one
commercial/office parcel and Environmental Review: The Environmental
Review Committee recommends the granting of a Negative Declaration.
The subject property is located between Stevens Creek Boulevard and
Rodrigues Avenue approximately 700 ft. west of South Blaney Avenue.
First Hearing continued. Tentative City Council hearing date -
February 16, 1982.
Assistant Planning Director Cowan exhibited transparencies showing
a "bubble" plan as previously requested by the Commission.
The letter received from Prometheus Development was read into the record
by Chairperson Claudy.
Com. Blaine requested that bus turnouts be included on De Anza Boulevard
on the south side of Stevens Creek Boulevard and expressed concern
regarding recreation space in the area should Eaton School be closed
and sold.
Mr. Burch Boone, Lincoln Properties, stated that there had been a reduc-
tion in residential and therefore the numbers on Figure 2E should be
adjusted.
Assistant Planning Director Cowan gave a presentation pertaining to
Applications 27-Z-8l, 23-U-8l and 22-TM-8l and reviewed drawings of
the proposed development.
(City Clerk's Note: Director of Public Works Viskovich arrived at
8:02 p.m.)
Mr. Marty Hall, Town Center Properties, introduced the architect
of the development - Chris Laman of Fisher-Friedman, San Francisco.
Mr. Laman reviewed fire access and parking areas in the proposed
development. He also questioned Commission in regard to this developer
being responsible for the completion of Torre Avenue and the two signals.
Discussion followed regarding the Torre Avenue extension, the height
of the proposed buildings, fencing around the tennis courts, lighting
of the tennis courts and recreational vehicle parking. The Commission
expressed concern regarding security in the underground parking facility
and asked if the Sheriff's Department had reviewed the plans.

(Assistant Planning Director Cowan later informed the Commission that the
plans had been submitted to the Sheriff's Department but the City had
received no response.)
The Commission also inquired regarding earthquake safety.
Marty Hall, Town Center Properties, stated that he would not take issue
regarding the completion of Torre Avenue at this time. He further stated
that he may wish to increase the commercial/office space in the future.
Mr. Stan Scarborough, 10571 Whitney Way, expressed concern regarding the
density and potential traffic problems as well as lack of open space.
He objected to some of the numbers used in the report submitted by the
Director of Public Works. He presented a suggested traffic pattern and
street design to the Commission.
It was moved by Com. Koenitzer, seconded by Com. Adams and passed unan-
imously to close the public hearing on Application l-GPA-8l.
It was moved by Com. Koenitzer, seconded by Corn. Adams and passed unan-
imously to recommend the granting of a Negative Declaration for Applica-
tion l-GP A-8I.
It was moved by Com. Koenitzer, seconded by Com. Adams and passed unan-
imously to recommend approval of Application I-GPA-8l per Planning Com-
mission Resolution No. 2276 with the following modifications of the plan:
Page 2-40, paragraph 2, last sentence to read "intensities and types".
Page 2-43, add a bus turnout on De Anza Boulevard.
Figure 2E - recalculate amount of office space for Cali and Lincoln
Properties.
It was moved by Com. Koenitzer, seconded by Com. Adams and passed unan-
imously to close the public hearing on Applications 27-Z-8l, 23-U-81 and
22-TM-81.
It was moved by Com. Koenitzer, seconded by Com. Adams and passed unan-
imously to recommend the granting of a Negative Declaration for Appli-
cations 27-Z-81, 23-U-81 and 22-TM-8l.
It was moved by Com. Koenitzer, seconded by Com. Adams and passed unan-
imously to recommend approval of Application 27-Z-8l with Standard Con-
ditions 1-12 and Conditions 15, 16 and 17 as per Planning Commission
Commission Resolution No. 2277 with findings in accordance with the staff
memo s .
It was moved by Com. Koenitzer, seconded by Com. Adams and passed unan-
imously to approve Application 22-TM-8l per Planning Commission Resolutio
No. 2279 with Standard Conditions 1-12 and Conditions 15 through 21 as
submitted and the addition of Condition No. 21 as follows:
21. Applicant shall present for Planning Commission review a staging
plan of the development prior to signoff on the final map.

BMR Program
MINUTES OF THE JANUARY 25, 1982 PLANNING COMMISSION MEETING
It was moved by Com. Koenitzer, seconded by Com. Adams and passed
unanimously to approve Application 23-U-8l per Planning Commission
Resolution No. 2278 with Standard Co~ditions 1-14, Conditions 15-20 as
submitted, Condition 21 amended to read as follows:
21. All applicable subsections of Section 13.5 and 13.6 of the RlC
Ordinance (Ordinance No. 664) regarding street improvement require-
ments and covenants shall apply to the subject development.
Approval of Application 23-U-8l is also subject to Conditions 22-25
as submitted and the following additional conditions:
26. The land use mix for the 28,000± sq. ft. non-residential segment
of the floor area shall be office and office-related commercial.
Office-related commercial is defined as personal services and
limited retailing activities such as real estate, title insurance,
general insurance, travel agencies and other activities which
support office use. The intensity of use shall be regulated by the
traffic intensity standard contained in the General Plan. The
hours of operation of office and office-related commercial uses shall
be regulated by the Parking Management Plan approved by the City.
27. Lighting for the tennis courts shall not impact the adjacent resi-
dential areas. Tennis court lighting shall not be used after
10:00 p.m.
28. The applicant shall present for Planning Commission review a
staging plan of the development prior to signoff on the final map.
29. The applicant shall have an analysis and report prepared by the
sheriff's department regarding increasing security in the area.
This report shall be reviewed by the Planning Commission when the
staging plan is reviewed.
UNFINISHED BUSINESS
3. Application 23-U-80 of D.C.E., Inc. (Richard Childress) - Request
for extension of use permit.
.It was moved by Com. Blaine, seconded by Com. Binneweg and passed
unanimously to grant a one year extension from 3/15/82 to 3/15/83
per Planning Commission Resolution No. 2280.
Director of Planning and Development Sisk informed Commission that the
Council has approved a hearing in regard to the BMR Program. This would
include the possibility of eliminating the program from the General Plan.
Following discussion regarding the proposed amended policy pertaining
to the BMR Program in relationship to the fact that the BMR Program
may be abolished, the Commission felt that at the meeting of February
22, 1982 at which time changes in the procedure will be considered,
they will continue that hearing to such time as the hearing on the
Housing Element of the General Plan.
