MINUTES OF THE REGULAR MEETING OF THE PLANNING COMMISSION
HELD ON FEBRUARY 8, 1982 IN THE COUNCIL CHAMBER, CITY HALL
CUPERTINO, CALIFORNIA
The meeting was called to order at 7:30 p.m. by Chairperson Claudy.

It was moved by Com. Blaine, seconded by Com. Koenitzer and passed unan Minutes approvel
imously to approve the minutes of the regular meeting of January 25, as submitted
1982 as submitted.
Minutes of regular adjourned meeting of January 26, 1982 - Com. Koenit-
zer requested that on page 2 pertaining to the presentation by the
Director of Public Works that the four alternates presented be in-
cluded.

the railroad tracks to Stelling".
It was moved by Com. Koenitzer, seconded by Com. Blaine and passed
unanimously to approve the minutes of the regular adjourned meeting
of January 26, 1982 as amended.

PUBLIC HEARINGS
1. Application 7-U-8l of Lincoln Property Company N.C. Inc.: Use
Permit to construct two office buildings equaling a total of 130,00
sq. ft. in a P (Planned Development with commercial/office and
residential, maximum 30 dwelling units per gross acre intent)
zone and Environmental Review: The Environmental Review Committee
recommends the granting of a Negative Declaration. The subject
property is located on the north side of Rodrigues Avenue from
De Anza Boulevard to a point approximately 400 ft. easterly of
Torre Avenue. First Hearing continued. Tentative City Council
hearing date - February 16, 1982.

It was moved by Com. Blaine, seconded by Corn. Adams and passed
unanimously to continue Application 7-U-8l to the meeting of February
22, 1982.
2. Application 29-U-8l of Wahib Costandi: Use Permit to construct
a 7,000 sq. ft. retail commercial building in a P (Planned
Development with recreation, entertainment and limited commercial
intent) zoning district and Environmental Review: The Environ-
mental Review Committee recommends the granting of a Negative
Declaration. Said property is located on the southeast corner
of Homestead and Stelling Road within the Brunswick Center.
First Hearing. Tentative City Council hearing date - February
16, 1982.
Director of Planning and Development Sisk reviewed the application
with the Commission.
Mr. Wahib Costandi was available for questions from the Commissioners.
It was moved by Com. Blaine, seconded by Com. Binneweg and passed
unanimously to close the public hearing.
It was moved by Com. Blaine, seconded by Com. Koenitzer and passed
unanimously to recommend the granting of a Negative Declaration.
It was moved by Com. Blaine, seconded by Com. Binneweg and passed
unanimously to recommend approval of Application 29-U-8l per Standard
Conditions 1-14 and Conditions 15 and 16 of Planning Commission
Resolution No. 2281 with findings and sub conclusions per staff
report.
3. Application 30-U-8l of Eli McFly (Barnhart Construction Company):
Use Permit to operate a restaurant and bar with a capacity of 200
seats in an existing shopping center in a P (Planned Development
with commercial, light industrial and residential intent) zoning
district and Environmental Review: The Environmental Review
Committee recommends the granting of a Negative Declaration.
Said property is located on the southwest corner of Valley Green
Drive and De Anza Boulevard. First Hearing. Tentative City
Countil hearing date - February 16, 1982.
Associate Planner Piasecki reviewed the application with the Commission.
Mr. David Nevis, partner in Eli McFly, stated his exceptions to
various conditions. He requested that they be required to restripe
to get maximum parking spaces and not have to change any concrete
and/or landscaping as they exist. Condition 18-3 was clarified.

It was moved by Com. Adams, seconded by Com. Binneweg and passed
unanimously to close the public hearing.
It was moved by Com. Adams, seconded by Corn. Koenitzer and passed
unanimously to recommend the granting of a Negative Declaration.
It was moved by Com. Koenitzer, seconded by Com. Adams and passed
unanimously to recommend approval of Application 30-U-8l as amended:
Standard Conditions 1-14; Conditions 15 and 16 as submitted; Condition
17 - the applicant shall provide a minimum of 73 on-site parking spaces
which shall comply with the City of Cupertino standards for size and
backup area. The applicant shall try to maximize the number of parking
spaces by restriping; Condition 18, second sentence was changed to
read, "Should parking become a problem as determined by the City of
Cupertino, the applicant hereby agrees to the following:" Findings
and subconclusions per staff recommendation.
4. Applications 19-Z-8l and l8-U-8l of De Anza Forge (Cupertino Vil-
lage): Rezoning approximately 7.3 gross acres from A (Exclusive
Agriculture) to P (Planned Development with residential 10-20
dwelling units per gross acre and mini-storage intent) zone or
whatever zone may be deemed appropriate by the Planning Commission;
and Use Permit to construct 96 residential condominium units and a
mini-storage facility and Environmental Review: The Environmental
Review Committee recommends the granting of a Negative Declaration.
Said property is located on the southwesterly quadrant of Homestead
Road and De Anza Boulevard just north of Highway 280 (behind
Homestead Square Shopping Center and De Anza Lumber). First Hear-
ing. Tentative City Council hearing date - March 9, 1982.
Associate Planner Piasecki reviewed the application with the Commission
John Vidovich representing De Anza Forge stated that they hoped to have
the development exit through the existing lumber yard. He stated
that he needed as much flexibility as possible in regard to Condition
No. 23 of Application l8-U-8l. He further stated that he was planning
to build the residential models at the same time as the mini-storage.
He would build the models and rough grade the sites for residential
and probably build the first two buildings at the time of building the
mini-storage.
Mr. Otis Forge, property owner, stated that high interest rates were
holding up the building and that access was already available through
the lumber yard. He expressed concern regarding having to build too
much residential at first. He also objected to the street improvement
requirement on the use permit pertaining to the widening of Homestead
Road.
It was moved by Com. Koenitzer, seconded by Com. Binneweg and passed
unanimously to close the public hearing.

It was moved by Com. Koenitzer, seconded by Com. Adams and passed
unanimously to recommend granting of a Negative Declaration.
It was moved by Com. Adams, seconded by Com. Blaine and passed
unanimously to approve Application 19-Z-81 with Conditions 1-15
as submitted, Condition 16 amended to read, "The mini-storage
component shall not exceed 33% of land area and shall be constructed
in conjunction with construction of at least two residential buildings
(16 units) and the rough grading of the site."
Commissioners Koenitzer, Claudy and Blaine did express reservations
regarding the possibility of ending up with just a few residential
units.
It was moved by Com. Adams, seconded by Com. Blaine and passed
unanimously to recommend approval of Application 18-U-81 with Conditions
1-16 as submitted; with the last sentence in the second paragraph
of Condition 17 revised to read, "All window assemblies facing
northeast and south on the perimeter buildings shall achieve a
minimum sound transmission sound rating of 25 dBA reduction in the
exterior to interior noise level"; Conditions 18-22 as submitted;
Condition 23 amended with the last sentence to read, "The mini-storage
facility shall be constructed in conjunction with construction of
at least two of the residential buildings (16 units). The entire
site shall be rough graded."; Conditions 24-27 as submitted;
subject to findings and subconclusions of staff report.
5. Application ll-TM-8l (Revised) of Clearlake Development:
Tentative Map to allow subdivision of a 28,600 sq. ft. office
building into 40 or fewer condominium office units in lieu of
20 units as previously permitted and Environmental Review:
No Environmental Review is necessary as the project was previously
assessed. The subject property consists of 1.8 acres located
on the north side of Stevens Creek Boulevard approximately
100 ft. east of Randy Lane in a P (Planned Development with
commercial and professional office use intent) zoning district.
First Hearing. Tentative City Council hearing date - February
16, 1982.
Director of Planning and Development Sisk reviewed the application
with the Commission.
It was moved by Com. Blaine, seconded by Com. Binneweg and passed
unanimously to close the public hearing.
It was moved by Com. Blaine, seconded by Com. Adams and passed
unanimously to recommend approval of Application ll-TM-8l (Revised)
per Standard Conditions 1-14; Condition 15, 16 and 17 as submitted;
and findings and subconclusions of the staff report.

The Commission inquired regarding the status of the building on !
Foothill and Stevens Creek Boulevard. Director of Planning and DeveloP1
ment Sisk will report back regarding when the use permit will expire. 1.
Com. Blaine requested that Mr. Busto be notified that the "pink ì

palace" has been written on again. It was requested that he contact 1
the owner. ~

Com. Koenitzer inquired as to whether or not the new Far West Savings 1
and Loan Building was occupied at this time. The Director of Planning;
and Development will report back regarding the condition of the buildin~
and the. residential foundations next to it. ¡
At 9:05 p.m. the meeting was adjourned to 7:30 p.m., Tuesday, February
9, 1982 at Kennedy Junior High School.
